(1) Any person under twenty-one who owned land could execute a deed (to sell the land) through the guardian.11 This law tells us that persons younger than twenty-one could own land, as by inheritance or gift, but could not sell it without the participation of the guardian. (2) Every person of the age of twenty-one or more who was of sound mind and not a married woman could write a will and devise property with two or more credible witnesses.12 This meant, of course, that married women could not write wills. (3) No person under the age of eighteen could write a will to dispose of his chattels (primarily livestock, slaves, tools, farming implements, and other movable, tangible property; not land).13 This implies, then, that persons younger than eighteen could own such property but only those eighteen or older could write a will that would be recognized by the court. Likewise, finding a will of a single young man, an ancestor's brother, for example, would lead a genealogist to estimate that he was at least eighteen. He may have been older but was not younger. (4) When Virginia began collecting taxes in 1782, just after the end of the Revolution, the General Assembly spelled out procedures. (As we use the microfilmed Virginia tax records at Clayton Library, it can be helpful to keep up with changes in the tax law.) Each county court was to divide its county into precincts or districts for tax collection purposes. Annually before March 10, the county court was to appoint a justice for each precinct to make a list of enumerated (taxable) articles therein. The justice was to give public notice of when and where he intended to receive the lists from the taxpayers and was to deliver the lists and vouchers for payment on or before April 20 to the clerk of the county court. The justice was to make a "fair alphabetical list" of the names of all free males over twenty-one residing in his precinct, the names of all slaves and to whom they belonged, and the lists of other taxable property reported by the taxpayers. For his part, every head of household or his agent was to deliver to the justice in his precinct, between March 10 and April 10 annually, a list of the names of all free males in the household over twenty-one, names and numbers of slaves belonging to his family as of March 9, and numbers of cattle, horses, wheels on wagons and carriages of all kinds, billiard tables, and other taxable property. A fine of 500 pounds of tobacco was to be assessed for concealing tax information from the county court.14 These instructions imply that the taxpayers went to the tax collector and not vice versa. It is possible, however, that some justices may have gone to their taxpayers or, logically, may have been in a given neighborhood on a given date to receive the tax lists. Thus, using the date given on some of the tax lists beside each taxpayer's name, a researcher may still be able to identify potential neighbors based on those who paid their taxes on the same day. A third reason for genealogical use of the statutes is that many individual ancestors are named in them. For example, a 1791 act dissolved the marriage of Robert Turnbull and Sarah Buchanan.15 Other individuals were named as trustees of schools and academies that the legislature chartered or were the subject of private relief acts. Two good examples appear in Shepherd's Statutes, the continuation of Hening' s effort. First, in January 1808, an act stated that David Black, son of Dr. David Black, late of Blandford (part of Petersburg), had died, leaving about seventy-two acres of land in Blandford. By act of the assembly, the land was now to belong to James Sample and his wife, Joanna, the said Joanna being the nearest of kin in the United States to the said David Black, the younger, at the time of his death.16 The genealogical implications of this document are obvious. If the genealogist did not already know this connection, the find is marvelous and the next steps in research are clear: marriage record for James and Joanna, probate records of both David Blacks, land records of Petersburg, etc. Secondly, also in January 1808, the assembly authorized William Faulkner, coroner of Halifax County, to deliver over to Jacob Faulkner, as trustee, for the use and benefit of Patsey Oliver, wife of Achilles Oliver, and her children, until the death of Achilles or until he was taken or surrendered himself to justice, all the real and personal estate of Achilles Oliver which William Faulkner was holding in consequence of Achilles absconding and refusing to surrender himself on his having been found guilty of murdering Joseph Gholston, by the inquest of William Faulkner, coroner.17 This kind of record can open the proverbial can of worms but may help answer other nagging questions of the diligent genealogist. Virginia researchers are indeed fortunate to have at their fingertips at Clayton Library such valuable resources as Hening's Statutes, Shepherd's Statutes, the Laws of Virginia supplement, Casey's index, and the Swem index. Laws passed after 1808 can be accessed at university and law libraries that have collections of the session laws from the various states. Bibliography Casey, Joseph J. Note: The Sarah Ferguson we contamplate might have married Thomas Younger was not the daughter of John Ferguson and Sarah, whose last name was either Gatewood or Bridgeforth, according to people researching that line. I am not going to get too involved, as it is not important, other than to disregard them. This John Ferguson, who names a dau Jail (Jael) in his will was b 1741; d 1812 and she marries Thomas Ryland. This family really gets mixed up as they intermarry with cousin's wife's stepbrother's uncles or something that bad!! Their dau Sarah was married to a Griffin/Grigging at the time of the Will and Thomas Younger was not dead until 1791... Also, this John Ferguson was son of John Ferguson and Ann Stubbleson, who are better candidates for our Sarah's parents. I am not willing to eliminate her as yet... as a wife of Thomas.

[Names slaves Fanny and Harry, providing for them to buy their freedom with a sum of money to her heirs named in the Will; sister Mary Estes; nephew, Younger Wyatt and his wife Polly; witness DOLLY LIGHT.] -Settlement of Estate: 28 Aug 1833; Executors S. C. Jackson and Richard Cook; Payees, Lucy Younger, John Lamdrum, Rec'd Samuel Younger, Joel Younger, Thomas Younger and Daniel Mills, Sr. [Halifax County, Virginia Will Book: Bk 15, pg 422.] Rachel Wyatt, dau of Leah Younger, marries a man named Joseph Landrum, possibly another coincidence, but they were married in Halifax abt 1814. (By 1821 they were in Indiana.) Marcus, if the abstract is in context, names his dau Susannah first, who was unmarried. Second he names grson James Wyatt, before his other children. Did he do this because James had no parents, or father? These Will Abstracts I have posted were obtained online by doing a search on the name, via FTM. I cut and pasted all I have on Marcus, but am still looking.     3. I want to make a correction regarding the information about James Younger, ancestor of Helen Turney McMindes, etc. He was not my ancestor, but was the ancestor of my first husband, Don Turney. Don was the son of Martha Alice Younger and Elmer Turney. Martha was the daughter of Jasper Newton Younger, the son of Alexander, the son of Thomas and on back.     3. Found while rummageing through more files, a copy of a letter from Dee Fozzard to Dreat Younger. Dreat sent it to me. It was written on stationery of The Genealogy Society of Southern Illinois,John A. Logan College, Route 2, Carterville, Illinois 62918. The date was 15 Dec 1987. Letter was as follows: "Dear Dreat, I joined the D.A.R (#684412) thru Laura Helen Younger Kell's Great Grand father, Joshua Logan Younger [underscore mine]. She was Coleman Younger's sister. I ordered Joshua's War Record and discovered he had served in Valley Forge in Captain William Vance's Co. of the 12th VA. Reg't. commanded by Col. James Wood from his Company Pay Roll sheets. In Nov. 1983, a member, Dessie Harrelson, of McLeansboro, Ill. announced to our Society, "The Genealogy Society of Southern Illinois," that she had been accepted as a new member of the "Society of the Descendants of Washington's Army at Valley Forge." She gave me the address to order the application forms. Then I began the task to prove the lineage of each generation. Since no one had entered on Joshua's record, I had to show where I obtained each proof, thru, births, death and marriage certificates, wills, etc. We are not allowed to use a quote from a book or other society's papers as proof. Many people shared their data with me: Louella Myers, Wilbur Zink, Marley Brant, Mabel Motes, Dreat Younger, Jay Younger, Margarette Hutchins, Ruth Whipple, Robert Brashier, Leola Mayes, Billie Smith, Sylvia Creek, June Spicer, Harriet Wickstrom--the list goes on and on. These people are all of the wonderful people I have met thru the "Friends of the Youngers." As Marley Brant told me "As we know families, whether they be biological or the family of friends, are what life is all about. The D.A.V. Commissary General of Muters [That is what it looked like. It is unfamiliar to me and I didn't find it in my dictionary. HM], Mrs. Bettye G. Wilson also gave me a lot of assistance on each step to take. Anyone interested in getting informaiton of the D.A.V. should write to the Society of the Descendants of Washington's Army at Valley Forge, P.O. Box 915, Valley Forge, Pa 19482-0912. I had problems with Charles Lee Younger's [again my underscore] proof that he was Joshua's son. His name wasn't listed on Joshua's Pension Record. Finally I obtained the marriage of intent for Nancy Toney to Charles Younger with his father's consent from Garrard Co, Ind., Marriage and Marriage Bonds of 1796 thru 1851 Book. I'll share any material I have. My D.A.V. #603 can be also used by any direct descendant of Joshua Logan Younger. They wish to compile the Roll of our Honored Dead at Valley Forge and the Rolls of all the soldiers at the Encampment to preserve their names and honor for posterity. To discover, compile, preserve and publish the incidents of the Encampment at Valley Forge. A good book on "Valley Forge ---In Search of That Winter Patriot" by Ramona Cameron Worley. I've enclosed some of it's pages. Still Searching Dee Fozzard" I copied the above letter exactly as it was written. It would seem that she was able to establish the Logan and Lee names with authentic documentation. I have not checked any of this out, just submitting it for your information. Helen
