The earliest record in Pendleton County of a land transaction involving John Dolly was dated 7 October 1793. It documents the transfer of 197 acres on North Fork River from John Wolf of Botetourt County, Virginia, and his wife Magdalene.10 This perhaps refers to the property which became the Dolly homestead. It was followed by grants from Samuel Day in 1805 for two properties opposite one another "on the North Fork of the South Branch," and a grant from Zebulon Dyer in 1811 "adjoining Dolly's own land."11 There are intriguing indications in a later land record which support the theory that Dolly was a landowner on the North Fork as early as 1785. Most of his real estate was dispensed in two deeds of 1847. Because that was the year of his death, these transfers will be referred to here as deathbed grants. The first of these, dated 22 January, deeded to Andrew Dolly-the eldest son-one of the acreages purchased in 1805. The first transaction you mention regarding John Dolly's 197a from Wolf is regarding land that is described as on Buck Lick and is specifically excluded from a large grant to Robert McCullock in 1796. That places the land south of the large Chambers grant (mentioned in an earlier email) and on the east side of the North Fork (considerably further south than the Samuel Day grants which were on the North Fork near the Hardy/Grant Co line). There is another grant that appears to join the 197a and it was to John Dolley [a spelling variation] for 140a as assignee of Philip Helmick. Thank you for the most informative posting. I found the information regarding the boundaries very helpful to all Pendleton County researchers, and especially because it names so many residents to pinpoint the exact location of the new boundary. And, the mention of the dwelling house of Samuel Day proves that he lived there several years prior to his 1796 land grant. Perhaps the deed and land grant records of Hardy County or even Hampshire should be pursued for land acquired by Samuel Day prior to 1789. Oren Morton corrected this in his "A Handbook of Highland County and A Supplement to Pendleton and Highland History (1922), page 67. In 1789 this boundary between Pendleton and Hardy Counties was moved from the original set in 1787 when the county was formed, to approximately 5 miles farther north than the original. The original line was described "to strike the mouth of Seneca and the south line of Sweedland Hill." (Sorry, I do not have the full description which would be in the State records of the formation of the county." The description in the post would appear to be the new line--note it crosses South Fork at the point of Sweedland Hill and references the north point of Sweedland Hill rather than the south line of Sweedland Hill. Thus, it is important to consider before or after March 1789 in determining which county was the residence. Remember that "below" refers to the flow of the river so as noted, "below" Samuel Day's house was north of it. However, since the original line was 5 miles farther south, it would seem that Samuel Day's house was originally built in Hardy County before the Pendleton-Hardy county boundary was adjusted in 1789. A report of the surveyors on the line between Pendleton and Hardy Counties was presented in March 1789 and reads as follows: "Beginning at three chestnut oaks, a white oak and chestnut tree on the top of North Mountain, opposite the north point of Sweedland Hill, and running thence N 51 degrees W, crossing the South Fork at the point of Sweedland Hill, through the land and above the dwelling house of Charles Wilson, and crossing South Mill Creek through the land and above the dwelling house of Charles Borrer, and crossing North Mill Creek through the land and above the dwelling of Nicholas Judy, and crossing the South Branch through the land and below the dwelling house of David Hutson, and crossing the North Fork through the land and below the dwelling house of Samuel Day; thence through the Clay Lick a straight course to the top of the Alleghany Mountain, containing 21 miles in distance." The report was signed by Moses Hinkle, surveyor of Pendleton, and by John Foley,assistant to Joseph Nevill, surveyor of Hardy. Oren F. Morton's, A History of Pendleton County West Virginia, page 89. Based on the above surveyors report, Samuel Days land was located on the North Fork at the present day Pendleton/Grant County line (Grant County was formed from Hardy County in 1866). The report states that the county line crossed below Samuel Day's dwelling house. That would place Samuel's house on the Pendleton County side of the line.
