Dear List, Does anyone know of any WV laws-- either State or county--protecting old Cemetery from destruction? I received this message concerning Baptist Cemetery, Ten Mile Creek nr Robey. "Any idea on how we could find out who now owns this plot of ground. [referring to Tenmile Cemetery] I am worried of its loss via construction. There are lots of new homes going up as retirees take advantage of the open space and low land prices. The plot could be in private hands now. It is about to disappear by the overgrowth. (______) knows of an old cemetery up in the woods in Camp Run. In the 1930 most of the hills were pastures and open. The overgrowth has been in the last 50 years so there may be many losses. And there are new logging roads being put in all over the place." Sometime ago, there was a discussion on one of the county lists abt this subject, but I can't remember what was said nor what list it was on. Are there laws in place to protect these old treasures and does anyone know who is responsible for keeping Cemeteries cleared if they are not perpetual care and no longer being used? Mariana
When I went to the Clerks office I was told that a cemetery could not be sold with the land. My grandmother was burried at the county poor farm and the county sold the land. They told me that the cemetery is still considered open to the public because they can not sell the cemetery per say. I was told that it was up the the family members to keep the up keep.
