I know of two cases in Pendleton County where the child was "sworn" to the father who was not the husband of the mother and took the last name of his/her biological parent.
I have read the will of Elizabeth Tharp, written in 1843, and there seems to be question of when it was probated, 1843 or 1863. In the will Elizabeth names her son, Solomon as executor of her estate and in 1860 census for Hardy County, VA, show SolomonTharp, age 48 with wife and children and mother, age 64, Elizabeth Tharp, living with him. My interest in this will is that she names as her heirs, among others, the children of her son, John Tharp, one Elizabeth Ann Tharp, whom I believe might have been my g.g. grandmother that I have been trying to identify parentage. Anyone out there have anything on Solomon Tharp and his parentage, siblings, etc? Sheliamichael@tularosa.net

I have been looking for Weese, Wease, Weis, Wise records from Hardy County and so far have found them in Frederick, Hampshire. and Hardy Counties. It has been my experience that the child USUALLY took the mother's surname if not married.....but not uncommon for the child to then go by the surname of a man she would later marry. I have one man in my genealogy that was born out of wedlock, he took on his mother's surname, she married, he started using her husband's name, then he moved away from Hampshire County to Springfield, Clark Co., OH and when he moved back to WV, someone convinced him that a certain man was his biological father and he then took that surname until his death. Upon finding birth information for children out of wedlock, most carry their mother's surname and maybe at a later time, are adopted by the man she marries and will assume that surname. What was the usual practice for naming an illegitimate child back in the late 1880's? There was never any indication that my great grandmother married the man, but her child carried a different last name from her. My great grandmother later married another man and the child then carried his last name and the last name of her father. This is so difficult to explain. The child was named Martha Viola Parker. The mother was never married to a Parker. At least I have not been able to make a connection. She married a Nazelrod, and the child then assumed his last name, Martha Viola Parker Nazelrod. So my question is: Did they have to be married to the man to give his last name to the child, or am I to assume that a Parker fathered the child and she just gave the child his last name? Rose, My Tharp (Thorpe) is Elizabeth Ann Tharp (g.g. grandmother), b. about 1823 in VA and married Covington Burch in Dec. 1839. The left Hardy County after 1858 (youngest son born there and in census his birthplace listed as VA) and in June 1860 census were in Piatt County, IL. Elizabeth Ann died in December of 1860 and is buried in Piatt County. Husband and children moved on to Jasper County, MO. I am never been able to identify Elizabeth Ann's parents. Or you can let the site select ALL of the available counties of West Virginia. Don't be discouraged if you don't get a find. It may mean that the person who retrieve the information from the original document couldn't read the handwriting and may have spelled the surname or first name differently than what you may have. In this case, type some letters with a wildcard in certain positions. For example, I am researching the surname Nazelrod but it has been spelled many, many ways. Therefore, I enter "N*l*r*d" minus the quotation marks and the site will show me ALL of the surnames that fit into the category. Try it! It contains priceless information!
