Garrett County, Maryland Land Records Liber 12 Pager 795 At the request of John S. COMBS this agreement was recorded Oct 14 1887 at 11:15 o'clock A.M. This agreement was made this 19th day of September in the year eighteen hundred and eigthy-seven, by and between John S. COMBS of the first part, and the Democratic Newspaper Company of Garrett County of the second part. Witnesseth that for and in consideration of the performance of the covenants hereinafter specified, the said party of the second part does hereby lease unto the party of the first part all the personal property, Printing Presses, good will and fixtures connected with the printing of the Mountain Democrat, which belongs to the said second party. Said property being more particulary described in a schedule hereto annexed and made a part of this agreement, said terms of renting to commence on the 13th day of October 1887, or as soon thereafter as the present lessee John B. FAY may surrender the same, and to continue for the term of three years unless said lease should be ended by the breach of any of the conditions hereinafter specified, by the party of the first part. The party of the first part covenants and agrees to pay as a rental for said property at the rate of six percent per annum, on the par value of the shares of stock issued by said company, which now amounts to the sum of fifteen hundred dollars, the par value of each share being fifty dollars, said rental to be paid semi annually to each share holder or their assigns, and upon default being made in the payment of said rental or interest or any part thereof, where as payable, there the said second party shall be at liberty to annul said lease. And it is further agreed that the party of the first part shall insure and keep insured the property hereby leased to the extent of at least one thousand dollars, and said policy of insurance shall be issued and held for the use of the said second party and that he shall pay all taxes, public dues or assessments that may be made upon this property, during the term of this lease, or while he remains in control, and it is further understood that he shall not sublet the same, without the consent of the second party, and that said property shall be returned in as good condition at the end of his renting as when took charge of the same, natural ware and tare excepted. And it is further covenanted and agreed on the part of the first party that he shall print and publish said paper in the interest and for the success of the Democratic party, and it is further agreed, that in the event, that if any differences should arise between the parties hereto as to the policy or management of said paper in any particular during the exercise of this lease, then it shall be the right of Either party hereto to take any legal steps that they may deem proper to annul said lease by the appointment of a reserve or other relief as the law may give. And to the true and faithful performance of the conditions and covenants herein before specified, and the said parties hereto bind themselves, their heirs, assigns and successors in office.
