In addition to Peter's reply, the 3-year and other time restrictions were waived in the event of an otherwise-qualified person being killed due to enemy action. In the words of the 1995 edition of the Medal Yearbook, "Any services curtailed by death or injury, or which resulted in an award or commendation, automatically qualified the recipient for the award".
