Connie, Here is my Genealogy Analysis of the Will of Minor Winn Sr. and I am including some documentation: Martha Winn Smith dau. of William Winn and wife of Mathew Smith was the granddaughter mentioned in Minor Winn's Will. Elizabeth Winn Smith dau. of Minor Winn was the wife of Benjamin Smith (she was dead when Minor Winn's Will was probated in 1778) Mary Winn Smith dau of Minor Winn (She was still living in 1778 when Minor Winn's Will was probated in 1778.) Does anyone know anything about Mary Winn Smith? Benjamin Smith did not have a daughter named Martha Smith. His daughters named in his Will dated 1770 were Margaret Smith and Suzan Smith. Documentation: Fauquier co. Marriage Record: Smith, Mathew married Martha Winn Nov. 25, 1771, bondsman James Winn In the WILL of MINOR WINN (Written 31 Jul 1775, recorded 23 Mar 1776 in Will Book 1 pg. 343 Fauquier Co. VA, probated 23 Mar 1778), a good Genealogy Analysis of Minor Winn's Will is that his daughter, MARY WINN SMITH is still living and that his daughter, ELIZABETH WINN SMITH is dead. Benjamin Smith does not mention his wife in his Will dated 1770 therefore his wife has died before 1770. The best analysis for Elizabeth Winn Smith and Benjamin Smith are that both Benjamin Smith and his wife, Elizabeth Winn Smith are dead when Minor Winn Sr. wrote his Will in 1778. From Minor Winn's Will dated 1778: *"Item: I give and bequeath to my daughter MARY SMITH and equal part of my estate that is sold after paying my just debts to she and her heirs forever." ****************** "Item: I give and bequeath to my granddaughter MARTHA SMITH one negroe girl named Lucy now in her possession to she and her heirs forever. ************** "Item: I give and bequeath to my daughter ELIZABETH SMITH'S CHILDREN forty pounds to be equally divided among the whole after the decease of my wife." (Minor Winn bequeaths in his will to daughter Elizabeth Smith's children. Proving Elizabeth Smith is deceased.) *In the WILL of BENJAMIN SMITH dated 30 Sep 1770 (Will Book O 1752-1773 Halifax Co. VA) BENJAMIN SMITH does not name his wife OR speak of her (which would indicate that she is already dead. In fact Benjamin asks that his oldest daughter to raise his youngest son.) " Will of BENJAMIN SMITH dated 30 Sept 1770 HALIFAX Co VA Will Book O 1752-1773 (Chiarito) Sons: Minor Winn Smith, Weathers Smith, John Winn Smith and Weaden Smith Daughters: Margaret Smith and Suzan Smith. ..."on condition my eldest daughter raising of my youngest son". s/Benjamin Smith Exr: MINOR WINN Wit: Samuel Hoskins, Thomas Vaughan, SMITH JOHNSON." What you are saying is that there is a second Smith relationship. Mary daughter of Minor is married to Benjamin Smith and now we have Martha daughter of William Winn(son of Minor and Margaret) married to Matthew Smith ??? so that Martha Smith granddaughter of Minor is not daughter of Mary Winn Smith.
