(Jefree) Rogers William Kincaid Robert Dossett T. Scarborough I, David Wilson Senior of Claiborne County in the state of Tennessee, being of sound and perfect mind and memory, do make and publish this my Last Will and Testament in manor and form following; First, I give and bequeath unto my beloved daughter, Polly Ann Wilson, the hereafter described peace of land. It being a part of the tract where on I now reside. Beginning on a Red Elm on the South Bank of my spring branch, near the deviding line between my land and the old Thomas McLaine tract, on the upper line of Lot E. Thence up the spring branch to the North West corner of the spring house, near the head f the spring. Thence Eastward to a black gum at the draw bars on the top of the bank. Thence a stright line North West to the East corner of the Guardian. Thence with the Guardin paling still Northword to the North East corner of said Gardin then with the Guardian paling Westward to the North West corner of said Guardian. Thence Northword running parallel with the Lot line E to the Grant line on Cumberland Mounatin. Thence westward with said Grant line to the lot line E. Thence Southward with the Lot line E to the beginning. To her the said Polly Ann & her heirs and assigns forever. Secondly, I will and brqueath unto my three sons, namly, David Wilson, George W. Wilson, and Wm. S. Willson, the balance of my home Tract of land, which I estimate at Twelve hundred Dollars, by their paying to the balance of my heirs, their hereafter stated amounts of money as herein after mentioned to the herein after named heirs. Given to Wm. S. Wilson, the West end next to the old McClain Tract, the lands devised to Polly Ann Wilson, Given to David Wilson, the next Lot through the middle, and to George W. Wilson, the East End, next Beelers to be equally divided between them by lines leading from the south side of the place through to the North line called the Grant line of the Mountain, soe as to leave to David Wilson the spring and buildings where he now lives. To be divided by Alvis Kincaid, Adam Beeler, Stephen Cawood, Sr. and John Dunn. To be laid off and divided by those men or a majority of them. According to quality and quantity given, my three sons, four years, to pay for the land. That is to say they are to pay eight hundred dollars in four annual installaments of two hundred dollars each. Thirdley, I will and bequeath to my son, Peter Wilson, one hundred dollars out of the price of my land, I will and bequeath unto my daughter, Peggy Rogers formerly Peggy Wilson, one hundred and fifteen dollars out of the price of my lands. Jefree Rogers having heretofore collected of James E. Bowman about sixty dollars of my money including interest which I have taken from his part of the price of my lands. I will and bequeath to my daughter, Elizabeth Dossett formerly Elizabeth Wilson, one hundred and ninety five dollars out of the proceeds of the price of my lands. I also will and bequeath to my daughter, Susan Kincaid formerly Susan Wilson, one hundred and ninety five dollars out of the peoceeds or price of my land. I also will and bequeath to my daughter, Tobetha Darcus Scarborough formerly Tobetha Darcus Wilson, one hundred and ninety five dollars out of the price or peoceeds of my land. My will is that the proceeds of my lands be paid to each of my heirs as collected ___ my three sons, equally, according to the amounts due each one. Fourth, I will and bequeath to my son, David Wilson, have two hundred acres of my lands North of Cumberland Mountain called and known by the name of the Tacketo Creek place, by his paying to my heirs one hundred and fifty dollars, to be equally divided amongst my heirs. Given the same credit that has been given for the home tract of land to be paid in four equal annual instalments & should he not be able to make the payments, at the expiration of the four years, it shall be sold on a credit of eighteen months to the highest bidder for cash. Fifthly, I will and order that all the residue of my lands North of the Cumberland Mountains be sold on a credit of eighteen months to the highest bidder for cash, after laying off to said David Wilson his two hundred acres, so as to incleude the improved and cleared lands. Sixth, I will and bequeath to my daughter, Polly Ann Wilson, my sorrell mare called Jane. Seventh, I will and bequeath to Olliva Elizabeth Wilson, daughter of my son Jacob Wilson, deceased, the sume of five dollars to be paid out of my Estate. Eighth, my will is that my three sons, David, George W. & Wm. S. Wilson, to whom I have devised my lands, shall have free access to my home spring, for water for family use and stock water, by weigh (way) of a lane; made and kept up for that purpose, and my will is that they, all, shall have free access to my Orchards for fruit for family use but for none other. Ninth, my will is that all the balance of my personal property, after my death, shall be sold on a credit of eighteen months by my Executors, and out of the proceeds, to pay and satisfy all my just debts and the balance, if any, to be equally divided amongst my heirs. Tenth, I hereby name, note, and appoint; Robert Dossett of Campbell County and Wm. Kinciaid of Claiborne County, both of the state of Tennessee, my sole Exectors to this my Last Will and Testament. In witness, whereof, I have set my hand and affixeed my seal, this twenty-eighth day of February one thousand eight hundred and forty-seven. Signed, sealed, published, and declared by the above named, David Wilson, Sr., to be his Last Will and Testament in the presence of us, who have hereunto subscribed our names as witnesses in the presence of the Testator.
