Carolyn- From an economic standpoint, it is certainly possible. Thomas Monday is an example of an indentured servant who arrived in Virginia and ended up with quite a bit of land when he died. He owned land in Old Rappahannock County near to Theophilus. If an indentured servant could do it, so could James, however he started. Since the records mentioned are only five years apart, and they both mention James Whaley of Westmoreland County, it appears there are two key questions. Where was Washington Parish? Did Washington Parish include the “Old Ordinary” Estate? Since Westmoreland County is not one of Virginia’s “burned” counties (those counties that lost their records during the Civil War), the answer to these questions should be obtainable. If you can conclude that “Old Ordinary” was in Washington Parish, it would seem safe to conclude they were probably the same James, or that they were probably father and son, depending on what else you know about James Whaleys in this vicinity (I know hardly anything about men named James Whaley).
