One of my problems is a certain Robert Penny of Preshute who married Mary Hutchins at Burbage 13th July 1767. He also seems to have married her sister Elizabeth at a later date. Robert and Mary of Preshute had a child who was baptised Mary at St Peter's, Marlborough 13th Oct 1768. Then there was a death of Mary Penny in November 1769 in the Burbage register and this could have been either mother or child. We have evidence of Robert being married to Elizabeth because of his will. Children born to Robert and Elizabeth are Mary (Maria) baptised at St Peter's Marlborough Jan 19th 1776 and Thomas who was baptised at Huish Oct 17 1773. We know that Mary and Elizabeth Hutchins were sisters and Elizabeth first married Robert Smith who died in 1771 so she was "available". We do not have a record of her marriage to Robert. It is illegal for a man to marry his late wife's sister but was it illegal then? Did it matter? Perhaps they just lived together?
