    3. THE TIME HAS COME -- YOUR HELP IS NEEDED NOW! For some time discussions have been taking place regarding the possibility of taking the federal government to Court to obtain a 'writ of mandamus'. If this action is successful - and we have every reason to believe it would be - it would force Statistics Canada to turn control of the 1906 Special Census of the Western Provinces (Alberta, Saskatchewan and Manitoba) over to the National Archivist for immediate release to the Public. Such release would be in accordance with Regulations attached to the Privacy Act. A successful action to obtain the 1906 Census would likely set the precedent we need for the the 1911 and subsequent Census records to be made available to the public in accordance with Regulations attached to the Privacy Act. Lois Sparling, a lawyer in Calgary - and an active participant in our campaign - has been making preliminary preparations for such an action. Several plaintiffs have been lined up and an estimate of costs for proceeding has been put together. Lois will be contributing her time, but even considering that, it is expected that costs could be about $8000. This includes provision for the remote possibility that costs could be assessed against the plaintiffs. Over the course of our campaign several people have made offers of financial assistance to aid in our efforts. Up to now these offers have been refused with thanks. However, as the Walrus said in Lewis Carroll's Alice in Wonderland - ' The time has come.' We are now seeking your assistance in providing the funding necessary to proceed with our action against the government. Without the necessary funding we will be unable to proceed! The estimated $8,000 required is made up of approximately $3,000 expected to be needed for expenses (no legal fees), couriers, long distance telephone calls and faxes, filing fees and the cost of transcripts. The balance ($5,000) is to protect the Plaintiffs in the unlikely event that costs are assessed against us by the Court. It is unlikely that costs will be awarded against us because, first of all, we would have to lose, and secondly, the Federal Court is reluctant to award costs against Plaintiffs in a public interest case. It is expected that we may be in a position to refund part of these donations. We believe the fair thing is to make the refunds on a pro rata basis, i.e. a percentage to everybody. There are practical limitations to this however. We cannot possibly do this for a lot of $5 donations. Therefore, pro rated refunds will be made for only those donations of $100 (Cdn) or more. We suggest that people get together to combine their donations. Approach your local genealogical and historical associations to make a contribution. Pass the hat at your meetings and send a cheque from your local group. In that way your local group will get any refund that might be forthcoming. Make the notation "Census Action" on the cheque. Lois will be the lawyer representing the Plaintiffs in the case. The funds will be deposited to her trust account. Lois has the means to accept US and other foreign currencies, and can also accept contributions through VISA. Transactions through VISA however, are more trouble than cheques -- and each transaction costs us 2.4 percent. A receipt will be issued for each and every contribution received. It will keep costs down if groups can collect from their members and send one cheque thus requiring the need to issue only one receipt. Make sure to include a covering letter or note with your full name and mailing address. As noted above, Lois is donating her time and expertise, and no part of the monies contributed to the legal case, other than costs, will go to her. A huge amount of work is involved in this action. Two other lawyers have offered assistance -- one from her office, and another member of the AFHS -- their experience in this kind of action, however, is limited. Normally the loser in a court action pays costs to the winner. These costs follow a chart set out in the relevant Rules of Court and are only intended to be a partial payment of legal fees. If our Plaintiffs are awarded costs it is felt that Lois, and the assisting lawyers, should get this money as partial reimbursement for their time, effort and expertise, aka their legal fees.     3. Greetings All. Christmas is over and we are now into the new year -- 2002. Time to get back to work. The next Town Hall meetings are coming up on 7, 9, and 11 January in Halifax, Toronto, and Montreal respectively. Not much time left. While I have been advised of some participants scheduled for these meetings, there are certainly others that I am not aware of. It would be appreciated if anyone scheduled to speak or attend these meetings would please advise me. >From the Ottawa meetings it is obvious that Statistics Canada has directed Environics to be on the lookout for certain things. Questions asked by the moderator show that they are looking for any indication that knowledge Census records would be released after 92 years will lessen individuals participation in Census, or lessen their trust in Statistics Canada in general. Presentations to the Town Hall meetings should include wording that would show just the opposite -- participation in Census and trust in Statistics Canada would increase with knowledge of eventual release of Census records. Chief Statistician Dr. Ivan Fellegi has changed the focus of his attack on our efforts from the strictly legal (because he knows he would lose), to one of a fear of lessening the integrity of the statistical agency. He still insists on promoting the non-existant 'promise' of never-ending confidentiality even though he has been unable to produce any documented evidence of it. Our counter to their insistance there is a 'promise' is to ask them to produce evidence of it. The legislation quoted by them certainly does not contain any 'promise' that confidentiality of Census will never end. Another main thrust of the Town Hall meetings is to promote the so-called 'Compromise Solution'. Copies of this 'compromise' were made available to all attending the Ottawa meeting and it is expected that this will be repeated at all upcoming meetings. Every speaker at the Ottawa meeting was asked if the 'compromise' was something they could support. Every speaker rejected it. Please make your comments relevant to the 'compromise' suggested rather than to my critique. I will be sending many of these to Environics and Statistics Canada. Getting information regarding what takes place in the Focus Group studies that follow each Town Hall meeting is quite another thing. Participants in the Focus Groups do not apply or volunteer as is the case for the Town Hall meetings -- they are chosen at random through telephone polls and must meet certain criteria to be accepted. We know little about the criteria, or about information given and questions asked of participants. We would appreciate anyone participating in these Focus Groups letting us know what takes place in them. We cannot stress enough the importance of participating in these Town Hall meetings. At the request of Senator Lorna Milne I am forwarding her message as follows =============================== To all the members of the Canada Census Campaign, and everyone else who has put so very much effort into the e-mail, letter and petition campaign. My bill is now at third reading stage in the Senate. I have postponed my third reading speech until the Senate returns at the beginning of February, 2002, so that it will be fresh in the Senators' minds during the debate. I firmly believe that out campaign is going very well, thanks to all the help you have given it --- such tremendous input from so many highly intelligent and highly qualified people. The latest Stats Canada ploy, the Town Hall meetings and Forum discussions, have started very well from our point of view. You already know that Stats Canada has had to resort to using Gordon's analysis of the "compromise solution" lifted straight off his webb site. Also their expert witness, who I am sure they expected to support the privacy aspect at the Ottawa meeting, came down strongly on the side of release of the historic census! I wish you all a very happy Christmas with your families and your friends. Ross and I will be in Calgary with our grandchildren, on whose behalf I am fighting this battle. For some time we have been hearing about a "compromise solution" to the Census issue that Statistics Canada and former Privacy Commissioner Bruce Phillips felt would meet the needs of genealogists and historians seeking access to Post 1901 Census records. Current Privacy Commissioner George Radwanski has stated that the 'compromise' is something that he can accept. It has been mentioned in Hansard for the Senate, recent responses from MPs and certain Senators mention it, Neil Sheridan and George Radwanski supported it in Senate Committee hearings in September, and now it has been used in the Ottawa Town Hall meeting. It might be stretching things at this point to suggest that the 'compromise' is being 'pushed' at the Town Hall meetings but copies of it were made available to everyone attending the meetings, and every presenter was asked if they could support it. It is my understanding that without exception, every presenter rejected it out of hand as being too restrictive and unworkable. Following the Senate Committee hearings I attended in September I was able to obtain a copy of the "compromise" and have done a thorough examination of it. I agree with the assessment of the presenters of the Ottawa Town Hall meetings. The so-called 'compromise', in my opinion, is no 'compromise' at all, and in fact is so restrictive as to be little better than no access at all. I have done a critique of this document, and included it in my latest column for the Global Gazette. Because of the length of it I will not post it in this message. Died in 1920 at the age of 69 or 70. in the White Flat Cemetery,Greer County, Oklahoma he married Virginia Monkres on 14 Dec 1884.the marriage was witness on 14 Jan 1885 and record on 4th Feb 1885. They were living in Thackerville.Love Co. Ok but were married in Gainesville, Cooke Co., TX. Luther could have been born in TX or MO even TN. Luther "Texas" Watts left home when he was 16. Where is home? Who were his parents? I know that when Luther was 16 his parents died. His brothers and sister were fighting over their estate. He got on his horse and rode away never to see or hear or talk about again not even to his family. He died in Greer County, Ok was once apart of Texas. Could he have move back where he was born the last few years of his live? He went to town and never came back. STORY: Luther went to get her and took to her to town and that is when she found out he was in jail for counterfeiting. She could have been pregnant at this time, but because all this she lost the baby. Fannie Second husband was GEORGE L CLINE IN 1901 IN TX.     3. Greetings All. Sound the Trumpets!! Ring the Bells!! Shout it from the rooftops!! I have just received a telephone call from the Office of Senator Lorna Milne. The Senate Standing Committee on Social Affairs, Science and Technology has PASSED Bill S-12 - An Act to Amend the National Archives of Canada Act and Statistics Act (census records), WITHOUT AMENDMENT. The Bill will now be referred back to the Senate in Report Stage and will receive more debate. We are optimistic that following that debate Bill S-12 will pass third reading and be referred to the House of Commons. We still have a ways to go, but having the Senate Committee pass this Bill, especially without amendment, has been a major step towards achieving our goal of regaining the public access to Historic Census records that we are presently denied. While passed without amendment, the Senate Committee did have some observations to make regarding the Bill. I am not at this time aware of what those observation are, but will post them as soon as I know what they are. Having passed this stage does not mean that we can let up on our efforts to let MPs and Senators how we feel regarding this issue. I encourage you to write the Members of the Senate Committee thanking them for their accepting Bill S-12. Write other Senators to encourage them to support the Bill in debate and to vote to pass the Bill in third reading. Write the MPs as well to seek their support when the Bill is referred to the House of Commons. Continue to collect signatures on our petitions. We need to tell our representative in Parliament that it is not just a handful of genealogists and historians that seek access to these records -- it is the people of Canada who do so.     3. Greetings All. I have received a list of times and dates of most of the Town Hall Meetings for expressing opinions regarding public access to Post 1901 Census records. (Their ad mentions only the 1906 and 1911 Census') There appears to be fewer meetings than expected, and if I learn of others I will post that information as soon as I get it. I copy the list of meetings below. It appears that anyone wishing to speak on the subject will be given a 15 minute time slot in which to do so. As sessions are slated to last two hours, this means that a maximum of 8 speakers will have the opportunity to speak in each session -- 16 speakers maximum in each location. Practically speaking, with administration overhead time required for each session the numbers of speakers may be reduced if they stick strictly to the two hour time period for each session. Presenters, in either English or French, will be chosen on a first come, first serve basis. Regardless of what location you will attend, if you wish to speak to the issue, contact Environics NOW -- TODAY to inform them of your desire to speak. If you wait you will be unlikely to obtain a spot to speak. Contact them by telephone at 613-230-5089 or by email at [email protected] I have already sent my request to be a speaker at the Vancouver meeting. I have today been advised that the Ottawa Citizen newspaper today (Thursday) had an ad on page A7 advertising the first of Statistics Canada's Town Hall meetings -- the first of Industry Minister Brian Tobin's announced "further broad based consultations with all Canadians" regarding public access to Historic Census Records. What is interesting about this ad is the heading of it, which was reported to me as "Express your views and opinions on releasing the individual 1906 and 1911 census questionairres." While only the 1906 and 1911 Census' are mentioned, it is expected that these hearings will have a bearing on access of later Census as well. Environics Research Group has been contracted to conduct Town Hall Meetings in 14 major centers in each of the Provinces and Territories, as well as two focus group surveys in each of these centers. This is the same company that conducted the focus groups and national surveys by Statistics Canada for the Expert Panel on Access to Historical Census Records. The first meetings are to be held in Ottawa. Date: Friday 14 December 2001 One from 2:00 - 4:00 PM and another from 6:00 - 8:00 PM. Location: Sir Guy Carleton Room, Mariott Residence Inn 161 Laurier Ave. West, Ottawa Presentations are in English or French on a first come, first served basis. To confirm attendance, which they request, once can call (613) 230-5089 or email [email protected] There is some concern, because attendence is requested to be confirmed in advance, that these meetings will not be as open as one might hope. We sincerely hope that no one who wishes to attend will be prevented from doing so. Information regarding these meetings is expected to be on websites for both Statistics Canada and Environics Research, however, at the time of this writing, the Environics sites are 'under construction' and there is nothing on the Statistics Canada website as yet. Perhaps there will be tomorrow. Environcs Research's home page is located at http://erg.environics.net/ On the upper left side, links for English and French are shown under a heading of "Census Consultations" The link given for Statistic Canada was http://www.statcan.ca/english/census96/histcrd.htm which is the same page on Statistics Canada's website on which the link to information on the Expert Panel is located. It is vitally important that those who wish to see public access to Historic Census Records make an effort to attend these meetings, and express their opinions regarding access. If we do not do so we stand a chance of losing these records forever. It is our feeling that the focus groups and surveys conducted for the Expert Panel were biased towards obtaining a negative response to access. We are concerned that information provided and questions asked during these town hall meetings and focus groups will be similarly biased. I have attempted to obtain information from Dr. Ivan Fellegi, Chief Statistician of Canada, regarding what information would be provided to participants, and what questions would be asked of them. So far he has declined to respond. I would appreciate it if some-one attending these meetings would let me know what transpired and how they felt the proceedings had gone. Let us know as accurately as possible what information was given and what questions asked. I am particularly interested in knowing if the unsubstantiated "promise" of Statistics Canada is introduced, and what degree of emphasis is placed on it. I would like to think that a transcript of the proceedings will be kept and made available to the public, but I think the odds are against this happening. Watch your local newspapers for notices of meetings and focus groups to be held in your area. Meetings in other areas are expected to be held in December and January. Final reports from Environics are to be given to Statistics Canada by 15 February 2002. I cannot stress enough the importance of attending these meetings to let those conducting them know that we need, and want access to the Post 1901 Census records on the same basis as those up to and including 1901 have been, and still are. I have recently been advised that the Senate Standing Committee on Social Affairs, Science and Technology have postponed clause by clause deliberation on Senator Lorna Milne's Bill S-12 An Act to Amend the Access to Information and Statistics Act (census records). This deliberation, originally scheduled for 6 December 2001, will now be held 12 December 2001. Following this, Bill S-12 will be returned to the Senate for Report Stage and further discussion. We hope that the Senate Standing Committee on Social Affairs, Science and Technology will recommend acceptance of S-12 without any major changes. Although MP Murray Calder's Bill C-312 has been deemed non-votable, along with every other Private Member Bill considered at the same time, it will receive up to one hour debate in the House of Commons before being dropped from the Order Paper. It is expected that this debate will take place on 11 December and will be broadcast on CPAC. There is a possibility, because a budget is expected to be brought down on that day, that debate on C-312 will be delayed. I will post a message regarding any delay as soon as I am informed regarding it. In this time of activity regarding S-12 and C-312, it is important to keep up our efforts to bring these to the attention of our MPs, Senators and Ministers. Keep sending your letters and email, and signing petitions. Both are important. Send your representatives a Christmas wish and ask for their support at the same time. While letters and email keep individual MPs and Senators keep them aware of our personal feelings, we have no way of tracking numbers sent.     3. Greetings All. We have today been advised from the office of MP Murray Calder that his Bill C-312 has been deemed to be non-votable. As a result it will receive only one hour of debate in the House of Commons and will then be be dropped from the Order paper. This is hardly worthy of a Bill regarding an issue which has received in excess of 40,000 signatures seeking support for public access to Post 1901 Census Records. This news has been a great disappointment. We had hoped that C-312 would be considered votable and would at least receive the three hours debate alloted to votable Private Member Bills. Watts Luther T; 1851-1920 Row 7; Watts, Virginia; 1866-1938'W/o L/T. Not sure of age because don't know when his birthday was. In Greer County, Oklahoma there was census take show ,that at the time of the Census he was 69 years old. In Texas he married Virginia Monkres on 14 Dec 1884.the marriage was witness on 14 Jan 1885 and record on 4th Feb 1885 Story goes: Luther Texas Watts left home when he was 16. Where is home? Who were his parents? I know that when Luther was 16 his parents died. His brothers and sister were fighting over their estate. He got on his horse and rode away never to see or hear or talk about again not even to his family. Greer County, Ok was once apart of Texas. Could he have move back where he was born the last few years of his live? For Greer Co. OK was part of Texas at the time of his birth. Ural was the daughter of James Calvin Scivally and Margaret Ann ( Mattie) Martin Scivally. I have a Copy of there marriage records: States that Emmett was 19 and Ural was 16 at the time of their marriage. L T Watts and J C Scivally had to sign for them. Emmett was living in Reed, Greer Co. Ok and Ural was living in Vinson, Harrison County, OK at the time of their marriage. Ural died 1 Feb 1977 in Van Nuys, Ca. MY GRANDFATHER. 6 John Wesley Watts b April 25,1894 in Indian Territory ,Ok. Died in Olustee, JacksonCo.OK. He was married twice. 2nd wife was Gracie L, Glenn. John and his wives were childless. 7 William H Watts b 1898 died 1978 8 Bert b 1899 9 Dorothy Mabel Watts b. May 14,1900 in Ok. Died June 1980 in Arp.SmithCo,Tx. Married Orion D Browder. 10 Euel J Watts (Jack or Buster) b 1909 in Ok. Died 1978 in Albuquerque,N.M. Married Bessie 11 Fannie Wigginton/Watts b 13 Oct 1880 d 2 Feb 1956. She is the daughter of Virginia Monkres and Mr. Wigginton. Fannie First married a man name Nelson (Will?). He went to town and never came back. STORY: Luther went to get her and took to her to town and that is when she found out he was in jail for counterfeiting. She could have been pregnant at this time, but because all this she lost the baby. Fannie Second husband was GEORGE L CLINE IN 1901 IN TX. I have found them on the 1851 Census by Gordon Beavington as follows: East Dean, Section VI WATTS, David, 50, labourer, born Wickwar " , Elizabeth, 50, wife born Westbury " , Emma, 18, dau " " " , James, 16, son " " " , George, 12, son " " " , Mary Ann 9, dau " " Emma WATTS married John Church PYM in High Wycombe, BUCKS on June 8, 1861. Emma and John PYM are my great x3 grandparents. At the time of Emma's marriage her father, David WATTS, was listed as a tailor. Does anyone have any knowledge and/or connection to this WATTS family?     3. Greetings All. I have just finished sending files to Global Genealogy for loading to the server and updating of the Scoreboards for MPs and Senators. When loaded, the online Scoreboard totals will show a date of 19 November. The current online totals show a date of 31 October. The new totals reflect all responses from MPs and Senators that have been forwarded to me. I currently have no further correspondence from MPs or Senators that would cause a change in their positions shown on the Scoreboards. Please check the Scoreboards in a day or so. If you have any correspondence from MPs or Senators that would change the position shown for them please forward it to me so that I might bring things up to date once again. Changes since the posting of 31 October are as follows: Gold Ticks of support have been awarded to MPs, Carole-Marie Allard (PQ), Elsie Wayne (NB), Howard Hillstrom (MB), and Jim Gouk (BC). Senators Isobel Finnerty (ON), Laurier LaPierre (ON), and Gerry St. Germain (BC) have also been awarded Gold Ticks. One Senator has been removed from the Scoreboard because he has retired. Non-committal Fence icons have been awarded to MPs Julian Reed (ON) and Steve Mahoney (ON). Both of these previously had Red Xs of opposition. Fence icons have also been awarded to MPs Derek Lee (ON) Karen Redman (ON), and to Senator Terry Stratton (MB). If votable, and if passed, it would go through the normal procedures of being referred to Committee, brought back to the House for the Report Stage and third reading after which, if passed, it would be referred to the Senate. Rules of the House do not permit two Bills that are identical (such as C-312 and S-12), or nearly so to be considered in the House at the same time. Should Bill S-12 pass all the steps in the Senate and be referred to the House, Murray Calder would likely withdraw his Bill C-312. With everything that is going on at this time it is important to keep collecting signatures on petitions. It is equally important, if not more so right now, to continue writing, or to write again, to our Members of Parliament and Senators to seek their support for these Bills. Check the updated Scoreboards before writing. For those having Gold Ticks of support, messages of appreciation should be sent with a wish for their continued support. For Fence-sitters, or those who have not responded at all, ask for their support for these Bills and request a response to your query. If writing to the few having Red Xs of opposition, respectfully request their reasons for their opposition. In all instances, keep your messages polite, direct, and to the point. It is especially important at this time to keep the pressure on. We must not allow our representatives to think that we have given up on, or are no longer interested, in regaining the public access to Historic Census Records the we are currently denied.     3. Greetings All. MP Murray Calder, our champion in the House of Commons, recently had his name drawn in the Private Members Bill Lottery. While he has more than one Private Member Bill in the works he has chosen Bill C-312 as the one to put forth. C-312 is identical to Senator Milne's Bill S-12 currently under review by the Senate Standing Committee on Social Affairs, Science and Technology. If passed into law these Bills would give us the access to Historical Census Records that we seek. It is expected that the Standing Committee on Procedure and House Affairs will likely meet on 21 November 2001. It is this Committee that will determine whether or not Bill C-312 will be deemed votable. Murray will make a presentation to argue that it should be votable. In it he will no doubt point to the enormous interest in this issue as expressed in the tens of thousands who have signed petitions. It is important to understand that the committee doesn't necessarily look at the merits of the bill -- only whether it should be votable. In other words, a committee member may be opposed to it, but still feel it should come to a vote. They will choose 5 bills from the 15 selected in the recent draw to become votable.
