    3. The following Will of Calvin WASHBURN is not in my direct ancestory line. I have had a copy of it since about 1994 and it needs to be on-line to help someone else. Good Luck, Ken Maxwell kenmax@eclipse.net _____________________________________________________________ (Pennsylvania) Will of Calvin WASHBURN Luzerne County, Will Book "F" Page 463 Probated September 13, 1875 "Calvin Washburn" I Calvin Washburn of the Borough of Hyde Park Luzerne County and State of Pennsylvania being of good health of body and of mind and disposing memory make and declare this my last Will and Testament. First . that my funeral charges and all my Just debts, shall first be paid, second I give and bequeath to my beloved wife the free and full use of my house and lot together with the hereditments thereunto belonging for and during the term of her natural life. It being the same premises on which I now reside. I also further direct and bequeath to my said wife the annual sum of three hundred dollars which shall be paid to her by my executors hereinafter appointed out of my personal and real estate semi annually until the time of her death. Third I give and bequeath to my son Martin the use of my farm Situate in the Towns of Ancram and Gallatin, Columbia County and State of New York-it being the same on which said Martin now resides and that the said Martin shall have the sole control and full enjoyment of the same for and during the terms of his natural life, and at his death I give and bequeath said farm to my grand children the lawful heirs of my son said Martin - I also further direct and bequeath that the sum of three thousand dollars in money shall be paid by my executors out of my real and personal estate to my said son Martin immediately after my decease, fourth I give and bequeath to my daughter Eleanor now intermarried with William H. Owens the use of five thousand, under the following regulations and conditions. First that my executors shall put the said five thousand dollars at interest shall be paid accruing on said mortgage to my said daughter Eleanor in semi annual payments as long as she shall live, or that the said sum of five thousand dollars may be invested in real estate by my executors, at the option of and by and with the approval and consent of my said daughter Eleanor and in such manner as will secure to her the profits and full enjoyments of said real estate so purchased, during the full terms of her natural life, after which event I give and bequeath the said five thousand dollars, or instead thereof the real estate purchased with the same as above directed to my grand daughter Mary A. Washburn the natural daughter of said Eleanor I give also further give and bequeath the sum of one thousand dollars, in money to my said grand daughter Mary A. the natural daughter of said Eleanor which shall be paid to her by my executors out of my estate immediately after my decease/ Fifth I give and bequeath to my daughter Catherine now intermarried with W. S. Cortright the use of six thousand ($6000.00) dollars for and during the full period of her natural life, subject to and under the same regulations and conditions above named and recited in the bequest made my said daughter Eleanor and after the death of my said daughter Catherine I give and bequeath the said six thousand to my grand child or grand children the lawful heirs of said Catherine or the real estate which may be purchased with the same instead thereof under the above named conditions referred to. Sixth I give and bequeath to Calvin Coons the village lot on which he now resides, conditioned that he pays for the building thereon erected and exhibited satisfactory evidence to my executors of the same. Seventh. For the purpose of promoting Religion and Sound Morality I give and bequeath to the First Methodist Episcopal Church of Hyde Park the balance of about two h undred dollars due me on a contract which I now hold by assignment, and originally made between the school Directors of Borough of Hyde Park and the "Trustees of said" First M. E. Church of H. P. aforesaid which contract I direct shall be given up by my executors and cancelled. Eighth, I hereby direct that my executors shall before paying the several legacies above given to my said heirs as herein specified settle with each and every one above named, and deduct the balance of any book account, notes and receipts for monies advanced from the date hereof and which may be due me at my decease, and apply said balance if any in part payment of the before mentioned legacies to my said heirs. Ninth. I give and bequeath after paying and securing to be paid the above mentioned legacies in the manner and form above directed-to my son Nicholas, all the remainder of my property including my real estate together with the hereitaments thereunto belonging monies bonds and mortgages, notes, book accounts, judgements and all other property of whatever name or nature which may belong to me at my decease. Tenth. I hereby nominate and appoint Nicholas Washburn and William Merrifield my executors who shall have full power at my decease to take charge of all my property and effects at my decease, pay off all my debts, collect all dues, pay off the legacies as herein directed and in all other respects to carry out my intentions as above set forth/ I now declare this to be my last will and testament, hereby revoking and declaring- all former wills void and of no effect. In witness whereof I the said testator have to my last will and testament set my hand and seal the eleventh day of September A. D. one thousand and eight hundred and sixty five. Merrifield Jr. Rob Merrifield. ____________________________________________________________________________ __ Will Book "B" Page 353 Codicil I now desire and direct that my Executors at my death shall sell my farm situated in the Township of Ancram Columbia County and State of New York to the best possible advantage, and out of the proceeds, first I give and bequeath to Nelly reputed daughter of my son martin now deceased two hundred dollars, which amount shall be put at interest and the interest paid to her annually towards her education and support until she shall arrive at the age of twenty one years, after which the said two hundred dollars shall be paid to her legal heirs. Second. The balance remaining from the sale of said farm I now direct shall be divided into four equal parts three of which shall be invested in mortgage at interest or interest paying bonds of the States or of the United States by my executors. The interest arising from the same shall be paid annually to my grand children legal heirs of Martin Washburn deceased, in manner and form as follows, Calvin Washburn one fourth of said interest as long as he shall live, to Catherine intermarried with James McDaniels the interest arising from her portion of said fund, as long she shall live, and interest arising from another fourth of said fund to the children of Elizabeth Nanfolkenburgh deceased, in equal proportions until they shall respectfully arrive at the age of twenty one years. The balance of said fund after deducting and reserving one thousand dollars shall be paid to John Washburn as long as he shall live, and at the decease of my grand children above mentioned I do hereby direct that the said annually to the legal heirs of my grand children above mentioned shall be paid his or her share of the principal forming the basis of the interest for the above purposes. Third, I give and bequeath to John Washburn a life interest in a house and lot situate on Washburn Street Hyde Park fifth ward City of Scranton, valued by me at one thousand dollars it being the same property on which he now lives for him to have and enjoy as long as he shall live and at his death, i give and bequeath to my daughter Catherine intermarried with W. C. Cortright twelve hundred dollars which shall be additional to the amount named in body of the above will. Fifth I give and bequeath to my daughter Eleanor intermarried with Wm. H. Owens five hundred dollars which shall be paid to her heirs xxxxx xxxxx independent of all other charges. Sixth I also give and bequeath to my daughters Eleanor and Catherine my house and lot situated on the Methodist Camp Ground Wyoming district for them to have and enjoy jointly or otherwise despise of after my decease as they shall think proper.
