This is the will of Martin Washburn Unfortunately I did not note in my file which volume it was in but it starts on p. 124 of whatevervolume, Washington Co., NY Probate In the name of God Amen I Martin Washburn of the town of Fort Ann in the county of Washington and state of New York of the age of thirty eight years and upwards and being of sound mind and memory but feeble in health do make publish and declare this my last will and testament in manner following that is to say First I give and bequeath to my wife Louisa Phidelia Washburn the undivided one third part of all my real estate to have and to hold the same as long as she shall be and remain my widow Second I give and divise all the rest residue and remainder of my real and personal estate of every name and nature whatsoever to my said son Ephraim Washburn and my said daughters Sylvia Washburn and Martha Lucinda Washburn to be divided equally between them share and share alike And lastly I do hereby nominate and appoint my fried Ensign Haskin of the said town of Fort Ann to be the executor of this my last will and testament hereby revoking all former wills by me made In witness whereof O have hereunto set my hand and seal this thirteenth day of December in the year of our Lord on thousand eight hundred and fifty eight Martin Washburn L.S. the within instrument consisting of one page was at the date hereof signed, sealed, published and declared by Martin Washburn as and for his last will and testament in presence of us who at his request and in his presence and in the presence of each of us have subscribed our names as witness there to Daniel Washburn, residing at Fort Ann in Washington County John Benton, residing at Fort Ann in Washington County Will was proved 22 Feb 1859 Susan Bingler Fairfax, VA
