A petition for discharge from the state hospital for the insane at Waterbury has been brought in Rutland County court by Mrs. Mary McCarthy, who was charged with the murder of her sister, Miss Kate Kerrigan, at their home in West Rutland in August, 1913. Attorneys Webber and Leamy appear for the petitioner and State's Attorney P.M.M. Phelps of Fair Haven represents the state. The crime was committed five years and a half ago and it was claimed at the time that it was done during a fit of sudden insanity. It was claimed at the time Miss Kerrigan was reclining on a couch when she was stuck over the head and later dragged into the cellar by Mrs. McCarthy and there buried , a wash tub hiding the fresh dirt, so that the body was not discovered for some time after the killing. WENT TO ASYLUM IN 1914. The woman was arrested on a grand juror's warrant and committed to the county jail. She was indicted and the question of her sanity was raised when she came up for trail in County court. It was by this court that she was ordered sent to the state hospital for examination on May 15, 1914. She has since been under observation there. The petition states that she is mentally able to be out of the institution at the present time and that she is illegally held there by E. A. Stanley, superintendent of the hospital.
