I W.A. Via of the County of Franklin and State of Va being of sound mind and being mindful of the uncertainty of this mortal life and the Certainty of death, do make this my last will and testament, I will that all my Just debts and burial expenses be paid out of my personal estate, I will and bequeath unto my wife Lizena Via for the use and benefit of her and my children by her my real and personal estate until my youngest child by her becomes 21 years of age provided that she remains my widow and further provided that my daughter Annie Via have equal rights and benefit of a home with my wife Lizena Via and my children by her as long as she remains unmarried if she should choose not to remain at home then I will that she have out of the proceeds of my real and personal estate Ten dollars per year as long as she remains unmarried, should my wife Lizena Via choose to marry before my youngest child by her should become 21 years old then I will and direct that all my estate both real and personal be sold in a reasonable credit purchasers giving approved interest bearing bond on all sums of five dollars and upwards when Collected I will that it be equally divided between my hiers at law should my wife Lizena Via remain my widow until my youngest child by her becomes 21 years old then I will that she share an equal part with my children of all my estate both real and personal and that sale be made of all my estate both real and personal and divided as directed above in case she should choose to marry that is the same as directed in case she should choose to marry I make and appoint M A Thomas and James C. __ my executers.
