    1. [VIA-L] Ballard Chancery case
    2. I suppose the first thing that should be done is too see if Micajah Via or Molly Via gave a deposition in this case. I don't know why the researcher I use would not have included it but maybe he thought it was of no value.....but I would like to see the whole case. As far as Mary - Molly goes.....two of Micajah's sons were married to women named Mary. William Via was married to Mary Craig. Micajah Jr was married to Mary Mills. But I don't know why one of their wives would give a deposition with a father-in-law. Here's what I have of this Chancery case.... Judy THE COMMONWEALTH OF VIRGINIA To Wm Meeks, Thomas Garth Senr, Robert Davis, & Joel Harris or any two of you Gentlemen, Justices of the Court of Albemarle County Greetings KNOW YE, That we, trusting to your fidelity and provident circumspection in diligently examining James Douglass, Micajah Via, Molly Via, William Michie, William Hall and Susanna Hall in a Certain Matter of Controversy now depending in our Said County Court of Albemarle between John Ballard and others plaintiffs and James Ballard and Thomas Pettit Executors of Thomas Ballard deceased Defendants Command you or any two or more of you, that at such time and place as you shall appoint, you assemble yourselves and the witness aforesaid before you, you call and cause to come and diligently examining on the Holy Evangelists of Almighty God, and their examination aforesaid unto our said Court of Albemarle County distinctly and openly without delay, you send and certify enclosed, returning also to us this writ Witness John Nicholas Clerk of our said Court of Albemarle County at the Courthouse, the first _ day of March 1806 in the 30th year of the Commonwealth. John Nicholas CC William Hall being duly sworn deposeth & sayeth that he heard Thomas Ballard in his life time demand a Hire of Jas Ballard for the Negroe Boy then in his possession, stating that a Ear or Grain of Corn would be better than nothing but the sd James laughed at him & said that he did not know that he should have to pay him any hire. This conversation passed __ this depon't was overseer for sd Thomas Ballard & he believes between seven & eight years ago but the said James said if he would go over with him he would pay him & the old man did go in a short time after but did not say for what 1st Ques by Deft - Do you know whether the old man rec'd the sd grain of corn for hire? Answer - I do not know - I did see __ receive it Ques 2nd by Do - You say that James Ballard laughed at his father's demand. Did not the whole conversation seem to be of a jocular cast? Answer - the old man I think was in earnest, but James laughed. Susanna Hall, being duly sworn deposeth & sayeth that she lived on the plantation of Thomas Ballard the first year that James Ballard had the Boy in dispute & that the sd Thomas furnished the Boy with clothing for that year, as to the other years she knows nothing & that she has frequently heard him say that he had lent the Boy to this Son as a Hand but did not hear him say anything about taking him home Quest. To William Hall by Pltfs Atty - do you know anything of old Mr Ballard's lending money to his son James. Answer - I heard him say he had lent his son James Two Hundred Dollars when about to go to Kentucky & but for it he did not know what James would have done as his Horse gave out & he had to buy another - after this dep't left Thos Ballards employment the Hands of Thomas & James Ballard worked together one year at least but the Boy did not work among them but remained at the house of James Ballard. And further this depon't say not. Susanna Hall (her mark) James Douglas William Hall (his mark) Molly Via (her mark) Micaj. Fanny Via who married William Ballard was his sister, and Fanny & Micajah were very close in age to each other. 2. <<No James or John in Thomas who died in 1781, but there is a John and a James in Thomas, Jr. who died in 1804 son of Thomas and Sussannah Hansford, brother to your Ann Ballard Maupin. What have you found?>> Thank you Jewell, Edna and William. I believe the Thomas Ballard in question is the one who died in 1804. >From the above you can tell William knows me pretty well....the answer is I don't know what I've found if anything. The researcher in Richmond that I use once in awhile sent me some "selected pages" of a few Chancery cases. I am always on the lookout for Via information and in particular a clue to information we are lacking. Anyway in the Chancery case of John Ballard vs Exors of Thomas Ballard Micajah Via is mentioned and so is Molly Via. Although the info I have from this case does not indicate Molly's connection to Micajah it would be easy to assume she was his wife. We've only seen Micajah's wife mentioned once - in a deed and it listed her as Phillipi Via. Micajah's son Jonathan named a daughter Maria P. (was the P for Phillipi?). If Molly was Micajah's wife I was trying to determine a connection between the families (we are still looking for his wife's last name). I think it likely that Micajah was involved in this case because he was most likely a neighbor of the Ballard's and because his daughter Fanny Via married William Ballard. I will try to transcribe the few pages of the Chancery case that I have and post it to the group. Even though I doubt it will shed any more light on the Via's I'll see if it's possible for me to order the microfilm and then I can see the whole case. Judy

    1. [VIA-L] Huguenots
    2. A very big thank you to Jewell for contributing the following article. This just goes to show us there is hope of someday finding Amer and his family before he came to America. Judy Family Puzzlers, November 11, 1995, Number 1412, Copyright 1995 by Mary Bondurant Warren. WHERE THERE WAS MONEY, THERE ARE RECORDS - EVEN FOR HUGUENOTS! At the Family History Library at Salt Lake City, UT, I received help from the French specialist Mme. Yvette Longstaff. Among their holdings were microfilms of several indexes about Huguenots, created in France, Holland, and Germany. I questioned their value, so I took a look. Mme. Longstaff suggested that Huguenot ancestors whose exile led through Germany might appear in the "Frankfort Index" which is available on microfilm through the LDS Family History Centers worldwide. These indexes are arranged alphabetically by surname of the Huguenot exile. Those exiles who resettled in Holland, the British Isles, or American colonies, may appear in the documents of the "Walloon Index." The French index was comprised of claims made by RELATIVES of Huguenots who had either been imprisoned for religion, and had their goods confiscated, or those who fled the country. The Revocation of the Edict of Nantes in 1685 provided that lands and goods of Huguenots would be confiscated by the King. Each dossier or packet has been filed under the name of the Huguenot prisoner or exile. All those true and loyal Catholic relatives of the proscribed Huguenot appealed to the King in petitions and memorials to give back the goods of the Huguenot to his or her family members. IN the process the petitioners presented family trees, either diagrammed or verbally, to show their blood connection to the Huguenot in question. As you might expect, the documents are in French, but are certainly worth the effort to translate if you find your ancestor within them. It was interesting that many of the confiscated estates WERE returned to the relatives, to be shared in proportion to their degree of kinship to the Huguenot. This is why so many "trees" appear among these claims. An interesting sidelight: When the Germans overran France during World War II, these papers were taken from the French Archives, to Berlin. They were microfilmed in Leipzig, before being returned to the French at the conclusion of the war.
