    3. A movement has been started like that from Desert Storm. During Desert Storm we tied yellow ribbons anywhere we could. Well, now the movement is to tie purple ribbons the same way.     3. Rhonda, After doing some research, it turns out that the 72nd Va. militia was mustered into service from Russell County. So, Cummings Kiser would have served that unit also. I just wasnt sure when I sent a letter to you before. Thanks, Greg

    3. Rhonda Although Wilson has many brothers who were of age, I only have one in my database that served that I know of. He had a brother named Cummings Kiser, b. Oct. 30 1842. In my database I have Cummings Kiser listed as a Private in the 72 Va. Militia, a Private in the 29th Va. Infantry, Co. A , and a Private with the 21 Va. Cavalry, Co. C.. As far as the militia, I cannot verify. But I do know that the 29th and 21st is him definitely.     3. Greg, He was a private in the 21st Virginia Cavalry...then enlisting on May 1, 1863 as a Private in Colley's Company, Counts Battalion, 45th Virginia Infantry Battalion. He only had two children that we have been able to find: John who was killed in a railroad accident at Coeburn and George who married and lived in the Riverview Section of Coeburn. We are trying to track some of his descendants so perhaps we can find a photo. Dickenson Dots DWALE, DICKENSON COUNTY, VA., April 20 - (Special) - L. M. Vanover, of Clintwood, has resigned as Commissioner of the Revenue of the Western District of Dickenson county, and W. M. Lambert was appointed to fill the vacancy. Frank A. Stratton, of Johnson city, Tenn., is having some coal from this section hauled to Norton to test its coking qualities. Mr. Stratton has large interests in the coal-fields of Dickenson county. George Dyer, a prominent citizen of Stratton, this county, was thrown from a mule a day or two since and seriously, if not fatally, hurt. Editor Free Press - I have lately had the privilege of examining some old papers left by an old man by the name of John Fleming, who has long since passed to that sojourn whence no voyager returns. Fleming's father came from Ireland back in the other century, and settled in eastern Kentucky. John Fleming lived near this place for many years prior to his death. The papers are dated from 1824 to 1860, and mostly relate to business affairs. Among them there is an order from Floyd County Court appointing Fleming as Road Surveyor. There is no state named in the order, and whether it was Floyd County, I don't know. The order is unique, as will be seen from the following verbatim copy: FLOYD COUNTY COURT JUNE TERM 1828 John Fleming is appointed Surveyor of the road from the mouth of the Dry branch to the picture of the Turtle, in the place of Frederick Glambaugh removed. And it is ordered that he call on all the bands on Beaver above where Samuel Harris formerly lived, and down as low as William Isaacs to a post. Hiim to keep the same in repair accounting to law; cut smooth fifteen feet wide, and dig six feet wide where digging is necessary. A Copy Att. Jacob Mayers, C.F.C.C. There is also among the papers a song ballad written in a very cramped hand, with red ink, on a very ancient looking sheet of paper, much yellowed with age. It seems to relate to some love affair, and it is a curiosity in its way, I will copy it. Here it is: A SONG BALLAD So early, early is spring I was pressed on board to serve my King, To leave my dearest dear behind. Who had often told me her mind. As we sailed down to Old Virginia town, (rest of poem illegible) SEEN AND HEARD BY THE WAYSIDE Frank M. Beverly Some days ago I rode out a few miles into the country over the "Gate Road," into the country with a friend of mine who is somewhat noted for his eccentricities, and especially his eccentric expressions. As we shambled on, our horses suddenly become scared, and as we tried to urge them onward they envinced an unusually stubborn disposition. After some little speculation as to the cause of the trouble, my friend who is somewhat argus-eyed (?) as well as eccentric, pointed to a gander hanging by the neck in a bush by the roadside. He was dead, whether he had been executed legally or lynched. My friend must have read "Book of Books", for he paraphrased a well-known passage after this matter: "Other ganders have I, which are not of this flock; them I must also hang." My eccentric friend drew a terse conclusion from an occurrence that took place in this vicinity not long since. This occurrence was related to ye scribe about as follows: One Mr. F- swapped horses with one of his neighbors who it is charged has an interest in a moonshine distillery. Now it happened on this occasion that Mr. F--, who is a professional horse swapper, was badly cheated by the moonshiner. He thought this would never do and so he went back in do haste and praved the moonshiner to "bargain" with him, which he steadfastly refused to do. After importuning him on several occasions, all to no purpose, he declared that he would set the moonshiner up with a job. So Mr. F- went into the moonshiners district and diligently searched til he found the distillery and he immediately informed the U.S. Marshals of the fact. They promised him five dollars to point them to it - but the moonshiner saw him hunting for it, and forthwith it was moved to a safe r----t, so it was not found when Mr. F-returned with the Marshals to the point where he had located it. Now, my eccentric friend says I shall be lawful for thee if thy neighbor horse-cheat thee to hunt up his 'still and forthwith report the fact to the marshals who will summarily dispatch old t-ing to revenge upon him." Dear Joe English: Two city chaps were rusticating in Cumberland mountain in Eastern Kentucky a few summers ago. They were boarding with an old mountaineer farmer, a rather gruff, eccentric specimen. One day they took their guns and went out to hunt some game. They went into a great wood, and it was not long till they saw a bear. One of them raised his gun and fired, with the other held his breath. The bear fell to the ground and after a few convulsive kicks all was over. Then the other said, "We've killed a bear." "No, no." said the first. "not we; I killed it by myself. You had nothing to do with it." Then they went up close to the bear, as they thought it safe to venture, and after assuming themselves that it was a veritable bear they concluded to go and tell the farmer what they had done and secure help. Greatly elated over their success, they told the circumstances to the farmer, who went with them to bring the bear home. The young men went before till they gained sight of the bear, when they appeared to be a little cautious about venturing to near. The farmer, however, led the way, and upon getting near a sight of the bear he gave vent to some expressions that I must not reproduce here. Instead of being a bear it was the farmer's little Jersey cow, which they had killed while she was feeding on the wild range. The farmer's wrath grew and grew till it assumed formidable proportions. The city chaps became fearful of the outcome of the affair. Then the one who did the shooting meekly said, "I'm sorry, sir, that we've killed your cow." "No, no, not we." Quickly said the other, "I didn't shoot." The chappies bundled up their duds and left for Cincinnati that evening. FRANK MONROE BEVERLY Dwale, Va. FRANK MONROE BEVERLY Dwale, Va. Kicked by a Mule DWALE, DICKENSON COUNTY, VA., May 13 - (special) - Madison Senter, a merchant of Freeling, had the misfortune to get badly kicked by a mule while handling it, recently. Several of his rib bones are said to be broken, and he is badly crippled. Dying of Hiccoughs DWALE, DICKENSON COUNTY, VA., September 27 - (Special) - Your correspondent learns that "Old Uncle" Tucker, one of Letcher county's (Ky) oldest pioneers, is dying of hiccoughs at his old home on Elborn Creek, ten miles east of Sergent, aged 90. He has a large number of descendents throughout Eastern Kentucky. Mrs. J.H. Ross, an elderly lady of Clindtwood, is in critical condition from suffocation. She is given to attacks of suffocation in its most acute form, and it is thought she will not survive this attack. Illness of John M. Neel DWALE, DICKENSON COUNTY, VA., February 19 - (Special) - John M. Neel, of Clintwood, ex-Commissioner of the Revenue for the Western District of this county, is in a critical condition, and his recovery is almost despaired of. He has been confirmed (?) to the sick-room for nearly three months. We had the hardest winds in this section Wednesday we have had for many a day, and much damage was done. Fences and out-houses were torn to pieces. Foul Play Suspected DWALE, VA., December 4 - (Special) - Intelligence has just been received here to the effect that a horse was found dead Wednesday lying in the road, which goes through Osborne's Gap, a notch in Cumberland mountain. It had been shot, and it is supposed that some one had been passing that way, and was beset by a band of outlaws, who are said to infest the mountains. Nothing can as yet be learned as to who was traveling the road at the same time, but if there has been any foul play, it was probably upon some one coming from Kentucky in this direction, as it would, in all probability, have been known, if anyone had passed from this side

A NARROW ESCAPE FROM DROWNING Farmer William McFall Has a Most Perilous Adventure DWALE, DICKENSON COUNTY, VA., April 6 - (special) - Your correspondent learns that William McFall, a prominent farmer of Freeling, had a narrow escape from drowning a night or two since. He had been to Coeburn, and on his return reached the Pound River after nightfall. It was somewhat swollen, and he rode into it, when his horse went beyond his depth by getting below the ford. Mr. McFall clung to the horse while he swam down the stream. The banks of the river below the ford are very steep and overgrown with thick bush, so that the horse could not get out until he had made the distance of a quarter of a mile where he gained terra firma once more. McFall's avoirdupois is about 200 pounds, and being somewhat corpulent, he is somewhat clumsy. A great deal of the fruit in this section has been killed by the late freeze while it still continues cold and disagreeable. Mr. Henry F. Howell, one of Dickenson counties most progressive teachers, has gone to White Head, N.C. Out In Dickenson DWALE, VA,. May 3 -(Special) - It is so dry that forest fires are raging in several sections of the county, and some damage has been done by the burning of fences. Our farmers are generally busy now making preparations to plant their spring crops. But very little corn has been planted in this section as yet, though the work will be in full blast during this week. Old William Mullins (Pound Bill, as he is familiarly called from his having lived on the Pound River), aged 92, is very ill at his daughter's near this place. He is the oldest inhabitant of the county, and has always lived in the Pound-river section. His wife is still living, and is nearing 90. They reared a large family. Case of Small Pox in Clintwood DWALE, DICKENSON COUNTY, VA., February 17 - (Special) - Your correspondent learns that there is a case of small pox in the town of Clintwood, three miles from here. The victim is Cicero Greer, a young man of that place who had been out in the infected district in Wise County. There seems to be various opinions as to whether the disease is actually small pox or not. Excitement ran high at Clintwood for awhile, but it has now almost subsided. Mrs. Noah Yates, wife of a prominent farmer of the "Ridge", is seriously ill; and her recovery is very doubtful. We are having fine weather for farm work now, and our farmers are taking advantage of it. Out in Dickenson DWALE, DICKENSON COUNTY, VA., October 27 - (Special) - The registration in this county (Dickenson) is the lightest it has been for years in a State election. There seems to have been a slight increase on the Republican side over the Democrats. There are many people in the isolated sections of the county who do not know who the candidates on the State ticket are. Only a few days ago a young man, who is in charge of the post office, and who claims to be posted, asked your correspondent, who the Republicans candidate for Governor was. Upon being told that it is McCaull, he remarked, "Well I know of one vote he will get; but of course he cannot be elected." Quite a number of witnesses left Clintwood for Abingdon to testify in somewhat famous case of B.F. Chapman against the Yellow Popular Lumbar Company, which is now being heard in the Federal Court. There is about $90,000 involved in this suit. There are many gray squirrels in this section, and the sportsman's gun is heard on every hill. They are destroying a great deal of corn. Pursuit of Wild Bees To the editor of the Dispatch; Will you please give me the common law, or statute law, if there is any, in regard to wild bees? The point I want decided is to whether a person has the right to them if he finds them on another's premises, and whether he can cut the tree in which he finds them without permission of the owner. Yours truly, Dwale, Va. F.M.B A person has no right to go upon the lands of another and take therefrom bees or any other animals, birds, insects, etc., without the consent of the owner. Such an act is a trespass, for which the law prescribes a remedy. All animal, whether tame or wild, are by our law the subjects of ownership to a greater or less degree. Tame animals - i.e. horses, sheep, cattle, etc. - are regarded as absolute property, and in those which are by nature wild, the owner has a qualified property. The latter class are technically known by the Latin designation, "Ferae naturae". Such a qualified property may be acquired in three ways: 1) By one's industry in taming them; 2) by reason of their inability to escape from one's possession or premises; 3) by reason of some privilege conferred by law. Such wild animals are one's property only while they continue in his actual possession. If they regain their freedom the ownership ceases, unless, having been domesticated, they have "animum revertendi" - the intention to return. Pigeons which fly away from home, or a tame deer wandering at liberty illustrates this latter point, as they gradually return to their owner at nightfall. "Bees are ferae naturae, but when hived and reclaimed, one may have a qualified property in them per industriam, and if they leave the owner's hive his property in them still continues as long as he can keep them in sight and identify them, and though they settle on a tree in another's grounds that does not divest the ownership. But as between the owner of the land and any stranger the bees and honey they may belong, it is believed, release soil, to the proprietor of the soil where they are found, subject to the bees (until he has reclaimed and hived them) to lose his ownership by the swarm leaving his premises." (article trails off, illegible) DICKENSON Delegates in the Pulaski Convention Elected DWALE, VA., June 22 - (Special) - The Democrats of Dickenson county held a mass meeting Tuesday for the purpose of appointing delegates to the congressional convention, to be held at Pulaski City July 5th. The following delegates were appointed: Clintwood District, Frank Beverly; Ervinton District, George W. Sutherland; Sand Lick District, William B. Sutherland; Willis District, J.C. Kerr; delegates for the county at large, J.C. Counts. The delegates were instructed to cast the vote for the county for William F. Rhea, of Bristol. Your correspondent saw a man at court at Clintwood this week, who said he was 73 years old, and had never read a newspaper in his life. He never read anything but the Bible, and does not intend to begin reading newspapers at this late day. The High School closed out at Clintwood a day or two since, with an exhibition, in which the students acquitted themselves with honor. The spectators were well pleased with it. WHAT A FARMER SAW Probably a Stray Shell from One of Sampson's Big Guns DWALE, DICKENSON COUNTY, VA., June 7 - (Special) - A farmer near this place reports having seen something pass through the air yesterday, which from his description, must have been a large areolite. He was in the field when his attention was attracted by a large passing shadow. Then he instantly cast his eyes upward, where he saw a novel sight, the object shooting through the air at a very rapid rate, going northward. It was of a cylindrical shape, and presented a fiery appearance. He compares it to that of a horse. It seemed to burst into fragments when some distance away, the pieces falling north. TIDINGS FROM DICKENSON The Small-Pox Scare-Logging Men Are Complaining DWALE, DICKENSON COUNTY, VA., March 16 - (Special) - The Tribune, a little weekly paper, of Clintwood, has resumed publications, after a suspension of some months. The space in the present issue is devoted mostly to the discussion of the small-pox situation in Southwest Virginia. I learn that there is a case of measles, alias small-pox, two miles south of this place. Several parties have been exposed to it. There are quite a number of very substantial building in process of erection in t his vicinity and Clintwood. The logging men are complaining of having no tide to float their logs out of the streams. They are needing the money they would realize from marketing their timber to defray the expense incurred. If there should be no tide this spring it would result in a serious loss to them. County Court will convene at Clintwood to-day. There are some very important matters to be heard at this term. The case of the Commonwealth against David Fleming, charged with making a felonious assault upon his cousin, Tandy Fleming, last June, will probably be heard. It will attract considerable attention.

She was b. in Wise County I am unsure of the year but she married Robert CULBERTSON in Scott County Feb. 14, 1890. You are correct that this district is in present day Alamance County, NC. I have made some copies from early Orange County, NC lower court records that indicate Elijah Beverly was the son of John Beverly of Orange County who died sometime before February of 1765. He had brothers named Isaac, John, and Jesse, and a sister named Hannah. They were all bound out to local families shortly after the death of John Beverly. Early Orange County land records indicate that John Beverly had at least 200 acres of land prior to his death, and there is an inventory of the household articles included in his estate. Unfortunately, I don't have any further information on Elijah Beverly and his wife and children. I hope this will be of assistance to you. Hannah Beverly one of the Children was Born Oct 17th 1750 and wants to stay with John Fruit and his wife until she is 16 Years old and they agree to find her Sufficient Meat drink and Apparel & Teach her to sew , Isaac Was Born March 30 th 1753 Joshua Hadley agrees to take him & Learn him to Read & Write & give him 12 or £15.     3. Pattie, I have some connections with Luther Anderson who was a Baptist preacher in Wise Co. He was married to my grandpa Gollaway's sister, Rosa. I don't know the exact dates, but they both passed away in the late 40's or early 50's. One of their daughters,Laura{or Laurie}married Wint Klepper. Both deceased. They had two sons.
