    1. [VAWASHIN] James Berry/Jane Doak -- Children confirmed
    2. Have just located estate settlement papers for the James Berry who married Jane Doak on 11 Jan 1787 in Augusta Co, VA. [ Marriage Source: "Virginia Historic Marriage Register: Augusta County Marriages 1848-1850” by John Vogt and T. William Kethley, Jr.; Iberian Publishing Company, Athens, Georgia, page 239]. An Augusta Co, VA administrator's bond for James Berry, deceased was filed on 26 June 1809 by Jane and Charles Berry. [Source: "Chronicles of the Scotch-Irish Settlement in Virginia" by Lyman Chalkley, Originally pub. 1912; Vol. II, page 394] A personal search of the the Will Books of Augusta Co, VA did not turn up a Will for 'this' James Berry, however, I have been able to trace his estate settlement papers in Augusta Co, VA court records and they do serve to identify the children of James Berry/Jane Doak. This James Berry was the son of Charles Berry who died in 1789, naming his son James Berry, among other children. [Will of Charles Berry, Augusta County, VA Will Book VII, page 168. See transcription of this will posted on Augusta Co, VA archive site at: ftp://ftp.rootsweb.com/pub/usgenweb/va/augusta/wills/w-ber02.txt Charles Berry identifes the following heirs: wife, Mary, sons: Robert, John, Charles, James; daughters: Challe [Charlotte], Elizabeth Henry, Jean Brawford] Jane/Jenny Doak was the daughter of David Doak who died in Augusta Co, VA by 28 June 1803. [See transcription of his will on archives at: ftp://ftp.rootsweb.com/pub/usgenweb/va/augusta/wills/w-doa01.txt David Doak bequeaths "to my daughter Jenny Berry five shillings ...." In March 1813, Augusta Co, VA Court, the Inventory of the Estate of James Berry, deceased was filed. [Source: Will Book 11, Page ___ [unclear on film]; Virginia State Library, Microfilm Reel #46, Will Book 11, 1811-1814; have not posted this to archives, but can provide my transcription.] The final settlement of the Estate apparently took several years. [Source: Will Book 16, pages 97-101; Virginia State Library, Microfilm Reel #47, Will Book 16, 1827-1829] All three of these documents from Virginia State Library films are very difficult to read because they are so faint, however in the 17 Oct 1827 Augusta Co, VA document, it is very clear that there were 8 children and they are identified by name, including the husbands of all married daughters. I have made a preliminary transcription and am attempting to obtain LDS films in case they are better copies. The distinct section which identifies the children and their 1/8th share of the estate shows the following names with my annotations of further information for those children in brackets: (1) To: William Bratton & Polly his wife. [ Polly Berry m. William Bratton 17 Dec 1812 with J. D. Erwin, Minister. [Source: "Virginia Historic Marriage Register: Augusta County Marriages 1848-1850” by John Vogt and T. William Kethley, Jr.; Iberian Publishing Company, Athens, Georgia, page 239] [This couple moved to Montgomery Co, IN. Have good documentation on their lives and some children.] (2) To: Wm. N. Youel & Jane his wife. [Jane Berry m. William Youell 18 Jan 1816 with J. D. Erwin, Minister. [Source: "Virginia Historic Marriage Register: Augusta County Marriages 1848-1850” by John Vogt and T. William Kethley, Jr.; Iberian Publishing Company, Athens, Georgia, page 239] [Also see: "Bible records, Youel Family Genealogy microfilmed-by the LDS, Church FHC Film # 1503998 which does identify the same eight children as descendants of James Berry/Jane Doak] [This couple moved to Montgomery Co, IN and then on to Benton Co, IA. Have some good documentation on their lives and some children.] (3) To: John Berry & Charlotte his wife. [Charlotte Berry m. John Berry 23 Oct 1823 with James Morrison, Minister. [Source: "Virginia Historic Marriage Register: Augusta County Marriages 1848-1850” by John Vogt and T. William Kethley, Jr.; Iberian Publishing Company, Athens, Georgia, page 239] [I don't know what became of this couple, nor which Augusta County BERRY family John Berry belonged to at this point in time, but Charlotte was the daughter of James Berry/Jane Doak.] (4) To: David Berry [David D[oak] Berry m. Betsy B. Walkup 2 Oct 1823 in Rockbridge Co, VA with Andrew B. Davidson, Minister. [Source: "Rockbridge County Marriages 1778-1850" by Dorthy & Edwin C. Kirkpatrick; Iberian Publishing Company, Athens, GA 1985, page 34] [This couple also moved to Montgomery Co, IN and I have some good documentation on their lives and children.] (5) To: Charles Berry [Charles Berry m. Elizabeth Craig 28 July 1819 in Augusta Co, VA with J. D. Erwin, Minister. [Source: "Virginia Historic Marriage Register: Augusta County Marriages 1848-1850” by John Vogt and T. William Kethley, Jr.; Iberian Publishing Company, Athens, Georgia, page 239] [This man died in 1884 in Page Co, IA. I have limited information on his whereabouts prior to that date or his children.] (6) To: James Berry [ There are several James Berry marriages in the same time frame & same Presbyterian Minister as the other siblings, but I have no further information on this James Berry, although he may have moved to Montgomery Co, IN also.] (7) To: Margaret Berry [Margaret Doak Berry was unmarried at the time of this Estate Settlement. She is identified in the Youel/Berry bible record as a child of James Berry/Jane Doak and I have tentative information that she married William Hamilton on 1 Nov 1834 in Augusta Co, VA and they ultimately moved to Washington Co, IA.] (8) To: John Porter & Rachel his wife. [Rachel Berry m. John Porter 21 Dec 1826 in Augusta Co, VA [Source: "Virginia Historic Marriage Register: Augusta County Marriages 1848-1850” by John Vogt and T. William Kethley, Jr.; Iberian Publishing Company, Athens, Georgia, page 239] [John Porter's first marriage was to Agnes 'Nancy' Bratton, sister of the William Bratton who married Mary 'Polly' Berry, Rachel's oldest sister. John Porter and Rachel also moved to Montgomery Co, IN.] Many descendants of Samuel Berry/Nancy Crow have been given information that his father was the James Berry who married Jane Doak. I think it is clear from the above information that they did not have a son named Samuel. There has also been information posted on the internet that the father of the James Berry who married Jane Doak was Thomas Berry. I think it can be demonstrated that 'this' James Berry's father was Charles Berry. The Thomas Berry [Sr] who died in Washington Co, VA in 1799 [Washington Co, VA, Will Book 2, Page 209 -- transcription posted at: ftp://ftp.rootsweb.com/pub/usgenweb/va/washington/wills/b6000002.txt ] Thomas Berry [Sr] also had a son named James Berry. This James Berry was married to Elizabeth McCutchen and this Berry/McCutchen couple can be documented as married from 1763 through 1788. The deeds which document this are found in: [1] 21 June 1763 Augusta Co, VA Deed Book 11, Page 242 [Thomas Sr/wife Esther sell 168 acres to 'his son James' [2] 19 August 1771 Augusta Co, VA Deed Book 17, Page 309 [James Berry/wife Elizabeth sell the same 168 acres to James McKemy.] [3] 14 October 1788 Washington Co, VA Deed Book 1, Part 1, page 97 [James Berry/wife Elizabeth sell 144 acres of their 200 acre survey to Dominic Morrin.] I have not posted these deeds to archives yet, but would be happy to provide complete transcriptions. James Berry/Elizabeth McCutchen did have a son named Samuel Berry [b. 27 June 1780-10 Feb 1855] who married Jane Weir circa 1803. Samuel Berry/Jane Weir lived in Franklin Co, TN from ca 1805 until 1826 when they moved to Menard Co, IL. They and their 11 children can be well documented along with his brother the Rev. John McCutchen Berry. The Samuel Berry who married Nancy Crow in November 1795 has often been cited as the son of James Berry/Jane Doak, however I believe that the above newly found estate papers of James Berry indicate that he did not have a son named Samuel. Samuel Berry/Nancy Crow should belong to one of the extended BERRY families who can be traced in Augusta/Rockbridge and Washington counties, however just which one is unknown to me at this time.
