VA Deed Bk. 24, p 538 "An Indenture tripartite, made & entered into this 28th day of January 1860. Between Jas. R. Deadmore of the first part of the town of Abingdon VA Martha B Newland of Abingdon Washington County of the second part & DC Dunn of Abingdon Virginia of the third part. Whereas the said Martha B Newland is seized & possessed of a certain interest in the estate of Margaret Hathorn decd [deceased] her Grand mother [grandmother] also in the estate of David Hathorn decd [deceased] & whereas a marriage is agreed upon & intended to be shortly solemnized between the said Jas. R Deadmore & Martha B Newland & whereas it was agreed upon by & between the said Jas. R Deadmore & Martha B Newland that the said Martha B Newland should notwithstanding her intended marriage have hold enjoy & possess all her said property above discribed [described] with all & every the rights titles interests & profits of to in & out of the same free & separate from all claims or demands of the said Jas. R Deadmore ! arising from the consummation of said marriage. And whereas the said Martha B Newland, has relinquish discharged & forever quit-claim to all & every part of the property real & personal of him the said Jas. R Deadmore to which she the said Martha B Newland might on the perfecting of the above marriage be entitled to by virtue of dower or in any other way whatever. Now this Indenture witnessed that in consideration of the said intended marriage & in pursuance of the perfecting of said herein before mentioned agreements & in consideration of the sum of one dollar good & lawful money of the United States to the said Martha B Newland in hand paid by the said DC Dunn at or before the sealing & delivery of these presents the receipt whereof is hereby acknowledged she the said Martha B Newland with the consent & approbation of, of the said Jas. R Deadmore testified by his being a party thereto & sealing & delivering these presents hath bargained sold assigned & transferred & set o! ver & by these presents doth bargain sell assign & transfer & set over to the said DC Dunn his executors administration & assigns the interest aforesaid to have & to hold the said property hereby conveyed unto the said DC Dunn his executors administrators or assigns. But nevertheless upon the trust & for the intents & purposes herein after expressed & declared of & concerning the same. That he said DC Dunn his executors administrators or assigns shall hold & manage the said property & all & every part & parcel thereof to & for the sole & separate use; benefit & disposal of the said Martha B Newland her said marriage notwithstanding. And that the same in as manner whatsoever shall be subject to the direction control or disposition of him the said Jas. R Deadmore her intended husband. And upon further trust that he the said DC Dunn shall pay transfer or deliver unto Martha B Newland or such person or persons & at such time & times, & in such proportions manner & form as she the said Martha B Newland may direct by her request or order made in wri! ting attested by three or more credible witnesses all the rents issues & profits of the said property so conveyed as aforesaid. And all the said separate & distinct estate & produce & increase thereof shall be had taken held & enjoyed by such person & persons & for such use & uses as the said Martha B shall at any time or times hereafter during her life limit devise order or dispose of the same or any part thereof either by her last will & testament in writing or by any other writing whatsoever signed by her in the presence of three or more credible witnesses. And the said Jas. R Deadmore for himself & his heirs covenants & agrees to & with the said DC Dunn in manner following (That is to saz) [That is to say] That if the said intended marriage shall take effect he the said Jas. R Deadmore will permit & suffer the said Martha B to give grant & dispose if her said separate estate as she shall think fit in her life time & to make such will or other writing aforesaid & thereby! to give, order, devise limit & appoint her said separate estate to an y use or purpose she may think proper & the said Jas. R. Deadmore will suffer & permit such will or other writing if made to be duly proved according to law. And the person or persons the said Martha B shall give or dispose any part of her separate estate by her will or other writing which may be assigned in the presence of three or more credible witnesses shall & may lawfully peaceably & quietly have hold use & occupy possess & enjoy the same according to the true meaning of such gift devise or appointment without any interruption or hindrance by the said Jas. R Deadmore & that he the said Jas. R Deadmore shall & will from time to time after the said intended marriage shall take effect upon every reasonable request & at the proper costs & charges of the said DC Dunn do & execute all & every such further act & acts for Martha B allotted & declared for her separate use benefit & disposal as afore side as by the said DC Dunn shall be reasonably devised, advised, or required. I! n witness whereof the parties have affixed their hands & seals the day & year first above writen [written]. James R Deadmore Martha B Newland DC Dunn Washington County to wit; This day Martha B. Newland a party to the within writing personally appeared before me R Keys Jr a Justice of said county & acknowledged the same before me. Given under my hand this 28th day of January 1860. Robt Keys jr JP In the clerk's office of the County Court of Washington the 3Oth day of January .1860. This deed from James R Deadmore & Martha B Newland To David C Dunn Trustee was acknowledged on the day above mentioned before John G Kreger Clerk of the said County by the said Deadmore & Dunn as their act & deed & together with the certificate of acknowledgement of the said Martha B Newland made thereto admitted to record.
