From Surry Co, VA Deeds 5:291,5:292, 5:293 FHL microfilm 0,034,120 This Indenture made the twenty third day of October eighteen hundred and sixteen between Stephen Sorsby and Martha J Sorsby his wife of the one part and William S. Lucas of the other part Witnesseth that the said Stephen Sorsby and Martha J Sorsby his wife in consideration of the sum twelve hundred dollars, lawful money of this Commonwealth to them in hand paid by the said William S. Lucas at or before the ensealing and delivery of these presents (the receipt where of is hereby acknowledged) Have bargained and sold and by these presents do and each of them doth, bargain and sell unto the said William S. Lucas, his heirs and assigns, one certain tract or parcel of Land Containing two hunderd and sixty three acres, be the same more or less, and bounded by the lands of William Milby, the estate of James Kee decd John Peter and the lands of the said William S. Lucas and Henry Bilbro, together with all and singular the appurtenances and the reversion and reversions, remainder and remainders, yearly and other rents, Issues and profits there of and every part and parcel there of, To have and to hold, the said two hundred and sixty three acres of land, with the tenements here d??aments and all and singular other the premises herein before mentioned or intended to be bargained and sold, and every part and parcel thereof with every of their rights members and appurtenances unto the said William S. Lucas his heirs and assigns forever, and the said Stephen Sorsby and Martha J his wife for themselves and their heirs the said two hunderd sixty three acres of land with all and singular the premises and apputenances before mentioned, unto the said William S. Lucas his heirs and assigns free from the claim or claims of them the said Stephen Sorsby and Martha J his wife, or either of them their or either of their heirs and of all and every person or persons whatsoever, shal will and do warrant and forever defend by these presents In Witness whereof the said Stephen Sorsby and Martha J his wife have hereunto set their hands and seals the day and year first above written. The within written deed of bargain and sale from Stephen Sorsby and Martha J Sorsby his wife to William S. Lucas with a receipt endorsed was proved to be the act and deed of the said Stephen Sorsby by the oats of Archibald Davis, Wilie Davis and James McGuriman the witnesses thereto and as to the said Stephen, is by the court ordered to be recorded. On the motion of the said William S. Lucas a commision is awareded to be directed to the Justices of Northampton County in the state of North Carolina to examine the said Martha. Lucas of the county of Surry and the sate of Virginia, of the first part, and Stephen Sorsby of the county of Northampton and the state of North Carolina, of the second part, and Wilie Davis of the other part. Witnesseth that the said William S. Lucas, in order to secure the payment of tweo bonds bearing date the first day of Jan'y eighteen hunderd and eighteen for the sum of six hunderd and seventy two dollars, which will more fully appear by haveing reference to the said bonds and in consideration of the sum of one dollar to him the said William S. Lucas in hand, paid by the said Wilie Davis at or before the ensealing and delivery of these presents (the receipt whereof is hereby acknowledged) the said William S. Lucas hath granted bargained and sold and by these presents, doth grant bargain and sell unto the said Wilie Davis one certain tract or parcell of land lying and being in the county of Surry and adjoining the lands of William Milby, the estate of James Kee dec'd John Peter and the lands of said William S. Lucas and Henry Bilbro, and contains thwo hundred and sixty three acres be the same more or less, together with the reversions remainder and remainders, yearly and other rents issues and profits thereof both at law or in equity of him the said William S. Lucas in, to or out of the lands tenements here?ilaments and premises. To have and to hold the said two hunderd and sixty three acres of land herein mentioned to be hereby granted with their and every of their appurtenances unto the said Wilie davis his heirs Ecors: admors: or assignes forever Upon special trust and confidence nevertheless that the said Wilie Davis shall when teherto required by the said William S. Lucas or the said Stephen Sorsby, whichever may first make the request after the first day of June, in the year Eighteen hundred and nineteen, after giving legal notice of the time and place of sale proceed to sell the before mentioned tract or parcel of land, or so much thereof as shall be sufficient for the discharge of the debt herein before mentioned with the legal Int's (interest) which may accrue thereon and all cost attending the same at publick auction for reddy money and out of the money arising from the sale in the first place to pay and satisfy all reasonable charges attending the execution of this trust and then the debt above mentioned, and the residue (if any) arising from such sale to the use of said William S. Lucas, his heirs Ecors: or admors: or ? such other person or persons as shall be thereto legally entitled. In attenstation where of the said William Lucas hath here unto set his hand and affixed his seal as also the said Wilie Davis and Stephen Sorsby the said Wilie Davis for the due execution of this trust and the said Stephen Sorsby as sanction to the present instrument of of writing. Lucas to Wilie Davis trustee for Stephen Sorsby was proved to be the act and deed of the said William S. Lucas, Wilie Davis, and Stephen Sorsby by the oaths of Archibald Davis- James McGuriman, and William McGuriman the witnesses thereto and by the court ordered to be recorded. a receipt endorsed was proved by the said Archibald Davis the witness thereto and is also oredered to be recorded. Lucas, and the said James McGuriman together with all and singular the appurtenances , and the reversion and reversions, remainder and remainders yearly and other rents issues and profits thereof and every part and parcel thereof, To have and to hold, the said Seven acres of Land, with the tenements, hereditaments and all and singular the premises herein before mentioned and intented to be bargained and sold and every part and parcel thereof, with every of their rights, members and appurtenances unto the said James McGuriman his heirs and assigns forever and the said Stephen Sorsby and Martha J his wifefor themselves and their heirs the said seven acres of Land with all and singular the premises and appurtenances before mentioned unto the said James McGuriman his heirs and assigns free from the claim or cliams of them the said Stephen Sorsby and Martha J his wife or either of them their or either of their heirs and of all and every other person or persons whatsoever, shall will and do warrant and forever defend by these presents In witness where of the said Stephen Sorsby and Martha J his wife have here unto set their hands and seals the day and year first above written. The within written deed of bargain and sale from Stephen Sorsby and Martha J Sorsby, his wife to James McGuriman was proved to be the act of the said Stephen Sorsby by the oaths of Archibald Davis, Wilie Davis and William McGuriman the witnesses thereto and as to the said Stephen is by the Court ordered to be recorded a receipt endorsed proved by Wilie Davis the witness and also ordered to be recorded on the motion of said James McGuriman a commission is awarded to be directed to the Justices of Northampton County in the state of North Carolina to examine said Martha. Ex'd teste....( it is not signed) Surry County Virginia Deeds 5:406 FHL microfilm 0,034,120 Virginia, Surry County, to wot The Commonwealth of Virginia to Cornelius Moore and Wm Gooseley Gentlemen Justices of the county of Northampton in the state of North Carolina greetings, Whereas Stephen Sorsby and Martha J Sorsby by their certain Indenture of bargain and Sale bearing dates the 23rd day of October 1816 have sold and conveyed to William S. Lucas a certain tract or parcel of Land containing two hundred and sixty three acres be the same more or less and bounded by the lands of William Milby and others and whereas the said Martha J Sorsby cannot conveniently to our Court of our said county of Surry in the state aforesaid to make acknowledgement of the said Conveyance, Therefore we do give unto you or any two or more of you power to receive the acknowledgement which the said Martha shall be willing to make of the conveyance aforesaid and we command you that you go personally to the said Martha and examine her priviledge apart from her said husband, first explaining to her the said Indenture and this writ and enquire of her whether she signed the said deed freely and voluntarily without the persuasions or thereto of her said husband and whether she be willing the same should be recorded in our said County Court of Surry and when you have received her acknowledgement and examined her aforesaid, that distinctly and plainly without delay you send and certify the same to us in our same Court under your hand and seals, returning the aforesaid Indenture, which is hereto annexed, and this Writ. Witness John Faulcon clerk of our said County Court at the Court house aforesaid on the 12th day of June 1817 in the 41st year of the Commonwealth. State of North Carolina, Northampton County Pursuant to the annexed commission to us directed we the undersigned justices of the peace for the county aforesaid have proceeded to take the private examination of Martha J Sorsby, the wife of Stephen Sorsby now of this County: and that she in our presence acknowledge that she without the persuasion or thereto of her said husband did voluntarily and of her free will accord on her own part sign and execute the annexed deed of bargain and Sale. This commission to receive the relinquishment of Martha J Sorsby wife of Stephen Sorsby to lands conveyed by her husband to William S.
