"March, 1814, Benjamin Pennbacker, aged 53, deposes, ditto; was not in Shenandoah County in 1779; he first came in 1783." Source: Berks County, Pennsylvania Deed Books, v. 70, p. 399-400 Deed Poll "To all people to whom these presents shall com I Philip Kremer Esquire high Sheriff of Berks County in the Commonwealth of Pennsylvania Send Greetings Whereas by a writ of scire facias [that you cause to know] bearing Test the Seventeenth day of May Anno Domini one thousand and seven hundred and eighty three issuing out of the Court of Common Pleas of said County I was commanded that of the goods and Chattels Lands & Tenaments of Derrick Pannybecker late of Amity Township & Berks County afs. Yeoman in my Bailiwick I should cause to be levied, as well a certain debt of nine hundred and twelve Pounds in Gold or silver money which John Kirlin and Henry Lehr lately in the County Court of Common Pleas of the County of Berks before the Justices at Reading recovered against him as two Pounds eleven shillings and three pence like Money which the said John & Henry in the said Court were adjudged for their damages which they sustained by occasion of the detention of that debt, as for! their Costs & charges by them in & about there said in that behalf expended, whereof the said Derrick Pannybecker was convicted as appears of Record And that I should have that Money before the Justices at Reading at the County Court of Common Pleas thereto be held for the County of Berks the twelfth day of August this next to render unto the said John & Henry for their debt & damages aforesaid." It may noted that as of 17 May 1783, Dirck Pennybacker was referred to as "late of Amity Township & Berks County." Tradition holds that the Pennybackers made a brief stopover in Washington County, Md., near Sharpsburg, where they leased a furnace from the Hughes family. This operation was destroyed shortly thereafter and they moved on to Virginia. In support of this tradition are two pieces of evidence: Benjamin Pennybacker served in the Select Militia of Washington County (unit formed in 1781) under Capt. Adam Ott in 1783 and Isaac Samuels witnessed a deed there in 1783. Sherry has so nicely given us these tax records. I see a John HUPP in 1793 as a captain of what exactly? John is not my ancestor, but his brother, Samuel, is, if this is the right family!
