Rinker VS David Lambert Partition of land TO THE COUNTY COURT OF SHENANDOAH COURT IN CHANCERY SITTING: Respectfully complaining, Your Orator Thomas J. Rinker, sheweth to the Court, that in the division of the real estate of his late father Jacob Rinker Jr., deceased, there was assigned, among other portions of land, to your Orator and his sister Catharine Rinker, a tract of land lying in said county two miles west of Woodstock on the road leading from said town to Columbia Furnace, containing one hundred acres more or less. That the said Catharine Rinker died under twenty one years of age unmarried and without issue, leaving as her only heirs at law on the part of her father, the said Jacob Rinker Jr. deceased, from whom she devised by devise, her interest in said land, the following persons, to wit: Your Orator who was a brother of the said Catharine of the whole blood and Samuel Rinker, Henry St. John Rinker, and Jacob G. Rinker, brothers and Mary the wife of David H. Fravel as sister of the half blood, That your Orator being thus entitled to an undivided half of the said tract of land as devised from his father and to one undivided third of the other half as one of the heirs of said Catharine Rinker deceased, holds two undivided thirds of the whole and that David Lambert of said county, who purchased the interests of the other heirs, holds the other undivided third, and that your Orator is anxious to have the said land divided so that he may hold and enjoy his interest therein in severally. Your Orator files with this bill an contract made Exhibit A from the Report of the commissioners who divided the lands of said Jacob Rinker Jr. deceased, of record in the clerk's office of this county, which contains a more particular description of said land. To the same therefore that justice may be done and as your Orator can only have complete and adjudged relief in a court of equity where matters of this nature are properly recognizable and relisable. Rinker died at her residence near St. Luke last Monday aged 73 years. She leaves four children to mourn the loss of an affectionate mother. Messrs. Samuel, Philip, Robert and Henry Brubeck. She was buried at St. Luke on last Tuesday. NOTE: In the obit Thomas J. Rinker was dead as he is not mentioned as surviving and although it states that she was buried at St. Luke that was not the case. Her service might have been held at St. Luke, but Elizabeth Fisher Brobeck Rinker was buried at Cedar Grove Cemetery, just north of New Market, VA. NOTE: From the obit it is hard to know whether the writer was referring to St. Luke, the place, or St. Lukes Church (Brethren) and for those of you who are curious as to where St. Luke and St. Lukes Church are located: St Luke (Locale) is "located 0.1 miles south of Narrow Passage Creek, 2.5 miles southwest of Alonzaville and three miles northeast of Columbia Furnace." "St. Lukes Church is located at the east foot of Little North Mountain 0.5 miles northwest of Holmans Creek and two miles west of Moores Store. Records indicate, conflictingly, that this Brethren church was erected sometime between 1835 and 1840, and that it was dedicated in 1876. This church has also been called the "County Line Church" due to its proximity to the Rockingham-Shenandoah County border 150 feet away."
