He left 4 infant children who were appointed guardians. Guardian for Thomas J. and Catharine Rinker was William Moreland and Guardian for Henry St. John and Jacob George Rinker was Absalom Rinker, brother of Jacob Rinker Jr. deceased. Shenandoah County Virginia Chancery Suit #1844-013 Instituted 13 January 1840 ABSALOM RINKER, GUARDIAN VS. HENRY ST. JOHN RINKER ET AL To the County Court of Shenandoah County in Chancery sitting: Respectfully sheweth to the court your Orator Absalom Rinker, that he is the guardian of Henry St. John Rinker and Jacob George Rinker, orphan children of Jacob Rinker Jr. deceased, That said infants are the joint owners of a house and lot in the town of Woodstock known and distinguished on the plan of said town as Lot No. 83, and now occupied by Hiram Myers. That the said house and lot now rents for about sixty dollars out of which the necessary expenses for keeping the premises in repair must be taken. This house and the other buildings upon the lot are in danger of being destroyed by fire, surrounded as they are by other buildings that are liable to be consumed. Your Orator alleges that the above described premises can be sold for at least sixteen hundred dollars, one half in cash and the residue in three equal annual payments, the interest on which amount will exceed by a large sum the rent which can be obtained, after paying the taxes and for necessary repairs. it is therefore manistfully to the interest of said infants that this property shall be sold and the proceeds safely invested until they respectively arrive to the age of twenty one years. The other real property to which said infants are entitled consists of one twelve acre out lot, two five acre out lots near the town of Woodstock, one in lot in said town containing an acre, and an interest in some detached pieces of land of no great value, besides they have an interest in the land which descends from their half sister Catharine Rinker, deceased. They are also distributees of their father Jacob Rinker deceased and of the said Catharine Rinker deceased, but the amount to which they are heirs, entitled is not precisely known to your Orator, as their estates have not been finally settled up. The amount however, it is believed, will not exceed Two thousand dollars. The persons who would be entitled to the house and lot above described, in the event of the death of said infants are Samuel Rinker, Daniel Fravel and Mary his wife, formerly Mary Rinker and Thomas J. Rinker, the said Samuel and Mary the wife of Daniel Fravel being the brothers and sisters of the whole blood, and Thomas J. Rinker a brother of the half blood and the said infants having no other brothers or sisters or mother living. To the end therefore that the interests of said wards may be promoted, and as the property can only be sold by a decree of a Court of Equity, your Orator prays that Samuel Rinker, Daniel Fravel and Mary his wife, Henry St. John Rinker, Jacob George Rinker and Thomas J. Rinker, the said Henry St. John, Jacob George and Thomas J. being infants, the two former however are the age of FOURTEEN years, may be made defendants to this bill and answer the same upon oath, the adult defendants in proper person, and the infants by Guardian Ad Litem, and the infants over fourteen years also a proper person. That this court will decree the said house and lot in the town of Woodstock to be sold in such manner and upon such terms as may be most conducive to the interest of said wards, and to grant such other and further general relief in the premises as the circumstances of this case requires, and as to the court may seem proper, and your Orator will ever pray and etc. A. Rinker Shenandoah County Court This day the above named Absalom Rinker personally appeared before the subscriber, a Justice of the Peace in and for said county and made oath that the facts stated in the foregoing bill are true to the best of his knowledge and belief. Given under my hand this 13th day of January 1840. Jacob Haun Note: The home in Woodstock was sold to Hiram Myers. ------------------ These slaves were owned by Jacob Rinker Jr. They were sold on the court house steps for $625.00 we believe to James Allen as he bought out the interest of some of the heirs.
