    2. Moses Henry Google LVA. Select The Library of Virginia. What we have. Land records. Virginia Land Office Patents and Grants/Northern Neck Grants and Surveys Enter Henry Moses in to the search window; click GO. When the list of hits shows go to the next page and see the answer to your question!! Click the square in front of the name. Click "Selected" to see the digitized land office card. At the top there is a link to the image of the grant and another to the survey. First slick the grant link. On the new window click "Click Here". On the next window click on the "document" and be patient! You will get the beginning of the grant. To print this page click your browser's print icon. Click options on the printer window and select "fit to page". After it prints. Hit the Go Back icon (<) the browser and you will be taken back to the "document" screen. Click the link to the next page on the top right of the list of pages. The next page will load. Print this page. Read careful what is written. The process was: 1. Warrant - right to the named quantity of land. 2. Entry - an order to a surveyor to survey a specific area of land (this amount was based on a warrant and could be the whole amount or a parcel from it. Many warrantees sold their warrant rights in various size tracts. When this was done it was called an assignment. The assignee was the new owner of the right to the named quantify of land. This happened at every step of the process until the survey had been sent to the Land Office for the grant to be written.( Before the grant is returned I have seen county court minutes where the Grantee had agreed to transfer title of the newly granted land to him to another when the grant is returned to the county. In this case the grantee has moving from the county to another state. 3. Survey by the surveyor of the "local" area. Survey was sent to the land office or Proprietors Office to have the land grant issued by the governors office. 4. The land grant (or patent) is written and returned to the surveyor's office to be delivered or picked up by the new grantee. Elijah Roye did not grant the 100a of land but for some consideration transferred the right of 100a on this named Treasury Warrant No. 765 ( probably Elijah Roye's) to Moses Henry. While a transfer is a transfer! The kind of transfer has its specific "name" and relates exactly to a step as defined by legislative acts. The paperwork follows and allows us to know exactly who had what rights, how & when. Your guy paid something to Elijah Roye for the right to the 100a. This grant language does not tell who had the right to make the entry or request the survey. Entries had recording fees and surveys were not free. Do back to the digitized card screen and click on the survey image and see what other information it relates. Watch the dates as this may indicate when your guy was in the area at that time. Read the survey carefully. The language is very clear and means just what it says! The warrant was for 650A to Elijah Roye who had selected the area for this 100a to be entered and surveyed. He assigned the survey to your guy. The assignment paper may indicate that Elijah did not live near or could not easily get to the surveyors office where his warrant was being held. If he had sent the warrant at that particular time, he would most likely written the assignment on the back of his warrant. This assignment note does not appear to be the back of a warrant. Warrants were more square like documents. NOTE: 3 men signed the original assignment note which appears to be transcribed. You are looking at images of a recording book and not original documents. The original survey and the assignment note may be in possession of LVA in Virginia Land Office Plats & Certificates. However, the warrant may not have been returned until the last survey from this warrant was sent to the land office. One needs to know to whom the last allowable acreage was granted to find the warrant. These documents are filed by alpha & year. In this case H 1797 From the website: "All of the documents that accompanied the patents, including warrants and surveys, were annually destroyed prior to 1779. Does anyone know of or have a record of a Moses Henry marrying an Elizabeth ??? prior to 1802? Also, when it states that Elijah Roye "granted" them 100 acres does this mean he sold it or conveyed it as one would to a relative? Any assistance would be great. Thanks.

One of my grandfather's sisters and one of his half-sisters married a Charles Fenton in the 1800s and they (first one wife then when she died, the second one) lived in Pleasant Hill, MO. He was shot in the lung at Gettysburg and survived. They had a bunch of kids (don't have time to look that up right now) and all are buried at the Baptist Cemetery in Pleasant Hill. Since my post of "Wife of Jacob Burner, Jr.," there has been notes to the mailing list and to me dealing with the identification of the wife of Jacob Burner, Sr., and also concerning the 1750 Reconstructed Mennonite Census of the Shenandoah Valley including the Massanutten Area. As far as I can determine, the only primary reference that sheds any light on the identity on the wife of Jacob Burner, Sr., who was the mother of Jacob Burner, Jr., is found in John (Hans) Bumgardner's Augusta County Will. This will was written on March 22, 1751, and is recorded in Augusta County Will Book 1, pg. 332. John Bumgardner mentions his children: John, Christian, Mary, Elizabeth and Madley/Madlena. He also mentions Jacob Burner, his grandson, and nominates Jacob Burner, (Sr.) as an executor of his estate. It can thus be concluded that one of his daughters was the wife of Jacob Burner, Sr., and the mother of Jacob Burner, Jr., but the will does not identify which one. Since Jacob, Jr., was specifically mentioned as a legate in the will, perhaps his mother was no longer living. In 1999 Richard Warren Davis published Vol. III of "Emigrants, Refugees and Prisoners" containing a Reconstructed 1750 Mennonite Census for the Shenandoah Valley, Virginia, including the Massanutten area. Jacob Borner's Family was designated as Household 37 and John Baumgartner as Household 38 (pg. 6). He places Madlena (Baumgartner) Borner in Jacob Borner's household, indicating she was Jacob's wife. He presented similar information in Vol. II, pg. 61. I wrote Mr. Davis and asked him for the source of his information proving Madlena was the wife of Jacob, Sr. He checked his notes and confirmed that Jacob Burner had married a daughter of John Bumgardner, but was unable to find the source of information that identified her as Madlena. He speculated that someone may have sent this information to him. Over the years a number of persons in addition to Davis have reported without proof that Madlena Burmgardner was the wife of Jacob Burner, Sr. I believe I have found the origin of this information in the publication/manuscript, "A Man of the Bullpasture, John Hiner, 1742-1814, " written by Amanda Arbogast Forbes for the dedication of the John Hiner marker on June 12, 1966, in a small family cemetery near Doe Run. Va. I contacted the author for the source of her information that Madlena was the wife of Jacob Burner, Sr.  She stated her proof was inadequate and was based on a false assumption. Unfortunately, the information in her publication has been accepted as fact by many and continues to be circulated as such since then. In conclusion, I think we can say with certainty that Jacob Burner, Sr., married one of the daughters of John Bumgardner, but we do not know for sure which one. There is a possibility that Jacob Burner, Sr., was married more than once, but we have no proof for this. I continue to search for a primary reference or solid proof that identifies the daughter of John Bumgardner who married Jacob Burner, Sr. If anyone has this proof or any ideas, please post them or contact me directly. I did find that they have them on film. Volume III of Emigrants, Refugees and Prisoners by Richard Warren Davis is on the following film available at a Family History Center FHL INTL Film --1224597 Item 10. This is the volume that contains the Mennonite census. Surely there are some copies of these books in libraries but I don't know where. I see that I also made a note that Vol I has 6 pages of Baumgartner information starting on page 68 with Hans b. ca 1520. And Vol II on page 61 has Madle Baumgartner, daughter of Hans, married to Jacob Burner, plus some other additions. Betty Carson
