Sheryl is correct about my late cousin, Curtis Lawson, cleaning the Robinette Cemetery. I personally hired him to do so because my Great-grandmother Eliza B. "Lyde" Chafin Ward, her son Robert Ward, & her mother Jerusha July Edens Chafin are buried there. Curt took great pride in keeping that cemetery clean for me. What is very sad is that the relatives of others buried in the cemetery took absolutely no interest in cleaning that cemetery or contributing to paying for the cleaning of that cemetery during the past 10 - 20 years. My grandmother, Pearl Ward Castle, cleaned the cemetery up until she died in 1969. It would be wonderful if some of you who have relatives in this cemetery would contribute to having a decent path built down to the now-unpassable county road that runs from the state road by this cemetery and to paying to have the cemetery cleaned at least twice a year. From California I simply cannot do it all by myself any longer. Others must contribute. It would also be beneficially to have some sort of fencing placed around the cemetery to keep the off-road vehicles from further damaging the gravestones. Brenda Reed

Hi, Just wanted everyone to know I will be in the chat room Wed. night at 9 p.m. eastern time if anyone would like to come and chat. The only thing to remember is that it asks to enter a Nickname but I suggest you use just your first name or some version of your name. The reason is that the owner and moderators of the chat rooms have to register their nickname and create a password so if you enter a nickname and then it asks you for a password, Cancel it and try a different name. The rooms does require you to enter your name each time you enter as it does not save it. I have not linked this chat room from the Looking Back Newsletter, I wanted to try it out and see how it does. As Brenda Reed wrote, Curtis Lawson (until his death August 2000) and his daughter, Angela Lawson (who still lives on the mountain in Stickeyville) cleared the Robinette Cemetery to allow family researchers to visit the cemetery and collect information. I have many ancestors who are buried in that cemetery. I do not want any person or persons, regardless of that person(s) being defined as a property owner, elected official or an agent of the community or State of Virginia determining if I should have access to a grave site containing an ancestor of mine. I live in central Ohio and am not able to go to the County Courthouse in Jonesville to verbalize my wishes. I suggest that we, the ones on this list, who have a vested interest in this cemetery and many others in the area that are in danger of this same issue, obtain an attorney familiar with "real-estate law". I am willing to contribute to a fund to assure that I and my children and grandchildren will be permitted to visit these cemeteries when visiting Lee County. My mother, father and their ancestors were born and raised in the Lee County area. Mostly the Stickeyville area. My uncle, Curtis Lawson was very proud of the mountain he lived on all his life. I want to continue his work somehow. If obtaining an attorney is not the answer, then please take a moment and suggest another solution to this issue. This is not the only cemetery that is in danger. One that I know for sure is still there is William (Bill) Maggard and Dorothy Maggard Mullins - although she may live in Big Stone Gap. They are children from Isaac's second marriage to Francis. His first wife, my gr grandmother, was Nancy Ann Sturgill, daughter of John Calvin Sturgill and Abigail (Abby) Stidham. Nancy died 4 Nov 1918 and is buried along with Isaac Maggard in the Maggard Cemetery in Keokee. If anyone knows the Maggard children of Isaac and Francis that are still living there or any Sturgill descendants that might be able to help me with pictures and information about them, I would greatly appreciate if you could let them know that I am trying to contact them. If needed I will furnish my postal address and phone number for them to contact me. Today I spoke with Mr. Poe, Lee County Administrator, about the situation with the road that goes through the property of Joey Cooper & Dick Jones. A hearing was recently held and the Board upheld keeping the road open "for now." Crystal, I'm not sure what your point is on this. I just read the opinion offered by the appeal court. The appeals court reversed the lower court's decision. The appeals court stated the board was justified in terminating Cooper's benefits and the decision of the board was not political. I have just spoken with my contact person in Lee County. He informed me that Lee County Supervisor, Claude Ray, has been involved and has managed to temporarily deny property owners, Joey Cooper & absentee owner, Dick Jones of Texas, from denying access to the Robinette Cemetery. My contact also stated that two young men had ridden some sort of four wheel off-terrain vehicles through the cemetery and have damaged some headstones. He suggests that we contact Supervisor Claude Ray to have "access in perpetuity" clause added to all future dealings with this situation. I have a phone number for Supervisor Ray if anyone is interested, contact me privately, & I will provide the number. What is of grave concern is that anyone would think they could come into a community & deny access to numerous families to the graves of their loved ones, though they be ancestors & not necessarily immediate family. Access to cemeteries located on private property; cause of action for injunctive relief; applicability. A. Owners of private property on which a cemetery or graves are located shall have a duty to allow ingress and egress to the cemetery or graves by (i) family members and descendants of deceased persons buried there; (ii) any cemetery plot owner; and (iii) any person engaging in genealogy research, who has given reasonable notice to the owner of record or to the occupant of the property or both. The landowner may designate the frequency of access, hours and duration of the access and the access route if no traditional access route is obviously visible by a view of the property. Thelandowner, in the absence of gross negligence or willful misconduct, shall be immune from liability in any civil suit, claim, action, or cause of action arising out of the access granted pursuant to this section. B. The right of ingress and egress granted to persons specified in subsection A shall be reasonable and limited to the purposes of visiting graves, maintaining the gravesite or cemetery, or conducting genealogy research. The right of ingress and egress shall not be construed to provide a right to operate motor vehicles on the property for the purpose of accessing a cemetery or gravesite unless there is a road or adequateright-of-way that permits access by a motor vehicle and the owner has given written permission to use the road or right-of-way of necessity. C. Any person entering onto private property to access a gravesite or cemetery shall be responsible for conducting himself in a manner that does not damage the private lands, the cemetery or gravesites and shall be liable to the owner of the property for any damage caused as a result of his access. D. Any person denied reasonable access under the provisions of this section may bring an action in the circuit court where the property is located to enjoin the owner of the property from denying the person reasonable ingress and egress to the cemetery or gravesite. In granting such relief, the court may set the frequency of access, hours and duration of the access. E. The provisions of this section shall not apply to any deed or other written instrument that creates or reserves a cemetery or gravesite on private property. (1993, c. 713; 2004, c. 831.) From the Code of Virginia: § 18.2-127. Injuries to churches, church property, cemeteries, burial grounds, etc.; penalty. A. Any person who willfully or maliciously commits any of the following acts is guilty of a Class 1 misdemeanor: 1. Destroys, removes, cuts, breaks, or injures any tree, shrub, or plant on any church property or within any cemetery or lot of any memorial or monumental association; 2. Destroys, mutilates, injures, or removes and carries away any flowers, wreaths, vases, or other ornaments placed within any church or on church property, or placed upon or around any grave, tomb, monument, or lot in any cemetery, graveyard, or other place of burial; or 3. Obstructs proper ingress to and egress from any church or any cemetery or lot belonging to any memorial or monumental association. B. Any person who willfully or maliciously destroys, mutilates, defaces, injures, or removes any object or structure permanently attached or affixed within any church or on church property, any tomb, monument, gravestone, or other structure placed within any cemetery, graveyard, or place of burial, or within any lot belonging to any memorial or monumental association, or any fence, railing, or other work for the protection or ornament of any tomb, monument, gravestone, or other structure aforesaid, or of any cemetery lot within any cemetery is guilty of a Class 6 felony. A person convicted under this section who is required to pay restitution by the court shall be required to pay restitution to the church, if the property damaged is property of the church, or to the owner of a cemetery, if the property damaged is located within such cemetery regardless of whether the property damaged is owned by the cemetery or by another person. C. This section shall not apply to any work which is done by the authorities of a church or congregation in the maintenance or improvement of any church property or any burial ground or cemetery belonging to it and under its management or control and which does not injure or result in the removal of a tomb, monument, gravestone, grave marker or vault. For purposes of this section, church shall mean any place of worship, and church property shall mean any educational building or community center owned or rented by a church.
