WILL OF THOMAS LUTEN 1766 NORTH CAROLINA CHOWAN COUNTY In the name of God Amen I Thomas Luten of the Province and County aforesaid calling to mind that it is.appointed for all men to die doe make and ordain this my last Will and Testament in manner and form following revoking and disallowing all manner of wills by me heretofore made. Item I give to my wife Hannah Luten for her use and ocupation during her life or widowhood, one negro man called Darby, one negro woman called old Murrear, one negro woman called young Murrear, one negro woman called Pheby, and one negro girl called little Janey, and after the decease or marriage of my said wife, I give the above mentioned Young Murrear and her increase to my son William Luten. I also give to my son William Luten one negro woman called Judah and one negro man called Darby. Item I give to my son John Luten one negro man called Charles and twenty shilling sterling. Item I give to my son Thomas Luten after the death or marriage of my wife one negro woman called Old Murrear and her increase, if any.     3. BlankOK all of you Vail researchers. The following is a inquest into the death a person that took place during the Reign of King George, so we know that was sometime before 1776. What's interesting about this is that Edward Vail was the foreman of the inquest. As we all may or may not know, The North Carolina branch of the Vail family has had some difficulty in determining with certainty what branch of the Vail family they descend from and who specifically started the North Carolina branch. Most speculation is that the NC branch come from the Jeremiah Vail side. It is my belief that no one has yet to determine who the individual was. The following inquest places Edward Vail in Bertie County, NC on a specific date. As they didn't use the current calendar, one must determine the dates of Reign for King George. Death of Mildred Smithwick North Carolina At a Supreme Court of Justice Oyer of Terminor & General Goal Delivery began & held at Edenton on the Second Tuesday in April in the thirty first year of the Reign of our Sovereign Lord George the Second now King of Great Britain & so forth, for the Countys of Currituck Pasquotank Perquimons Chowan Bertie & Tyrrel before the Honorable Peter Henley Esq'r Cheif Justice of the Province aforesaid & the rest of the Justices of the said Courts~~ The Jurors for our Lord the King upon their Oath Present that Annis Legett late of Society Parish in Bertie County Spinster on the first day of July in the Thirty first year of the Reign of our sovereign Lord George the Second King of Great Britain France and Ireland defender of the Faith (and so forth) with Force and arms at the Parish aforesaid in the County aforesaid in and upon one Mildred Smithwick in the Peace of God and our said Lord the King then and there being feloniously and in the fury of her Mind did make an assault and that the said Annis Legett with a Certain Sythe of the Value of one Shilling Sterling money of Great Britain which she the said Annis Legett in both her hands then and there had and held the said Mildred Smithwick in and upon the left Side of the Breast of her the said Mildred Smithwick then and there in the fury of her mind feloniously did Strike giving unto the said Mildrd Smithwick then and there with the Sythe aforesaid in and upon the said left side of the Breast of her the said Mildred Smithwick one Mortal wound of the Breath of Two Inches and Depth of four Inches of which said mortal wound she the said Mildred Smithwick then and there Instantly died and so the Jurors aforesaid upon their Oath aforesaid do say the said Annis Legett the said Mildred Smithwick in Manner and Form aforesaid then and there feloniously and in the Fury of her Mind did Kill & Slay against the peace of our said Lord the king his Crown and Dignity Robert Jones jun'r Atto. pro'd no Reg Dom Rex vs Annes Legett} Manslaughter Evil. The funeral will be held at 11 a.m. Saturday at Pleasant Grove Free Will Baptist Church. Burial will follow in Salem Cemetery. Surviving are one daughter, Bessie Tyndall of Pikeville; three sisters, Ruth V. Williams and Marie V. Rowe, both of Pikeville and Perrine V.     3. From the book GENEALOGY OF SOME OF THE VAIL FAMILY DESCENDED FROM THOMAS VAIL At Salem, Massachusetts 1640 Together with Collateral Lines BY WM. PENN VAIL, M. D. 1937, pages 77-78 SAMUEL (6) VAIL; was born in the old home at Green Brook, N. J., and was under age when he came to Fayette County, probably in 1793. He married two daughters of Thomas Grissell, 1st. Agnes Grissell and 2nd. Elizabeth Grissell. He was of Menallen Township when he made his Will, which is dated 25 December, 1854, and proved 8 May, 1865, and it is probable that he still lived on the land he inherited from his father. He calls himself "far advanced in years" when he made his Will. He bequeaths to his wife Eliza­beth and to his children, thus; -- his sons Joel (7) Vail and Jesse (7) Vail; to the children of his daughter Priscilla Pile, viz., Hannah, Ag­nes, Charles, and Albert Pile "who now reside in Morgan County, Ohio, -- to his daughters Hannah Richardson, Mercy Cope, Marga­ret McGrew, Agnes Frazier and Lydia Vail. Lydia (7) Vail was to have a home with her mother. The homestead was left to Samuel's two sons Edward (7) Vail and Abraham (7) Vail, who were also to care for their mother Elizabeth; and these two sons were named as Executors. WILL OF ABRAHAM (5) VAIL His Will is dated 20 May, 1833; was not probated till 10 January, 1840, and is on file in Uniontown, Fayette County, Pennsylvania. In his Will he makes no mention of his wife so the assumption is that she had died before he drew up that document. He is "of the Township of Menallen, County of Fayette, being far advanced in life"; mentions separately his sons Benjamin and Robert, saying that he had "given them their share in full." To his son Samuel (6) Vail he gives land adjoining Jeremiah Piersol. To his youngest son, Taylor (6) Vail he gives the remainder of lands in Menallen Township, adjoining lands of John Wood, Charles Mc­Cormack and others. He has already given his son Stephen (6) his share, as also to his daughter Catherine Davis. He gives to Charles (7) Vail, son of Samuel (6), and to his sister Priscilla Pile. Likewise to his grand-daughter Mercy Cope, daughter of Samuel Cope. To Margaret, daughter of Samuel (6), Abraham makes a special legacy, and then follows -- "the six following persons being grandchildren and children of son Samuel, (i. e.) Joel, Jesse, Edward, Agnes, Lydia and Abraham." His friends Samuel Cope, Jr., and Dorsey Cope are named as full Executors. The witnesses are Jere­miah Piersol, Job Wheatley and Samuel Cope. Robert S.
