To my wife Mary, the use and benefit of all my real estate during her widowhood, provided she relinquishes her right of dower in farm of land I disposed of to Nathaniel Underhill in West-chester; Also one third part of my movable estate for her own use and benefit forever; Also the other two thirds of my movable estate during her widowhood; provided she pays the interest of the moneys due against said estate; to my two daughters, Abigail and Elizabeth, the two thirds of my movable estate which I have given to my wife during her widowhood; to be equally divided between them at their mother's marriage or decease for them and their heirs forever; if my wife die before me the one third part of my movable estate that I have already given to my wife to be equally divided between my two daughters, Hannah and Mary Pugsley, for them and their heirs forever; my executors to dispose of all my real estate, after a reasonable time after my death, if my wife is deceased first; if not, after her decease or marriage; my lawful debts to be paid out of the first payment; to my son William œ100, which is to be paid him out of the first payment arising from the sale of my lands; to my daughter Abigail œ50, to be paid out of the first said payment; if there be any money left of the first payment I give it to my two daughters, Hannah and Mary Pugsley, to be equally divided between them and their heirs forever; as well as my other two daughters, Abigail and Elizabeth, to their equal proportion, of the same payment for them and their heirs forever; to my son William œ200, to be paid him out of the second payment arising from the above sale of my lands; to my son William and all my daughters, the remaining part of the moneys arising from the second payment, to be equally divided among them and their heirs forever. To my son Thomas œ50, to be paid out of the third payment of my abovesaid lands; to my son John's children, William, Thomas and John œ5 each, and if either son should die before he comes of lawful age or without lawful issue, his part shall be equally divided between the survivors; to my son John's daughter Phebe œ35, to be handed out for her relief as occasion may require by my son Thomas, if not occasioned to be given to her then to her two sisters hereafter mentioned. To my son John's other two daughters, Ann and Elisabeth, œ10 each and their heirs forever; to my daughter Phebe's children, Abigail Quimby, William Quimby, Mary Quimby and Elizabeth Quimby, œ50, to be equally divided among them for them and their heirs forever; if there be any moneys arising from the sale of my real estate above mentioned, which I order to be sold at three equal payments, which has not already been disposed of, I give to my son William and my daughters, Hannah, Mary, Abigail and Elisabeth, to be equally divided among them and their heirs forever. I order that one half of my daughter Hannah's legacy during her life be handed out to her for her relief by my son Thomas, at his discretion, and if there be any left at her decease, it is to go to her children to be equally divided between them; to my son Thomas all my wearing apparel, my former negro man, named Lewee, shall be properly supported by any one of my children which shall be his choice, all of my children shall bear his part of the expense or charge if he becomes chargable. I leave to my son John, all that my 137 1/2 acres of land, lying near Green Brook, in Somerset County, in New Jersey, and now in his possession, and also my negro girl "Dido." I leave to my son Stephen, all that my 137 1/2 acres of land, near Green Brook, in Somerset County, New Jersey, and now in his possession, also a negro boy "Tony." I leave to my wife Mary, all the legacy left to her by her father Matthew Farrington. I also give her during her widowhood the use of the best room in my house, and my negro woman "Hannah." I leave to my daughter Phebe Turner, a negro woman. I leave to my son Thomas, the use of all lands and meadows and buildings (except the room left to my wife) and the use of all my personal estate, on condition that he pay all debts and funeral charges, and support the family for two years, they assisting him with their labor. After the two years I leave to my son Thomas, "a negro boy and the bed and furniture he lyes on." Leaves legacies to his daughters Abigail and Elizabeth. Two years after my decease I leave to my sons, Thomas and Isaac, certain cattle, and the rest of my personal estate to my daughters, Abigail, Sarah, and Elizabeth. I leave to my son Isaac, the use of the land I bought of Thomas Jennings, and 8 acres of woodland joining to a highway near Thomas Nicholl's land, and 4 acres of salt meadow, "part of the Patricks meadow," joining to the meadow of Stephen DeLancy. After the two years I devise to Josiah Hunt and Moses Mullinex, all the remainder of my lands and meadows, and privileges in the Sheep Pasture, In trust for my son Thomas, and my wife is to have 1/3 the profits, and I make them executors. I Richard Dunning do make and publish this my Last Will and Testament in manner following to wit: I give devise and bequeath unto Lewis J. Fish of Malta aforesaid, my executor hereinafter named In Trust for the purposes hereinafter specified all and every my property and estate, both real and personal of every name, nature and description wherever situated, To have and to Hold the same In Trust in the manner and for the purposes hereinafter mentioned, and to be managed conducted and distributed as hereinafter stated: I do hereby authorize, direct and order my said executor on my decease to sell and dispose of all the goods, chattels and personal property of which I may or shall die seized and possessed, and the avails thereof to invest safely on interest, except such household furniture as my daughter SALLY MARIA VAIL wife of GEORGE W. VAIL, may select and desire to use and enjoy, which said household furniture the said Sally Maria is to be at liberty to use and enjoy fully and perfectly under the direction of my said executor ~ I do hereby authorize order and direct my said Executor to pay out and expend such sum or sums of money from the property and estate herein thereby devised and bequeathed to him in Trust, as my said daughter SALLY MARIA VAIL may need or require for the comfortable support and maintenance of herself and family (intending by family to include her husband and children) at such proper time as my said Executor shall deem proper ~ I do also authorize, order and direct my said Executor, from said estate hereby devised to him in Trust, to furnish and provide in his discretion all proper support and maintenance to the children of said SALLY MARIA VAIL, born or hereafter to be born of her, the said SALLY MARIA VAIL, and to educate them, by giving them and each of them the opportunities of a good common school education. Said property and Estate hereby devised and bequeathed is to remain in Trust for the purposes and in the manner aforesaid during the natural life of said SALLY MARIA VAIL, and any receipt from her for any and all advances or expenditures shall be good and valid in the hands of any said Executor and a full and perfect authority and protection to him for any and all expenditures or advances as Executor of this will ~ On the death of my said daughter SALLY MARIA VAIL, I do authorize, direct and order my said Executor to deliver over surrender and convey in due form of law all the property and estate both real and personal of every name nature and description then remaining in his hands or under his control in Trust under and by virtue of this Will and Testament to the child or children of said Sally Maria, which said property and Estate is to be divided among them (if more than one) share and share alike ~ In case my said daughter Sally Maria shall die leaving no child or children her surviving, I then in that case authorize order and direct my said executor to surrender and deliver over and convey in due form of law all the property and estate remaining in his hands in Trust hereunder to Richard Dunning son of my brother John Dunning. And I do further authorize and direct that my said daughter Sally Maria may, if she so choose, occupy and enjoy from year to year the real estate of which I may and shall die seized free of rent, but her right shall be merely the right of a tenant from year to year. And in case she shall thus occupy the said real estate, the avails thereof shall go towards the necessary support and maintenance of herself and family and the education of her child or children. And in case said Sally Maria shall prefer to have the said Real Estate sold, and shall in writing request my said Executor to sell and dispose of the same, said executor shall proceed to sell the same and the avails thereof to invest on interest, furnishing support and maintenance to said Sally Maria and family as aforesaid, and said executor is hereby authorized in the event of a sale to make and execute a good and sufficient deed thereof to the purchaser. I do hereby nominate and appoint said Lewis J. Fish Executor of this my last Will and Testament and hereby revoke every and all former wills by me made.
