There is a John MARTIN and a James MARTIN living in Patrick County on 7 October, 1825. They was called to jury duty to hear the following case: "MICAJAH STONE, late of the County of Patrick, Labourer, who was heretofore indicted of murder and thereof arraigned, and plead not guilty, and for his trial put himself upon God and this Country, was again led to the bar. Whereupon came a jury, to-wit: Edward THOMAS, Harden H. MOORE, John SCOTT, John MARTIN, Golihue MOORE, Henry HART, Edward MURPHY, WIlliam BOOKER, James MARTIN, Joseph VARNER, Bailey CARTER and Gabriel DEHART who say that defendant is not guilty of the felonious killing of Richard STONE in the indictment named because he was a lunatic at the time of such killing. Therefore it is considered by the court that he be discharged and acquitted. At the further order of this Court, being satisfied that the said MICAJAH STONE is a lunatic, that he be remanded to prison, and to be taken before the Justices of this County and examined by touching the state of his mind and the propriety of sending him to the lunatic hospital." (Note: Richard Stone is the father of Micajah Stone.) I see that there is also a Giles MARTIN living in Patrick County and who is serving on the jury, April Term, 1816.
