Item I give and bequeath unto my son Luke Wright a Horse bridle and saddle and 40 Dollars in money also I wish and desire that Polly Bowles and her children to have 100 Dollars at her mothers death . . . ." On May 14, 1847, at Franklin County, Virginia, Chancery Court Order Book A/ the Court issued the following order identifying Mary (Wright) Bowles as a child of George and Mary Wright: "May 14' 1847. At a Circuit Superior Court of Law and Chancery continued and held for Franklin County at the Courthouse on Friday the 14th day of May 1847 Sitting as a Court of Equity. Present - The Same Judge as on yesterday. Isaac Wade ) Plff against ) Polly Wright, widow of George Wright, Decd. ) Hiram Mills and Tenor his wife; Abram Teel, ) and Sucky his wife, and the same Hiram Mills ) and Abram Teel Administrators with the will ) annexed of George Wright Decd.; and Luke ) Wright, Gabriel Wright, Martin Wright, ) Pendleton Wright, Ambrose Abshire, and ) Charlotte his wife, John Wright, William Wright,) John Breedlove, and Kitty his wife; Paschal ) Meador and Quintina his wife; Polly Bowles ) and Martin Bowles, Elizabeth Bowles, Tenor ) Defts. Wright and Polly his ) wife; and Quintina Wright, Elliott Wright, ) George Wright, Catharine Wright, Elizabeth ) Wright, Charlotte Wright and Julia Wright, ) children of the said George W. Wright, ) This day this cause came on to be heard upon the Bill of the Plaintiff the answer of the Defendants Abram Teel and Hiram Mills Administrators with the Will annexed of George Wright deceased, the subpoena awarded in this cause on the 6th day of August 1846 and the 23rd day of Sept 1846 which appears to have been duly served for more than two months upon the Defendants, Polly Wright, John Wright, Luke Wright, Kitty Breedlove, George W. Wright and Polly his wife, Quintina Wright, Elliott Wright, Geo. Wright, Catharine Wright Elizabeth Wright, Charlotte Wright, Polly Bowles, Elizabeth Bowles, Tenor Bowles, William Bowles, Lucy Bowles, Cynthia Bowles, Martin Bowles, Paschal Meador and Quintina his wife, Hiram Mills, and Tenor his wife, Abram Teel and Lucy his wife, Abram Abshire and Charlotte his wife, William Wright Mary Bowles, George Wright and Julia Wright. The order of Publication awarded against the absent defendants, Gabriel Wright, Martin Wright, Pendleton Wright and John Breedlove against whom the Plaintiff appears to have proceeded in the mode prescribed by law; exhibits and the examination of a witness and was argued by counsel upon consideration whereof the Court doth take the Bill of the plaintiff for confessed as to all the aforesaid defendants who have not answered, and it being suggested by the plaintiff that he has sold the land in the proceedings mentioned to Hay Turnbull, and the said plaintiff desiring that the same may be conveyed to the said Turnbull. The Court doth therefore adjudge order and decree that Thomas S. Greer who is hereby appointed a Commissioner for the purpose, do by a good and sufficient deed with special warranty convey to the said Hay Turnbull the tract of land in the Bill and proceedings and mentioned and that he report therefore to this Court in order to a final decree and liberty is reserved to the absent defendants to show cause against this decree at any time within the time and upon the terms prescribed by law. And as to any other question not settled by this decree This cause is continued until the next Term." On May 17, 1847, at Franklin County, Virginia, Chancery Court Order Book A/ the court entered its further order in the matter: "Polly Wright, widow of George Wright Decd., ) William Wright, John Wright Kitty Wright and ) Plffs and Quintina Wright children of the said ) George Wright Decd. ) against ) Hiram Mills, and Abram Teel Administrators ) with the Will annexed of George Wright Decd. ) the said Hiram Mills and Tenor his wife the ) said Abram Teel and Sucky his wife Luke ) Wright, Gabriel Wright, Martin Wright Ambrose ) Abshire and Charlotte his wife Pendleton ) Wright, Polly Bowles and Martin Bowles, ) Elizabeth Bowles, Tenor Bowles, William ) Bowles Lucy Bowles, Cynthia Bowles and ) Defts. Mary Bowles children of the said Polly Bowles ) and Polly Wright, Quintina Wright, Elliot Wright,) George Wright Catharine Wright and Elizabeth ) Wright, Charlotte Wright and Julia Wright the ) wife and Children of the said George W Wright ) legatees under the will of George Wright Decd. ) This cause this day again came on to be heard on the papers formerly read and the amended report of the Commissioner Thomas S. Greer of the 9' day of May 1846 with the plaintiffs exceptions thereto and they were argued by Counsel, on consideration whereof the Court sustains the first, second, third and the fifth exceptions of the said plaintiff except the sum of $40 in the said fifth exception as items improperly allowed the said Administrators by the said Commissioner in his report aforesaid and overrules the plaintiffs 4' exception and the said Commissioner will reform his account accordingly and report the same. The Court is of opinion that the testator George Wright by his will charges the whole of his estate with the payment of his debts, that the Legacy of the mansion house tract of Land to his wife Polly Wright for life with remainder over to the plaintiff John Wright, William Wright and Quintina Wright and the Legacy of acres of land to the wife and children of George W. Wright are the only special Legacies contained in the said Testators will, that as pecuniary and general Legatees and for want of adequate personal assetts(?) to pay the debts of said Testator the said pecuniary and general Legatees should contribute rateably from their several legacies to pay the same before a should be to the specific Legacies the Court is moreover of opinion that Hiram Mills and Abram Teel Administrators with the will annexed of George Wright Decd have so proceeded to administer the said assetts of their testators estate as to def some of the legatees of the whole amount of the bounty of their testator whilst the legacies of others remain unimpaired, and in order to produce equity among said pecuniary and general Legatees the court will substitute such of them as may be injured by these proceedings in the room and stead of the said creditors for satisfaction, and to that end doth adjudge order and decree that said Commissioner do estimate the value of each pecuniary and general Legacy, that have been by the said administrators for the payment of debts, the amount of rateable contribution from each and still retaining said Legacies to produce equality bringing to and the ballances reported in the hands of said administrators after reforming his said account in conformity with the principles of this decree and report the same to the Court with any matter specially stated deemed pertinent by himself or requested by the Parties to be so stated." On , 1848, at Franklin County, Virginia, Chancery Court Order Book A/ the court entered its further order in the matter: "Polly Wright, widow of George Wright Decd., ) William Wright, John Wright Kitty Wright and ) Plffs and Quintina Wright children of the said ) George Wright Decd. ) against ) Hiram Mills and Abram Teel Administrators ) with the Will annexed of George Wright Decd. ) the said Hiram Mills and Tenor his wife the ) said Abram Teel and Sucky his wife Luke ) Wright, Gabriel Wright, Martin Wright Ambrose ) Abshire and Charlotte his wife Pendleton ) Wright, Polly Bowles and Martin Bowles, ) Elizabeth Bowles, Tenor Bowles, William ) Bowles Lucy Bowles, Cynthia Bowles and ) Defts. Mary Bowles children of the said Polly Bowles ) and Polly Wright, Quintina Wright, Elliot Wright,) George Wright Catharine Wright, Elizabeth ) Wright, Charlotte Wright and Julia Wright the ) wife and children of the said George W Wright ) legatees under the will of George Wright Decd. ) Thomas S. Greer is appointed guardian ad litem of Polly Wright, Quintina Wright Elliott Wright, George Wright, Catharine Wright, Elizabeth Wright, Charlotte Wright and Judith Wright, infant children of George W. Wright to defend their interests in this suit, And therefore the said infants by their said guardian filed their answer to the plaintiff's bill, by leave of the Court, to which the plaintiffs replied generally. It appearing to the court that the defendants Luke Wright,, Gabriel Wright, Martin Wright, Ambrose Abshire, and Charlotte his wife, Pendleton Wright, Polly Bowles Martin Bowles, Elizabeth Bowles, Lucy Bowles, Catharine Bowles and Mary Bowles have been duly served with a subpoena in this suit more than two months, and they still failing to appear, and answer the plaintiff's bill, the same is taken for confessed against the said defendants, And now this cause this day came on to be heard on bills, the answers of the other defendants, the exhibits, the examination of witnesses and the report of Commissioner Greer filed in this suit and it was agreed by counsel, on consideration whereof, the Court not construing the Testator's Will in the proceedings mentioned and defining the rights of the parties under said Will being unable to do so from the insufficiency of said report, doth recommit the same to the said Commissioner with the following special instructions therein, that he do take an account of the administration of the Estate of George Wright Decd. by the defendant Hiram Mills and Abram Teel who are the Administrators with the said Will annexed that he do assertain the amount of assetts that came to their hands not specially devised or bequeathed by said Testator to the parties to this suit if their be any that he assertain the value of all the legacies contained in said Will separately discriminating between real and personal estate, that he do assertain what portion of each legacy contained in said will have been resorted to by the said Administrators to pay the debts of their testator that he assertain what legacies have been paid under said Will as well as those that remain unpaid, that he assertain whether the said Administrators have sold any of the lands of the said testators estate, set apart by him to pay pecuniary legacies and if so to whom sold, the price given and in what manner they have disposed of said purchase money, that he do also assertain whether the debts of the said Testator have been paid, and if not what portion remain unpaid, and the assetts in their hands to meet the same, that he discriminate the amount of assetts derived by said Administrators from debts due said testator from personal chattels, from slaves and land, and also the debts due from said testators estate by simple contract and by specialty and report his proceedings to the court with any matter specially stated deemed pertinant by himself or required by the parties to be so stated and the said Commissioner will be at liberty to examine either of the parties on oath and they are required to attend him for that purpose &c."
