Of course, this is the family of General Joseph Martin, and Brice Martin was either the s/o Joseph or the brother. That is a fascinating family! DECLARATION OFFERED TO THE JUSTICS OF THE COUNTY COURT OF FRANKLIN VIRGINIA BY JAMES YOUNG 13TH DAY OF MARCH 1833 Virginia Franklin County On this 7th day of March 1833 personally appeared in open court before the justices of the County Court of Franklin aforesaid, now sitting (the same being a court of records) James Young a resident in the county aforementioned and State of Virginia aged 77 years, who being first summon according law, doth on his outh make the following declaration in order to obtain the benefit of the act of congress dated June 7th 1832. Tarlton was fought between Williamsburg and Jamestown. He was then marched up to Maupin Hills 15 miles below Richmond and there discharged in the whole a tour of 3 months service. He then returned home and was again drafted into Captain James Terrance Company and marched to Glasgow in Rockingham County, Virginia as a guard to the British prisoners in number 163 taken at the Eatan Springs, September 1781 South Carolina in which service he was six weeks and then discharged. He is not apprised of any person living who can testify at this time as to the whole service contained in this Declaration, that the person who serviced with him are dead or gone, so that he has no knowledge on their place of residence that he has lost the discharges mentioned above but thinks that the evidence of Abednego Hodges will show that he was served as stated. He hereby relinquishes every claim to a pension or annuity except the present and declare this his name is not on the pension roll as the agency of any state. In testimony whereof he hereunto subscribes his name to this his amended declaration the day and year above and first written.     3. Does anyone know the parents of Noah Lee HALE who m. Malinda SNEAD? The couple had numerous children, and many of their names are very familiar to my ear. I'm sure I've heard my parents speak of some of them as kinfolk. The children's names are: sons Curtis, Coy, Roy, Delbert, Amos Coolidge, Denard and Kermit; daughters Mittie (or Mattie?), Mary, Clara, and Ruth. Kermit, of Ferrum, VA, died on August 26, 2007, according to the Roanoke Times online obituary. On FamilySearch.com there is a Noah Lee HALE b. 27 Jan 1885, d. 05 May 1964, son of William Wiley HALE and Mary A HALE. I have William Wiley and Mary A. in my database, he as the son of David HALE and Sally Amanda GIBSON. This David is the son of my 2great-grandparents William N. HALE and Sarah Elizabeth "Betsy" WADE. Any information on parents of the Noah Lee who married Malinda SNEAD would be appreciated.     3. Has anyone recorded the graves in Round Top Cemetery? Round Top Cemetery is probably in both Floyd and Franklin Counties. My husband and I visited the cemetery in June this year, on a misty, damp, gray day, and I'm thankful to Bill Moran for leading the way.down a back country road, over hill and dale, across a creek, a walk past a junkyard, and a really exciting and awkward crawl under a barbed wire fence!!! Never let it be said that Floyd County folk don't go to some trouble to entertain visitors. I've always heard the cemetery referred to as "Round Top" but maybe it's called the Kelley Cemetery or the Jones Cemetery. My 4th-great grandfather, George Washington Kelley, is buried there. I took a few pictures which I'll be glad to share, for the county websites. Many of the stones had been made of slate, and they have been eroded by time and weather. Slate is in layers, and the layers crumble and flake off. Some of the marble stones still have readable engravings. We didn't have time to decipher the ones that were readable, because of the weather and also all of the undergrowth among the trees. Is anyone familiar with this cemetery?     2. SOURCE: The Times of Franklin, Aug 07: 15-Shilling Musket Inflicts Death Court records dated 5 Sep 1791 tell of an inquisition into the death of Wm Webb. The inquiry was held at the home of Theodorick Webb before coroner SWINFIELD HILL. The body was viewed and oaths were given by Joshua Rentfro, Showers Price, Adam Hilton, Wm Eubanks, Bartlet Wade, Poindexter Toney, Jacob Prillaman, Peter Gearhart, Melcher Waggoner, Theodorick Webb Sr, Joel Walker, Enos Miles, Charles Minnnix, Baxter Lee, John Hale, Moses Rentfro "good and lawful men of the County." They were ordered to consider "when, where, how, and in what manner the said Wm Webb came to his death." Their decision seems to be that a musket Webb held in his hands went off, making a single entry wound 4 inches from his right nipple (striking the heart area?) and exiting his back in four pieces. He died about 11 hrs later. Interestingly, the price of the weapon is often mentioned in court proceedings, even when the victim is not named. For instance, you will find the value of a razor used by a man to cut his own throat given in court proceedings published in our latest Killin' book. Here's what the men said, under oath: "On the Main Road near the halfway Spring by accidental Shott by a musket gun of the value of 15 shillings which fired in his own hands from which he the said Wm Webb rec.d a mortal wound about four inches from right nipple which entered his body in one hole and came out near his back in four, of which mortal wound in about the space of 11 hrs he died." The coroner accepted the Jurors' decision and asked them to sign their decision. It was entered into official record by James Callaway at the Oct term of court.

Believ this to be wrong, I believ that the parents of my Jubal Turner was probably, a Richard Turner and wife Rachel Ayers. Jubal Turner and Milly Ross, grew up in SW Virginia, and were the parents of: Whitfield Ross Tuarner, b. 29 Apr 1819, Henry Co., VA d. 11 Apr 1880, in Albia, Monroe Co., Iowa; + 12 Jan 1853, Franklin Co., Martha Jane King, [b. 5 Dec 1830, Lynchburg, Lynchburg Co., VA] Martha Jane King was the daughter of Solomon King and Elizabeth "Betsy" Turner, [d/o George Wilson Turner, and wife Milly Stone] I would very much like to find out more on the parents of this Jubal Turner, who I strongly believe to have been, Richard Turner and Rachel Ayers; [m. 19 Dec 1792, Bedford Co., VA] I know of a John Ayers, who performed many marriages in this area, was she a daughter? When this family emmigrated they stopped for a year in Kentucky, to allow the birth of Whitfield and Martha's second child, Elizabeth K. Turner, b. 6 Oct 1854, KY. The first child of Whitfield Turner,was Amanda Ellen Turner, was born in Franklin Co., VA. she died in Cedar Mines, Monroe Co., IA. Whitfield and Martha's third child was my grandfather, George Whitfield Turner, Sr., b. 6 Feb 1857, Monroe Co., VA. He died in an accedental shooting in OK, while checking out the area, 30 Sep 1895, Shawnee, Pottawatomie Co., OK. He died three months before my father George Whitfield Turner, JR. was born 23 Dec 1895, Appanoose Co., IA.     3. Hi Betty, Thanks so much for answering my query. Your info is similar to what I have but I can't understand why in the 1850 Franklin co census there are no children listed in their household. I can't find Ann and John in the 1860 census. The only John Sigmon I find in Kanawha Co in 1860 is the one with wife Emma. Do you know when John and Ann arrived in Kanawha Co.? Are there any land records available for them that would give a time period? It could solve the question as to who the Ann and John Sigmon are in the 1850 Franklin Co. census. I do have some info that says John and Ann had a son who m. an Emma but the ones in the census are much older than a son of John and Ann. That John Sigmon has his birth year as 1818. Is it a possibility that Ann also went by Emma? I didn't have the burial place for Ann, thank you for that information. I would appreciate any information that you have that you would be willing to share with me regarding John and Ann's children. Ann's sister, Martha Hancock Underwood went to Monroe Co. at the same time as their half-brother, Reuben, and their mother, Frances. After Martha died her husband and children, with the exception of one, are found in Kanawha Co. The lone one went to Fayette Co and lived near Reuben and his children's families. I hope to hear back from you, as I am trying to get Ann's family in my Family tree. Thanks again, Bev

    2. Hi Bev, John, born in 1818, was married twice. First marriage to Ann Hancock on September 30, 1839. Second to Pardine Reese. Ann was born in 1825, died in Sissonville, WV, in 1866. She was buried at the Legg Branch of Tuppers Creek. Pardine was born in 1845, died January 19, 1919, in Elkview, WV. John and Ann had 9 children. Joseph, Sheldon, Adaline, Octavia, Frances, John, Wiley Peter, Thomas and Layfartti. Have moreinfo if you need it.     3. I am researching the Sigmon surname and need some help. A John Sigmon married Ann Hancock in Franklin Co. Sept 30, 1839. Ann was the half-sister to my ancestor, Reuben James. They shared the same mother, Frances James Hancock. I have found John and Ann in the 1850 Franklin Co. census with no children in the household. I was given info several years ago that stated John and Ann went to Kanawha Co., Va/now WV where Ann died. This info showed that John and Ann had several children, some being born before 1850. When in fact the 1850 census shows otherwise. I do find in Kanawha Co. a John Sigmon and a Larkin Sigmon, (I find this man in Franklin Co census) and I am assuming they are brothers. I have not been able to locate John and Ann in the 1860 census, I did, however, find a John Sigmore in Kanawha Co 1860 along with Larkin Signore (error on the surname by the enumerator). This John has a wife named Emma, both would have been born abt. 1818 in Virginia. The problem I have with this couple is that some of their children have the same names that were given to me as being the children of Ann. I am beginning to believe maybe Ann died in Franklin Co and John remarried an Emma. Does anyone have any info on these Sigmons that would be of help to me? I am at a loss on John and Ann Sigmon.
