It appearing to the court that the defendants Luke Wright,, Gabriel Wright, Martin Wright, Ambrose Abshire, and Charlotte his wife, Pendleton Wright, Polly Bowles Martin Bowles, Elizabeth Bowles, Lucy Bowles, Catharine Bowles and Mary Bowles have been duly served with a subpoena in this suit more than two months, and they still failing to appear, and answer the plaintiff's bill, the same is taken for confessed against the said defendants, And now this cause this day came on to be heard on bills, the answers of the other defendants, the exhibits, the examination of witnesses and the report of Commissioner Greer filed in this suit and it was agreed by counsel, on consideration whereof, the Court not construing the Testator's Will in the proceedings mentioned and defining the rights of the parties under said Will being unable to do so from the insufficiency of said report, doth recommit the same to the said Commissioner with the following special instructions therein, that he do take an account of the administration of the Estate of George Wright Decd. by the defendant Hiram Mills and Abram Teel who are the Administrators with the said Will annexed that he do assertain the amount of assetts that came to their hands not specially devised or bequeathed by said Testator to the parties to this suit if their be any that he assertain the value of all the legacies contained in said Will separately discriminating between real and personal estate, that he do assertain what portion of each legacy contained in said will have been resorted to by the said Administrators to pay the debts of their testator that he assertain what legacies have been paid under said Will as well as those that remain unpaid, that he assertain whether the said Administrators have sold any of the lands of the said testators estate, set apart by him to pay pecuniary legacies and if so to whom sold, the price given and in what manner they have disposed of said purchase money, that he do also assertain whether the debts of the said Testator have been paid, and if not what portion remain unpaid, and the assetts in their hands to meet the same, that he discriminate the amount of assetts derived by said Administrators from debts due said testator from personal chattels, from slaves and land, and also the debts due from said testators estate by simple contract and by specialty and report his proceedings to the court with any matter specially stated deemed pertinant by himself or required by the parties to be so stated and the said Commissioner will be at liberty to examine either of the parties on oath and they are required to attend him for that purpose &c." Greer to which there is no exception together with the special statement made at the instance of the Defendants Hiram Mills & Abram Teel the Court approving the said report doth confirm it, and rejects the said special statements, and doth adjudge order and decree that the defendants Hiram Mills and Abram Teel Administrators with the will annexed of George Wright decd. do pay out of the assetts of their Testators estate in their hands to be administered if to be had and if not then out of their own estate to the plaintiffs Polly Wright William Wright, John Wright, Kitty Wright and Paschal Meador and Quintina his wife the sum of $844.78 cents with interest at the rate of six per centum per annum thereon from the 7' day day of October 1847 till paid and the Court doth further adjudge order and decree that the said Polly Wright upon her entering into bond with good and approved security in the penalty of two thousand dollars payable to the said William Wright John Wright, Kitty Wright and Pasca Meador and Quintina his wife conditioned to be discharged by the payment of the sum of $844.78 at the death of the said Polly Wright that she the said Polly shall have the use and Benefit of the said sum of $844.78 for life, that in the event of the said Polly being unable to tender the said bond with security as aforesaid the Court will hereafter provide for her reserving the annual interest on said sum of money and the parties are at liberty to resort to this Court in this suit for that purpose. List, I'm getting frustrated with myself at this point. Please pardon me while I say I goofed again! We do believe Mary Polly Burnett's mother was Nancy Pendleton. I got that right. However, the statement that Pryor Pendleton was the witness of her marriage to John Burnett was wrong: Pryor Pendleton was the witness at Jonathan and Mary Polly Burnett Boyd's marriage. HOWEVER, the two previous censuses in Patrick Co. and Russell Co. do not. They consistently put Joseph in an age category that would show he was born 1780-1790. Since Jonathan was born in 1801, it is more likely that it was not later than 1780. ** Franklin County was formed from Bedford County in 1785. It is unlikely that Joseph was born as late as 1785, since he would have been only 16 years of age at Jonathan's birth in 1801. Hello List, Anyone else researching the Samuel Montgomery and Elizabeth Bowman lines? My daughter-in-law comes from this line and I am researching it for her. I am very happy to share all I gather on the more recent descendants. Samuel Montgomery 1777-1833 married Elizabeth Bowman 1805 Franklin County, Virginia. We are most interested at this point if any of these Montgomery men below have Confederate military records. There are men with these names listed on Virginia muster rolls but I do not know if they are ours. James is a son of Samuel and Elizabeth. Another son of Samuel and Elizabeth was John J. who has a son Abraham Stover Montgomery. Abraham S. Montgomery is listed with the 57th Va Inf. and this might be Abraham Stover Montgomery. James Montgomery and sons Isaac, Samuel and George. Were they with Confederate regiments? Thank you. Donna Schwieder
