First let me say that I think Mike is a very generous person to stop his personal research and spend his time doing look-ups. I did ask for a look up. Second let me say that the person who made the statements about the copyright infringement possibilities was very kind and considerate in how she sated her position. And she was correct in what she stated. Here are the court guidelines on fair use for copyright materials, taken right off of a copyrighted piece of work. And please remember that the internet has a major impact on the availability and sharing of material. 1 PURPOSE AND CHARACTER OF THE USE: If it is for non-profit or educational purposes, it MAY be fair. If it is for commercial gain, to make a profit, it MAY be unfair. 2. NATURE OF THE COPYRIGHTED WORK: to warrant copyright protection, a work must be original and creative enough. 3. AMOUNT AND SUBSTANTIALITY OF THE PORTION USED: The used portion of the work must not be too large compared to the copyrighted work as a whole. 4. EFFECT OF TE USE ON THE COPYRIGHTED WORK: Must not harm the POTENTIAL market for, or value of, the work. WHAT KINDS OF SHARING IS A VIOLATION? * Systematically making reference freely available to more that one person at a time. * Systematically making large parts of the contents freely available to others. * Uploading all or part of the contents onto an electronic bulletin board. * Circulating a printout taken straight from the material. It means in essence when you share large amounts of information it may be illegal. So it could mean a lot of the information with a few persons or lots of small pieces of information with a large group of persons, if it hurts the potential sales then it is deemed infringement. So we can share, I do look ups myself, but I do not put the offer out on the internet to do so. I have shared lookups with a number of persons on this and other lists. But it is on an individual basis. I also tried to be very generous in sharing info once and found out the hard way just what the intent of the law is. TO protect the value and work of the author/publisher and very strict adherence to the copyright laws gave us the guidelines of FAIR USE and that is what the courts look at. Carrie Bias Hoffert
My answer to this is.... put the INFORMATION out there.... It is information, data, and on and on. No one can copyright a person's birth, marriage date, death date, name etc. If it is a history written by someone, then the exact wording of that history may be subject to copyright. But facts are facts, they are not copyright items. It is up to the person or company that claims copyright infringement to prove that their copyright to anything has been breached. Do not be deterred by those who threaten legal action. More often than not it is someone who speaks loudly and carries a very little stick. From one who knows Eric
I understand the hard work that one goes through to compile all of these records, but they are PUBLIC RECORDS copied exactly from the Public Record. Rick Brown, Chillicothe, Ohio
<<When I read the queries, I thought perhaps that an interest in purchasing the book would be the result. I hope so. The statiscal books, such as yours and Kathy's, are invaluable as resources.>> Pat, Very touchy subject here............ From what I've seen on the list lookups and info. I got in the past from this Gettysburg book it is number 1 one my book list. Bev's books were on my list for a long time and I've finally got most of the ones I want. I have bought many books new and used because of lookups such as the ones we had here over the last week or so. Infringement on the copyright.........perhaps, but in my case it will be another sale to me of a very good book in my opinion. Remember this is my own personal opinion and does not speak for anyone but myself. Good Points! I was thinking the same, a good way to advertise a book is through word of mouth, or via a gen list. IMHO!!! Seems free advertisement to me, and those really interested will purchase. Another thought is the message boards. Those book fanatics, like myself, will save and save their pennies to purchase a book such as the ones being discussed on this list. Maybe the word needs to get out and sales will increase not decline. Has anyone considered mentioning these books on the appropriate message boards. Get the word out!!! I am sure those of us who are able will eventually buy. . . buy. . . buy! Also, maybe some industrious individual might create a site that lists the available publications, POD's etc. Even maybe hook up with Barnes and Noble or something like that. Advertisement is a good thing and discussion and mentioning the books authors and titles as reference material is only the beginning. Rhonda Just my view ----- Original Message ----- From: Beverly Thomas <bev25420@msn.com> To: <VAFRANKL-L@rootsweb.com> Sent: Wednesday, August 01, 2001 5:32 PM Subject: [VAFRANKL] Copyright > I have done many look-ups in the past for individuals but in doing so I "always give the author's name and tell them the book is available for purchase". I feel that this is free advertisement for the person who has went to the trouble to gather the info from public records and put into book form for those of us who can't always go to the courthouses to do our research. I also limit the info I give out, telling the individual that there is more but my time is limited, and by doing this they will usually ask where they can purchase the book I know that if I have someone do a look-up for me I ask if the book is available for purchase and by doing this I have over the years acquired a nice little library of my own. > As for books on census, many counties have on their archive websites census records available. More and more public records are being made available via the net. I still like to try to get to a courthouse to get copies of documents to back up my research but sometimes it is not always an option.
