September 25, 2003 Fauquier List: In the 1815 Directory of Virginia Landowners Vol 4 a George Kendall is listed on page 40 as a land owner on Carter's Run. In the Fauquier County Grantee & Grantor index books there is no record of the purchase or sale of property by George Kendall. Can someone point me in the right direction to find out more about how this particular land may have been acquired? Much obliged if you would respond directly, not to List: fflat@att.net

Lease and release: a technical way of avoiding English court fees for transferring land. The possessor of the land would lease it for a year to the person who wanted to buy it. The leaseholder would take possession of the land, and then could purchase the remaining rights to the land through a release. The entire process had the same effect as a sale of land. lease for "lives": in Colonial days the customary time for a lease to be in force was twenty-one years, but at times it was for three "lives." This could be for the lives of any three people: a man, his wife and child, a man and two friends, or any other combination. At the death of the last of the three, the use of the land reverted to the owner. This type of lease usually was not recorded in the local land register. leasehold: land which has been rented. Lease: 1.) to rent; 2.) a legal contract in writing whereby a person conveys a portion of his interest in property to another, in consideration of a certain rent or other recompense; 3.) pasture. Thanks to all who responded to my question regarding the reversion inheritance. I have two documents that speak to this issue....the first is a lease. The second is the release of the lease. One took place one day, the release of the lease the next day. I think from what everyone has said, is that if my ancestor did not fulfill the lease and died, the property would have gone back to the previous owner, not the heirs of my ancestor. However, the next day when he paid off the lease, the property was free and clear to him, his heirs, assigns, etc. One issue I have is that both documents clearly mention two ancestors John and George in the beginning....but only John at the end of the documents when they say that John's heirs, assigns, executors, administrators, etc would have title to the property. George or his heirs are not mentioned at all. Isn't that odd?
