Smith [B standing for where he came from which is Bumberry] The following is information on John B. Smith that was sent to me by Jim Ball, who has researched the Smith lines diligently: "In 1768 John Smith is listed on Armistead Churchill's tithable list for the Center District (Fauquier Co., VA) as overseer of Elizabeth Bumbury's property. This appears to be the same individual known as John Smith of Bumbury (various spellings), and later as John B. Smith. At times he was referred to only as John Smith. The middle initial was apparently adopted to distinguish himself from the numerous other John Smiths living in Fauquier Co. The Bumbury family was an influential family of early King George County, VA. Elizabeth, widow of William Bumbury, resided in St. Paul's Parish in Stafford Co. (to become part of King George Co. in 1776). Her Fauquier lands were on the "upper side" of Licking Run. She seems to have completely divested these lands by 1784, giving them by deed to her nephew, Robert Townsend Dade. It is not clear when John Smith's employment with the Bumbury family ended. In 1778 he is listed on Wm. Pickett's tithable list and he paid the tax that year for Charles Christy. The next individual listed on this 1778 list is Edward Ball whose property is known to have been in the vicinity of the upper areas of Licking Run, near Cedar Run. Also living in this vicinity was the family of Wm. Spicer." So, in answer to your question, the John Smith mentioned in the lease above is possibly (probably?) the John Smith who married Rebecca Spicer, but that's as far as I can go! Sandra

To all, There is a great article in the Giles County Virginia History and Families Book Vol 1 on Daniel Shumate. It said he and his wife Millie left Fauquier County and settled in Rich Creek VA in 1780( which was Greenbrier Co.and now Giles Co.,VA). I believe the Shumate (Shoemate) were the first family to settle in Rich Creek and received a Land Grant of 300 acres of land. He acquiered over a thousand acres of land and owned 7 slaves at his death. He is buried in Sunrise Memorial Gardern at Rich Creek VA. Several families in Giles Co.,VA orginally came from Fauquier Co. VA., including a few that I'm researching. Lois

>From my Shoemaker book on pg. 387 is the following The estate of Michael Watson, deceased, of 96 District (probably Abbeyville County) set aside 8 pounds, 7 shillings, in 1774, for Daniel Shoemate, indentured boy, who had run away. It does not appear that money would have been reserved for an indentured boy run away, unless there was some relationship involved. The "Shumate Family History" would indicate that Daniel Shumate Sr. lived in South Carolina for a period. I couldn't find a Duanna Shumate and here is the list of Shumate's mentioned. Many times a child of fourteen was considered capanle of choosing a guardian but, if the child was under fourteen, a mother alone was many times not considered as a guardian. Many timesa guardian would be appointed by the court until the mother remarried and the stepfather would be appointeed guardian. This is what John K. Gott wrote as his introduction to Guardian Bonds: These abstracts of the guardian bonds of Fauquier County, Virginia (formed from Prince William County in 1759) were compiled from the County records from 1759 to 1871. The bonds for the years 1759 [1760] to 1818 were abstracted from loose bonds and Minute Book entries in the Clerk's Office of the County. The bonds from 1818 to 1871, except for the years 1834 to 1850, are contained in bound volumes now in the Archives Division, Virginia State Library, Richmond, Virginia. These books were printed blank forms which were filled in, then bound together in heavy blue wrappers. The first volume, refered to as Book One in this compilation is marked "1818 to 1822"; however it contains two hand-written bonds, dated 27 and 28 January 1823. The other three volumes, represented in these abstracts as Book Two, Book Three, and Book Four are marked: January 1823 to September 1827; November 1827 to December 1833; and 1850 to 1871. The volume, if one existed, for the years 1834 to 1850 is missing--the abstracts in this compilation for these years were made from the Court Minute Books. The Minute Book entries give less information than the original bonds: there are no securities or witnesses listed and no value of the estate of the ward or wards. The user will note that the guardian was either chosen by the ward or appointed by the Court. This is important to the genealogist because any orphan over the age of 14 years could chose his or her guardian. The Court appointed the guardian for any "infant" under the age of 14 years. The entry in the original bond always read an "infant(s) over 14 years of age" or an "infant(s) under 14 years of age." Occasionally, a parent was appointed guardian of his/her children, probably indicating that they had inherited property or were entitled in some way to property, real or personal. The guardian was required by law to give an account of his ward's estate and the Court audited and recorded such accounts. Frequently, guardianships were revoked by the Court for failing to appropriately administer a ward's estate. Hi List, When I first started doing genealogy, I was taught by reading standard textbooks on genealogy of course, by some of the old timers but, the one that made such an impact on me was the one --- Henings "Statutes at Large for the State of VA" and "Shepards Continuation" (of the same) I may have the exact titles a bit off , But, the point is, they cite the rules and laws by which the citizens of VA (and for many years North Carolina, also) lived. So, if your library does not have these books, or you don't have access to them, that is not good. As chairman for books and resource materials for our genealogical society who supplies all of the genealogy materials in our little library, those were two of the books that I made sure we purchased. Questions just like these are answered... :-) And, to add to Pat's citation, I want to say that if there was no estate (land or slaves) then you won't find a guardian because there was nothing "to guard"... :-( And, sadly in these cases, there was usually an indenture or apprentice records because Mom or Dad could not support or take care of them alone. (and there is another reason for the immediate remarriage of a parent with young children).. And, I say "sadly" with reservations because, it was a good thing, for us, to help find those elusive children. Also, I found that sometimes, there would only be an accounting of the estate funds every two years. Occasionally even more time between reports. And, you won't always find a release of the guardian either, when the child/children comes of age. In fact very rarely ( in NC) My 2 bits worth.. :-!
