Surnames: Pritchartt, Butler, Ford, Jenkins, Allen, Slaves Classification: Deed Message Board URL: http://boards.ancestry.com/mbexec/msg/rw/SBC.2ACI/386 Message Board Post: Deed Book Y2 Fairfax County Page 95-97 At a court continued and held for Fairfax County the 19th day of Nov 1828 William T ALLEN and wife against Lewis PRITCHARTT and Mary PRITCHARTT On a motion of the complainant ship the Court do assign to the infant defendants a guardian liten(?) to defend their interest in the cause the court doth thereupon assign Charles F FORD guardian for the purpose aforesaid and the complainant having filed his bill, and the guardian as litten his answers, and the cause by consent set for decree and by the like amount, coming on this 19th day of November 1828 to be heard, the court upon hearing and considering the same doth draw? order and adjudge that the commissioners herein after named do make an equal division of the slaves in the bill and answer mentioned in three parts, allotting one third part thereof to the complaint William T Allen, one third part thereof the defendant Lewis PRITCHARTT and the remaining third to the defendant Mary PRITCHARTT and that the third allotted to the said Allen be assigned? to him and that the portion allotted to the infant heirs be assigned to W B BUTLER the same of Travis PRITCHARTT deceased ! to be held by him and hired out to the use and comfit of the aid infant children until they have attained the age request for choosing guardians, and it is further decreed and ordered that Elisha Jenkins, William E Beckwith and Alexander Waugh be and they one hereby appointed Commiss to make the division and allotment and that they make report of their proceeding to the court in order to a final decree and continued for report. A Copy - Test W Moss Pursuant to a decree of the county Court of Fairfax requiring it of us the the subscribers have pro ceded to make an equal division of the slaves in said decree mentioned as follows to with. We allot to William T ALLEN and wife, Negroes LUCY and MARIA appraised to Two hundred and Fifty dollars, to Lewis PRITCHARTT, Negroes JANE and SAMPSON appraisement Two hundred and Thirty Dollars and to Mary PRITCHARTT , Negro ELIZA appraisement to Three hundred dollars. This so fin is nearest and equal division in kind that can be made, but not being worthy? so in value, we direct that Mary PRITCHARTT do pay to William T ALLEN and wife the same of Ten dollars and that she pay to Lewis PRITCHARTT the sum of Thirty dollars. Given under our hands this 15th day of Dec 1828. Elisha JENKINS Wm E BECKWITH Alex WAUGH At a Court held for Fairfax County the 15th day of December 1828 William T Allen and Wife against Lewis PRITCHARTT and Mary PRITCHARTT. The persons appointed make an equal division of the slaves in this bill and answer mentioned in three parts, allotting one third part there of to the complainant, William T Allen, one third part thereof to the defendant Lewis PRITCHARTT and the remaining third to the defendant Mary PRITCHARTT and that the third allotted to the said ALLEN is delivered to him, an that the portion allotted to the infant defendants be delivered to W C B Butler the admis of Travis PRITCHARTT deceased to be held by him and hired out to the use and comfit of the said infant children until they have attained the age required for choosing guardians.
