    3. Dear Family Researcher - I am trying to make a long story short and ask for your help in postponing the rezoning on a family cemetery in Fairfax County VA. If this rezoning precedes it will be a major step in allowing a builder/developer to absorb this cemetery (about ¾ acre) into a new housing development (11.04 acres) while there are unresolved legal issues. The cemetery in question was established or 'set aside' in a will of Archibald Hall in 1836 and does include graves. The families associated with this cemetery include - HALL, SUTHERLAND, DEAVERS, BEACH, LUDLOW, TAYLOR, and more There is a current lawsuit filed in Fairfax County claiming that the ruling regarding the legal ownership issue of this cemetery needs to be revisited and that fraud was involved in a previous "quiet title suit". However, pleas to the members Fairfax Board of Supervisors are being rebuffed - (I am just a single vote and am hoping more 'voices' will be heard). We're not asking the Board of Supervisors to make a legal ruling on this matter - only asking them to postpone or delay the vote on rezoning the cemetery property until the legal ownership question is resolved in the court system. I feel the Public Hearing on RZ 2005-MV-001 currently scheduled to be heard on Monday, June 26th, 2006 at 5 p.m. SHOULD BE POSTPONED, allowing the current court action to proceed until the ownership of the cemetery, included in this rezoning application, is legally resolved.
