Pat Is there a Fred Wilkins and a William Higgins listed? Daryle
Let me jump in here and explain the term "implied" marriages. The minister's returns for early marriages (pre 1853/54) in Fairfax County are no longer extant. As a way to determine the names of people who were married, archives Connie Ring read orders, wills, deeds, chancery papers, and misc. things filed in Drawer X (kinds of an original name, wouldn't you say?). From these documents, Connie extrapolated assumed marriages. As an example, when David Dogood devised to his daughter Priscilla Purple in his will, one can imply that Priscilla was married to a man with the surname Purple. In Peter Purple's pension application, if his wife's given name was Priscilla, there is a fairly good chance that Peter Purple was married to Priscilla Dogood. I found a wonderful implied marriage that is not recorded in Loudoun (where we have early ministers returns). These names are In a subpoena in a chancery file, Exr of George Gregg v. Abraham Dawson & Timothy Hixon, 1813-004. "We command you to summon Amos Dawson, John Palmer and Elizabeth his wife and William Dawson heirs of Abraham Dawson deceased." Now, because I'm an old school teacher who can't give away answers, you tell me the maiden name of John Palmer's wife.... Hi Pat, Are there any Talbott/Talbot listings in the Implied Marriages book? My Talbotts may have been there pre 1770's at which time they moved to Washington Co. VA. then to Cumberland Co. Ky around 1799. The first one I am absolutely positive was Nicholas (different from Nicholas Reagan who went to Bourbon County, Ky.) Talbott born around 1755-1760. Not sure it was in Fairfax Co, although some resources say so. There are several Talbert/Talbot/Talbott/Talbutt/ Tallbutt/Tolbert entries over various time periods, but no Nicholas. Hi, Pat. I would be very interested to learn if a John Walker (ho ho ho) is mentioned between the formation of Fairfax County and 1757, the formation of Loudoun County. The following explanation is from the Introduction in "Index to Loudoun County Virginia Chancery Suits 1759-1915" by Hiatt and Scott: When a Virginia citizen had a complaint which did not involve violation of law, the matter was presented to the Chancery Court. The suit was heard and settled by a judge. Papers in a chancery file should include the bill of complaint, brought by the plaintiff (orator) and naming the defendant, the decree, or final settlement, and might include supporting documents, subpoenas, and depositions. Chancery was the court in which to settle disputes-over ownership of land, slaves, livestock, a business, or any other issue about which men could argue. If a worker was not paid for his services, or a store keeper not paid for his merchandise, the suit would go to chancery. There are numerous suits for payment of debt. Intestate estates were often settled by the chancery court. These files might be the only place to find a list of heirs when a man who owned property died without a will. If there was a question over which part of the land should be set aside for the widow, it was decided in chancery. If some of the heirs decided it was time to sell their inheritance, they would take their complaint to chancery to force a sale of the property. When children had a complaint against their guardian, or wanted to establish their legal independent status, they took their cases to chancery. I, too, own a copy of "Implied Marriages of Fairfax Co, Va" by Hiatt and Scott, which was published in 1994. Some of the Fairfax Co. records no long exist, including early marriage bonds and minister's returns. Deeds, wills, pension applications, chancery suits, court minutes, and newspaper notices were used to compile this book. These records begin in 1742, when Fairfax Co. was created, although here too some records were lost in a courthouse fire. Some records used in this book extend into the early 1900's. The only TUNNELL entries are: Tunnell, ___ & Keziah Money, dau. of Nicholas Money [Will Book G1:434-5] Tunnell, James of Hawkins Co., TN & Jane Ball, dau. of Moses Ball [Deed Book C3:47] On the Fairfax Co. Personal Property Tax Lists from 1782-1822 a Tunnell appears on the 1782 and 1783 lists, and those entries are for William. Several Gunnells, including a William, appear on the lists during this time period. We knew part of Howard's family lived there, but weren't sure who. My mother (Sara Neitzey Elliott) and your grandfather Howard were pretty close growing up. She has a letter he sent her after he went into the military, and we have a photo of him in his uniform (those standard head shots the military does). I'd love to share and compare information with you. There are LOTS of Neitzeys--I've got info back to 1831, but I'm not sure how many there are. At that time the name was Neitz. It changed to Neitzey sometime around 1870. Photos would be great! I have one of Uncle Chris at Mount Vernon, but it's a little grainy. Have lots of my granddad (Wilfred) and a couple good ones of Maurice. E-mail me at Wolfden777@msn.com and we can try sharing electronically. If that doesn't work (I live in the mountains and still use dial-up), there's always U S Mail.
