My mother and I faced a very similar problem in Delaware. Because of DE laws regarding graveyards, the developer was forced to protect the graveyard by sectioning it off, provide access to and from, gate the graveyard (wrought iron) and reduce the number of homes they wanted to place on the land. (We put up a headstone identifying the plot.) Doesn't Virginia have laws that protect graveyards? Or perhaps there is a statute concerning archeology that may help. VA does have laws, that is why so many graves are bulldozed before anyone knows. I was horrified when I heard this but I sort of understand that when people find signs of graves they don't want to lose control if they want to develop, but that is only sort of.
