I suspect that a family cemetary continues to belong to the family and probably descends to the heirs at law, maybe to the testate devisees. Whoever has the adjoining land has probably taken it subject to a reserved right in the family as to the cemetary. After some time, one will have a hard time identifying the true owners as the interests will be very fractionalized. In short, if you can show your link to the persons buried there, you have probably established more right to being on the land than any one else can at the present time. If you were to put a suitable stone in the plot, who would complain (especialy if you do so politely)? Now, if I may, some questions for you. 1. Who are these Wares? I descend from Sarah Ware (born 1765) who married John Smith. Her home is put as "Mt. Moriah Church" which is just South of Indian Creek. I copy the part of the Ware tree that I know below. If this plot is of this Ware family, I'd love to know the location. 2. Do you know of any other family cemetaries in this area of Amherst? I search for the Sandidge burying ground in particular. I am also interested in finding the Lee cemetary on the East slope of Tobacco Row Mountain, near Hicks' Store. Title to that plot was in fact reserved to the grantor in a deed conveying the associated land when it was sold in the late 1800's (so I should be able to find it with a title search but am being lazy at the moment). The marriage bond of James Nowlen and Susannah Wright was dated on January 15, 1793, at Amherst County, Virginia, with the consent signed by her father Isaac Wright. That Isaac was 1807 (year of death) Isaac Wright of Amherst County, Virginia, (place of death), the son of 1767 Francis Wright of Amherst County, Virginia, and Mary (Hawkins) Wright. The will of Isaac Wright was dated February 17, 1803, and probated on September 21, 1807, at Amherst County, Virginia, W.B. 4/465 and listed Susanna Nowlin as a beneficiary. A Memorandum of the Ellis Family by Thomas H. Ellis and written in 1849 stated that Susanna Wright was a daughter of Isaac Wright and Susannah (Ellis) Wright, married James Nowlin, and emigrated to Ohio. This indicates that the Susan Nowlin of Bedford County was a different person from Susannah (Wright) Nowlin. I would be happy to exchange information on this family with other interested researchers. Good Evening This is true the book was published in 1999 but the important point is the data was not all updated to 1999. As an example the Mead Cemetery in Madison Heights was entered with data as of 1933. There is a small WARE family cemetery on Indian Creek. I would like to have a "group'" stone put up with all known names and dates as has been done with other small cemeteries in the county. .Anyone had any experience with this sort of thing?. Any advice appreciated. Joe Ware

The Amherst County Museum and Historicl Society published a book in 1999 called "Gravestone Inscriptions in Amherst County Virginia."
