While it is true that orphaned children without funds were often apprenticed, that is not always the case. On other occasions, male relatives stepped up and assumed responsibility. There are numerous cases of Uncles and Grandfathers becoming guardians, money or not. Dear James I'm back in my California home and have the records we discussed. I feel confident that William Arrington & Catherine Stone were Richard's parents because of a will their grandmother (Catherine's mother) wrote leaving land to Richard and if he died the land was to go to his brother, John. I found records showing John later sold the land after Richard's death. This was an interesting family. It appears, based on various wills, that Richard Arrington first married Nancy Griffin d/o John Griffin and they had a child, Richard. While Nancy was still living, Richard married Catherine Carter December 26, 1786. I found no divorce records so I'm not sure how this happened, but in a will John Griffin refers to his daughter, Nancy, as Nancy Arrington and to Richard as his grandson. In 1790 Richard died intestate. Petition was brought against Catherine Carter Arrington, Richard's wife at date of death, on behalf of Richard's orphans, Lucy M. and Richard. As a result, on December 21, 1791, Catherine Carter Arrington deeded 240 acres to Lucy M. and Richard as follows: Page 380, Deed Book #15. 240 acres Land 21th day of Dec. 1791, between Catherine Arrington of Halifax County of one part and Lucy M. Arrington and Richard Arrington, orphans of Richard Arrington, deceased of the aforesaid county of the other part witnesseth that the said Caterine Arrington hath for divers reasons and good causes and tender consideration and for the sum of 5 shillings specie received of Gregory Baynham as friend in behalf of the said Lucy and Richard Arrington they neighbor (?) children hath by these presents given released and confirmed unto the said Lucy and Richard Arrington all the tract piece or parcel of land lying ____ ____ in the county of Halifax between Hico and Aarons Creek whereof the Catherine Arrington now lives containing by estimate 240 acres be the same more or less and bounded by Wallace Wilison line on the road running along his line to Garlands old line thence along his line to Morrises Creek down Creek to a blazed oak thence along blazed line to Wooding's line thence along his line to a corner oak Baynham line along his line to the road thence up the road to the beginning to have and to hold the said 240 acres of land unto the said Lucy and Richard Arrington to their heirs and assign forever the Catherine Arrington for herself her heirs exrs. and administrator doth convenant and grant to with Lucy and Richard they their heirs. I could not determine if Lucy was Nancy's child or Catherine's child. However, since Catherine's mother was named Lucy it appears Lucy may be the child of Catherine and Richard. At any rate, about a year after Richard's death (December 1791), the same date she deeded the property to Richard's children, Catherine married the attorney Abner Farrar. They moved to Georgia where Catherine died in 1832. Another interesting entry on March 25, 1817 in the Deed Book 26, p. 383 reveals Richard S. Arrington and John F. Robin and wife Lucy sold 240 acres on Morris Creek to John Ingram by attorney Mr. Farrar. It's amazing how everyone was interrelated or related. I know more about North Carolina law than Virginia, but NC law echoed VA law a great deal. And I think the handling of the situation was pretty universal. From my research, guardians were only appointed in court when there was an inheritance at stake, and the issue was not resolved in a last will and testament. A minor child would need someone to handle business affairs for that inheritance until he or she was capable of taking over management of their own inheritance. I descend from the Madison family, and my ancestors (in Virginia) were given guardians to handle their inheritance until they were old enough to take over their affairs. I believe that, at the age of 14, a child could also choose his or her own guardian, so the issue of whether the child's preference was consulted can also give you a clue or additional proof as to age of the child. A child could hold and even buy land before the age of majority, but generally an individual could only sell land at age 21. These matters should be in the court documents of the appropriate county. The specific instance in my family was in the court order book of Lunenburg County in 1757. Laws do change over time, but I doubt that form of the law changed much between the 1700's and the 1800's. The James Hall of the will was a son of Instance Hall of Amelia Co, I believe. The son, Benjamin Hall, died in North Carolina about 14 years later. James' wife was Ruth Evans.The children of Instance Hall and wife Mary Wilson were : James, Judith, Instant, John, Frances, George and William H. Several of the grandchildren of James and Ruth Hall went to live in Halifax county.
