Good Morning Everyone, I have a legal question about the status of a possibly illegitimate child, Davenport Kennedy, in future litigation of an estate governed by his possible father, Charles Kennedy, will written in 1783 and probated in Hanover Co. The child in question is not named in the will, but neither is one of the legitimate children who is later mentioned in a brother's will, and who is included as a child in a later chancery court dispute of Charles Kennedy's children over the division of the increase of a slave who was willed to a daughter who died without issue. The reading of the will is that "all the rest of my estate" is to be divided amongst "all my surviving children". There is no qualifying clause in the will after children such as "herein named", or a list of them. My question(s) is would an illegitimate child be included in the definition of "all my surviving children" in a will even if not named? Would he or she have any rights in a later chancery court case? Would it have made any difference if there had been some sort of court acknowledgement, or a bastardy case? Obviously we are trying to figure out if Davenport Kennedy is a son of Charles Kennedy. He could be a brother, and he died with many heirs, also not involved in the chancery case. Unfortunately, alot of their records would have been in burned Hanover Co., but fortunately the chancery case was in Louisa Co., and the will was part of the case file. As Paul Drake reminds me, I should have added this: Levina Cole, born in Virginia (according to the 1850 census of Warren County, Ohio), married (1) Alexander Anderson; and (2) Thomas M. Lind (m. 1824) in Warren County, Ohio. Levina's brothers were Isaac T. Cole (married Anna Wintrow/Winterroad, family from York Co. PA) and Daniel (Danne) Cole. I have a letter that Isaac T. The people that are on a time line are important, but what is more Important is it will show Two Things, you can now use the Tithable list to pinpoint Certain Groups of People, Like take Mackness Goode ( earliests deeds on this Creek) find him on the Tithable List and what County he is in an out of:::: Look for others Around Him are there any Johnsons::: Now if there are we now know what County to look for Deeds in::: WE can know bring Mackness Goode Forward into the Next Tithable list looking at each list Mackness Goode is on::: then check next list around him mark it on the Tithable List where he was. Go down to the Next entry say Henry May 1760, find him on the Tithable List check the people out around him okay we find a Johnson, we now know what County to Look for a Johnson Deed in and we Know what time era that Johnston or Johnson came to that Creek:: FInd the Deeds and find the Wills. The time line will also Show when a County took over this part of Virginia. and you can now look at that Counties records for Johnson-Johnston deeds and Wills. during this tim period. I know nothing of the Perrins earlier than Richard, apparently first Perrin in VA. As an aside, Katherine (Banks) Royall married (2) Capt. Henry Isham after the death of Joseph Royall. Through her second marriage she was ancestor of both Martha (Wayles) Skelton and Sally Hemings and the children of Thomas Jefferson. I have ancestor, Francis Edmunds and wife, Rachel, who were In Halifax Co. from at least 1768 until 1784, when he sold 260 acres more or less to Henry King of Amelia Co. To the extent I can determine, Edmunds was on Walter Cole's 1768 Poll List and on Col. Robert Wooding's 1768 Poll List also. He is listed twice on Isaac Cole's Poll Lists in 1769. Does this indicate that there are two parcels of land involved? I do not have the description of the land, but I should like to know how I might find it. He was compensated under Public Claims for driving beeves and for a "smooth bor'd. gun" after the Revolution. When he and his family removed to bounty land in Wilkes Co., GA in 1784, a daughter, Nancy, and her husband, William Milner, with son, John, remained in Halifax. William Milner was still living in Halifax in 1824, when he sued on his wife's behalf for her portion of the estate of Rachel Edmonds who died testate in Jasper Co., GA, 1824. Francis Edmonds died testate between 1795 and 1799 in Wilkes Co., GA. Nancy was not mentioned in the Will of Rachel Edmonds. Is there anyone on the list who is connected to either the Edmonds/Edmunds or Milner families of Halifax during this time period? I have no proof, but it is possible that Francis was a descendant of the Edmonds/Edmunds family of Lancaster Co., VA or Calvert Co., MD. A Francis Edmonds is listed as having fought in Company of Foot of Captain Edw:d Gant (not dated) in the colonial militia from Calvert Co., MD in COLONIAL SOLDIERS OF THE SOUTH, 1732-1774, by Murtie June Clark, 1983, Genealogical Pubishing. The word "waterman" has and will for yet a few more generation had several meaning. As I suggest in my dictionary, "What Did They Mean By That?", the terms used to reveal many, many of our thoughts have evolved across the centuries to a point where our ancestors might not recognize those words. A word means what we think it does depending upon when and where we speak. Thus, there ain't no such animal as a "true definition." We should always remember the words of Mr. Justice Holmes: "A word is not a crystal, transparent and unchanging. It is, rather, the skin of a living thought, and its meaning may vary greatly with the time and the context in which it is found. "

Dear List, I am seeking a deed record that shows Lewis Williams living on the land that belonged to William Williams of Brunswick Co. ( Wm. Williams b. 1704 Va. d.1773 Brunswick Co. Va.) This land could be the land mentioned in Lunenburg Co. Deed Book 4 where it mentions Matthew Williams 258 acres that was part of William's patent -- the south side of Long Branch up a small branch to Great Branch and corner of Lazs. Hello Everyone, Were young, single widows, who were heads of households charged a tithe or poll tax (not the property/land tax) in the 1700s in Virginia? I seem to remember that they were exempt. On another list a researcher said that in Maryland, in the 1770s at least, they were counted and taxed just like a male head of household. Thanks in advance, Janet (Baugh) Hunter
