The child must reside with the new parents for 6 months before the adoption can be finalized. Once the adoption is finalized, a request for a new birth certificate is made. However, before the adoption takes place, the only birth certificate that exists is the one containing the biological parents info. I used to practice family law and handled a number of adotions. Now that I strictly practice criminal law, I don't keep up with the current changes in family law. However, I've handled private adoptions where both sets of parents met and knew each other, and the biological parents themselves gave the adoptee parents a birth certificate. Once the adoption is final, however, the adoption proceedings, etc. are sealed.
