Patti Thomas parft@marionco.net The State of Texas County of San Augustine In the name of God Amen I Cordelia Frances Dean of afore said state shall being of sound and of deposing mind and memory, do on this 6th Day of August A.D. 1859 make const__?__ and ordain this my Last Will and Testament having __?__ing all others heretofore made by me. First I give and bequeath to my dear husband OHP Dean all my property real and personal during his natural life or during the minority of my children. That is to say at majority of John and Calloway (twins) they are each of them to receive 1/6 part of my estate and at my daughter Dora’s majority or marriage she is to receive 1/6 part of said estate. So as to give my said children ½ of my estate – the other half of my estate I give my husband OHP Deen during his natural life thereby descend to my three children John Dean, Jr, Calloway Dean, Jr, and Dora Dean-children of my body. The property above bequeathed consists of: 1 league of land headright of my father Samuel Love situated in Matagorda County on the Peninsula. Four hundred acres of land also in Matagorda County on Live Oak Bayou part of the headright one farm lot on the Peninsula in Matagorda County together such all of the following Slaves,__(tou?)__ Jenny a fine slave about Sixty yea! rs of age, Jack a man about fifty four years old and Charley a man about thirty five years of age. Then 2nd It is my will and desire that my executor shall exchange or sell my negro man Charley and purchase or get in law of him a negro woman to assist him in the raising of my children. Then 3rd It is my will and desire that my executor should sell any portion of the land abovementioned that may be necessary to pay off and discharge all of the debts that my husband OHP Deen and myself may be ___?__ing. I __(?further)_ authorize my executor of necessary to sell a portion of the above lands to assist in the education and rearing of my children. Then 4th I hereby appoint my dear husband, OHP Dean Executor of this my last will and testament. Then 5th It is my will and desire that the Probate is County Court shall have no control of my property except that my executor shall assess and Inventory of my said property and Probate this my last will __?__ and that my executor shall not be required to give any bond & security whatever. ___?____ whereof I heretofore sign my name and scribe for seal this the Sixth (6th) day of August A.D. 1859. Deen declared by him on the 6th day of August A.D. 1859 that they sign the said will as witnesses. In the presence of the said Cordelia F. Deen who signed the same in their presence and that the said Cordelia Frances Deen at the time of signing said last will was of sound and deposing mind and memory, and requested them The said B F Sharpe Jno C Love to become subscribing witnesses to the same and that the said will has not been altered or changed since the same was made proper and acknowledged by the said Cordelia F Deen.
