Delayed birth certificates are obtained by witnesses who know the person and must have personal knowledge. Sometimes this is done because no originial certificate was ever filed, or because the county courthouse had burned, etc. Our aunt was born in Johnston County, Okla. but received a delayed certificate in Dallas County....which is different than the City of Dallas....so anyone who looks in Okla. for a birth certificate won't find one even though that's where all of the kids were born. The only reason we found it was because we were at the county courthouse researching other lines. Best wishes, Jo

Even though birth records were "required" after 1903 more than a few counties didn't enforce it. Not until the 1920s or so do you find this practice widespread.

[email protected] asked about birth certificates in the 1880's: Texas did not require registration of births until 1903. Even then, some counties were very lax about doing so. <Or does filing a delayed certificate indicate no one from the family reported the births?> A delayed birth certificate means that the birth wasn't recorded at or near the time of birth. It was filed later and it required some proof. Much of the time a parent or sibling went to the courthouse with the party in question and made an affidavit stating the date and place of birth and the name of at least one parent. Sometimes the applicant was looked up in the census and that was proof. Family Bibles and baptismal records were also used. The big impetus for obtaining a delayed birth certificates was getting a Social Security card. <How do I retrieve a copy of the birth certificates? Cost?> Do a Google search for the Texas Department of Vital Records in Austin. Their website has all the details, including the privacy restrictions. I noticed a few years gap in the marriage records and guessed that was due to fire or civil war. Or does filing a delayed certificate indicate no one from the family reported the births? For some time, I have been on a search for a picture of my ggrandfather, James Davis Grant, who married Sarah Elizabeth Talley. They moved from Maury County, TN about 1840 and eventually settled in Robertson County, TX in 1852. As it turned out, he was in the 16th and 17th Legislative Session (1879-81) of the Texas Legislature. On a chance there might have been photos of the legislators, I wrote the Texas Historical Society, which referred me to the Texas Preservation Board. They thought they had copies of legislators from that period, but quickly found that the images were destroyed by a fire at the capitol in 1881. I persisted and inquired about the possibility of another entity of government having a copy. They found one and referred me to the Austin History Center. The short to the long story is that I have ordered a composite picture from the 17th Legislative Session that has James Davis Grant's picture and his name below the image. So, if any of you are seeking photos of people in your family who might have been in the state legislature, for sure in Texas, you might want to pursue such routes. You are essentially in the same situation as me. I have been searching for men from my ancestor's company and from all of Likens' 35th Texas Cavalry who received pensions because since no rosters exist, those veterans who applied for pension had to have witnesses swear to their service. If you can give me some time, I will look for any pensions from men in Company "B" and see if your ancestor is listed. Sadly, the Texas Pensions INDEX only lists the names and counties of the pensioners, not their units. I have researched Likens' 35 Texas Cavalry for a number of years and discovered from pensions and diaries a number of mistakes made by authors who have just taken a passing interest in this hard fighting unit. Best wishes William Bozic Descendant of Isaac Bodine Ellison, Company "E" Likens' Mounted Infantry (AKA 35th Texas Cavalry) PS. There was another 35th Texas Cavalry commanded by Ruben Brown.
