Hernandez was not wearing his seatbelt, investigating officer, Trooper David Yarborough, Department of Public Safety, said was he was ejected from the Ford in the collision. "He would have most likely survived had he been wearing a seatbelt," Yarborough added. The Ford's cabin roof had to be cut off by emergency crews with the "jaws of life" to free Bazaldua. After he was freed, he was flown by Scott & White's Stat Air helicopter to the hospital. According to the accident report, Bazaldua was driving the Ford on the shoulder of SH 36 and then attempted to turn left onto CR 111 in front of the gravel truck driven by Eddie Arnold, 46, of Holland. Holland swerved his tractor-trailer into the eastbound lane in attempt to avoid hitting the Ford, but caught the driver's-side bed of the pick-up with the semi's front right corner. Yarborough said Hernandez was ejected when the pick-up was pushed around the front of the gravel truck. Arnold's gravel truck stopped on the eastbound shoulder and the trailer spilled over onto the Ford which stopped in the ditch beside SH 36 facing Buckholts. Arnold refused medical treatment at the scene. Bazaldua was cited for an unsafe lane change. Yarborough said fatigue on Bazaldua's part could have been at fault for the accident. The Rogers Police Department was the first on the scene and were later joined by DPS Sergeant Rick Bryant and troopers Yarborough and Broderick Sims. Also responding were the Milam County Sheriff's Office, both Buckholts and Cameron volunteer fire departments, and Scott & White and American Medical Response EMS crews.
