I am seeking proof that Elizabeth Davis b. 1807 GA was the mother of Malinda Davis Kelly/Kelley b. abt 1828; GA m. abt 1846 TX; spouse of Malinda was Daniel Kelly b. abt 1823 GA. A researcher (James Davis) said that according to his ggrandfather, James Riley Davis, he lived in Ware Co., GA in 1827. He had 2 sisters b. in Ware Co. and his mother was Elizabeth Davis. They came to TX in 1836 and Elizabeth got a land grant in Jasper, TX I found a land patent # 64 for Eliz. dated 12/02/1841. The 1850 census for Jasper shows Elizabeth as head of household with James age 22 b. in GA (1828) Does anyone have a copy of a will for Elizabeth or for Daniel Kelly ? Nita Your answer is in Jasper County District Clerk's Office Probate Book F page 445. This is the estate settlement of Elizabeth Kelley. (She had married Elisha Kelley in Jasper County on 8 May 1851.) It begins: "In the Estate of Elizabeth Kelley deceased, and now comes James R. Davis, M.C.Kelley & her husband Daniel Kelley & Martha Wagnor who are the legal heirs of said Deceased..." Later it specifically identifies "Malinda C Kelley & her husband Daniel Kelly". It gives a complete inventory of her estate and the 4-way division of it, including the 1280 acres of land. The last deed regarding Dan Kelley's property (7 Jan 1903) is in Deed Book W, page 312, Jasper County Clerk's Office. Daniel gives to George Kelley for $1.00 "...and for the love and affection I have for my son George Kelley and his heirs for the further consideration that my son George Kelley is to take care of me during my natural life have granted, sold & etc" my 1/2 interest in D. Kelley preemption of 20 Oct 1887 No. 193, v. 46. Malinda was not mentioned. The Ware Co,GA connection is from James Riley Davis' Confederate pension application of 31 Aug 1911 (Texas State Archives, Austin). He states that he was born in "Wear Co., Georga" [sic] and has resided in Texas "Since Dec. 28, 1836". How are you connected to this clan?
