My friends - As we all continue to watch the horrific scenes from the New Orleans and adjoining areas, and express our thanks that rescue and recovery now seems to be progressing at a much more rapid pace, we might pause - for a brief moment - in our thoughts and wonder about what has happened to the historical and genealogical records of that area, especially those in New Orleans, which has a rich and varied past. Just as an FYI, I am passing along the following piece which appeared yesterday in the "Washington Post". It has been making the rounds of some lists, so if you have seen it before, please delete. But it is good to know that once the living have been rescued and order restored, part of the activity to follow that will be efforts at saving the valuable records of the area. One area which has not been covered well by the news media has been the cemetery situation in New Orleans. As many of you know, most burials in that area are above ground, since digging down only a dozen feet or so will strike water. One of the national newspapers(I believe it was the Wall Street Journal)reported a day or two ago that many of the mausoleums and aboveground crypts in that area had been disturbed or destroyed and that opened, ruined caskets and loose bodies were numerous in and around these cemeteries. The cemetery directors are doing everything possible to insure that the bodies are located, identified and reinterred in a dignified manner as soon as rebuilding has been done. In one case, in which the cemetery office itself had been destroyed, the cemetery manager set up a tent and, with a shotgun handy, stayed all night to protect the dead if necessary. Interestingly, the below ground burials(these are apparently on somewhat higher ground)fared better than the above ground interments. Let us pray that we shall never again see such a heartrending disaster as this hurricane as wrought. -B ===================================================================== THE WASHINGTON POST: Park Service Team Set to Rescue Years of Artifacts By Petula Dvorak Their bags are packed with safety glasses, gloves, masks, boots and suits. As soon as they hit the ground in New Orleans, they plan to set up triage tents and long tables. Then the emergency team from the National Park Service will begin its work: blotting, washing, drying, straightening and preserving centuries of historical artifacts that tell the story of one of the oldest U.S. cities. The curators, archaeologists and historians of the Park Service's Museum Resource Center are not the bookish types who dwell in dusty stacks. These are people who are trained in outdoor survival skills, are immunized against disaster area diseases, have helicoptered in and out of work sites and know how to identify poisonous snakes and spiders, said Pam West, director of the center. Their biggest enemy is mildew. "When we do retrieved artifacts, we're dealing in extreme mold," West said. "Anytime 48 hours pass, you get mold. You have to fight mold. We've seen it turn the most amazing colors -- bubble-gum pink once." The preservationists dried and blotted a million artifacts from colonial Jamestown in Virginia after Hurricane Isabel hit in 2003. Last year, they used boats to get to 300,000 artifacts in the Fort Pickens museum near Pensacola, Fla., after Hurricane Ivan. Once it gets the all-clear in the coming days, the preservation team will head to the Crescent City to retrieve documents, photographs, furniture and other pieces of history that have marked the rich life of a city founded in 1718 and occupied by the French, Spanish, Creoles, Americans, Confederates, fire, disease and water -- again and again. There are photographs and musical instruments in the Park Service's jazz museum, musical scores in Louis Armstrong's home, archives at the Jean Lafitte National Historical Park and Preserve museum and the Chalmette Battlefield and National Cemetery, all floating in swampy, oily, polluted water. Once the artifacts are pulled from the water, Park Service specialists can begin the work: laying out, sorting, stretching, drying. "Papers can be freeze-dried. Photos, furniture and furnishings can be washed and dried," West said. Sometimes, they can clean objects and transport them for restoration at a better facility. But as is often the case in hurricane situations -- where humans, let alone objects can't get transportation, refrigeration or water -- curators have to work in less-than-ideal conditions. "I saw someone preserve a 20-by-20 photo right there on the spot once. They knew how to dry and blot and straighten it right there, in the middle of camp," West said. I have two articles from the Dallas Morning News (11 Dec 1917 & 26 Feb 1918) that report the death of Henderson County Constable James W HOPSON on 10 Dec 1917 & wounding of Sheriff W O WILLIAMS while attempting to arrest George DAVIS (a black male). DAVIS was convicted and sentenced to life in prison. I would like to know where Constable HOPSON is buried, whether he has a tombstone or marker, date of birth, when elected constable, which precinct, family history or living relatives, and any related information. The newspaper article indicated he was not married and left an aged mother.

First, when an adoption is consumated in Texas, the original birth certificate is "canned" so to speak and the surname of the child is changed to reflect the adoptive name on the birth certificate as of the date of birth. Only by court order can the original name be discovered. Second, Several years ago the Smith County County Clerk told me that for reasons she was not sure of, the delayed certificates of birth index or the amended or corrected birth certificates were never forwarded to the BVS in Austin. For grins or whatever I copied twenty names with dates of birth and parents from the delayed filings in the Clerk's office and checked for those names on the list sent to BVS from Smith Co. [Before the lockdown, discussed below] None of them appeared on the BVS list. I have checked for a couple of them on the Texas Birth Index as it now appears and they are not there either. Somewhere in my files I still have the list of twenty and will check again when I locate the list. Back then I talked to some lady with BVS in Austin and she told me in effect "we only have what the counties send us". She had no other explanation why the delayed certificates where not on file in Austin. The local County Clerk had no explanation why the delayed certificates were not forwarded to BVS. Now, of course, since the State has lumped serious genealogists into the same category with identify thieves the County Clerks have essentially locked up the birth and death certificates and thrown away the key. And they give anyone the right to call BVS to get "unbirthed" and remove their name from the published list. Obviously, it is with bitter resentment that I am classified as a potential identify thief. Having practiced law in Smith County and surrounding counties for 40 years as of September 10, 2005, and having worked on my family genealogy for almost as long, needless to say I am more than aggravated that I can't look at birth certificates newer than 75 years old or death certificates newer than 50 years old. I would be more than glad to furnish a bond, mugshot, fingerprints or whatever might be required to be able to access those records. I don't give a hoot about someone else's bank account or credit cards but the powers that be in Austin think otherwise. ! At one time I drafted some proposals to rectify this situation --another item filed away I will locate. In the meantime if you or anyone else on the list have some ideas I would welcome them. A couple of items I might mention. My own birth cerfiticate - which was not delayed - appears in Smith Co but not in the Texas Birth Index nor on the list of Smith Co births forwarded to the BVS although I am listed in the Smith Co birth index in the Clerk's office. Years ago I obtained a certified copy from Smith Co and made any number of inquires of BVS. Not there and they have no explanation. If my name appeared and I wanted it removed that would be easy but otherwise no way it can be added. I can't help but remind myself of that situation every time I search for anyone's birth on the published lists. My sister appears on the BVS records as "Inf daughter of A. D. Kirby" There was a delayed certificate of birth filed in Smith Co when she was about six years old. But along with a thousand or so others, the delayed certificate was never filed with BVS and to this day does not appear in their records nor does it appear in the Smith Co online records. So far I have been unsuccessful in persuading the County Clerk to forward the delayed certificates to the BVS. I may be mistaken but I think it is a fair assumption that delayed certificates on file in the Clerk's office in many, if not all, counties in Texas never found their way to the BVS in Austin. If you know, I would be interested in knowing if this same situation has occurred in other counties. I apologize for being so long winded - just blame in on my several great great grandfathers who were primitive baptist preachers. One other thing...and I'll quit.. A few years ago I contacted Rootsweb and/or Ancestry.com about setting up a message board for posting missing and/or erroneous birth certificate information. They welcomed the idea but I need someone with more expertise with message boards than I have to get it rolling. Any ideas or volunteers? And if I didn't say so, thanks much for your assistance. Rex

The index doesn't say whether these were recorded at birth or delayed filings, so you'd have to go to the court house and look at the actual birth records.

I don't know Ms. Breedlove (?) personally but have been trying to help her son Ed Lingner which I don't think [but don't really know] is one and the same as Edwin Brack. I will contact him to find out about length of marriage and also more about her second husband. But from what he tells me at this point I'm not too sure Gatha will remember. We have now contacted all counties adjacent to Van Zandt (as well as Van Zandt) with no luck. But in view of the information you furnished I am going to recheck Smith Co. Thanks for your assistance.     2. Hello, I have been to Rome Cemetery and wondered many times who this person with the Hawaiian name was. You solved it by sending around this obituary. It lets me know who she is married to and what her connection to our area was. Thanks for taking time to try to help the person who requested the info and sharing it with all of us. It really solved a puzzle I personally had wanted solved! I am in Houston area living with a daughter in Alvin. My other daughter has bought a house near Alvin also so I am helping them right now. In case no one else sent the obit, and she checks for an answer, here it is: Athens Daily Review October 10, 1998: Irene Kealoha Kamauoha Makekau Rushing Services for Irene Kealoha Kamauoha Makekau Rushing, 71, of Athens are scheduled for 2 p.m. Saturday at the Church of Jesus Christ of Latter Day Saints, 814 Belmont, in Athens, with Bishop Stanley Green officiating. Burial will follow in Rome Cemetery in Henderson County under the direction of Eubank Funeral Home of Mabank. Mrs. Rushing died Friday, Oct.9,1998, in Athens following a lengthy fight with cancer. She was born May 22, 1927, in Napoopo, South Kona, Hawaii, to Henry and Matila Makekau Duvachelle. She and her husband had lived in Lamesa, where they raised their seven daughters. They owned and operated Irene's Truck Stop Cafe for 17 years before retiring to Athens in the spring of 1985. She was a member of the Church of Jesus Christ of Latter Day Saints of Athens, where she was active in serving the Lord until her health prevented her from attending. Mrs. Rushing is survived by her husband of 51 years, Simpson "Simp" Matthew Rushing of Athens, daughters, Lani Gilbreath of Honolulu, Hawaii, Gloria Sellers of Athens, Kathy Reeves and her husband, Earl, and Paula Ambriz and her husband, Perfecto, all of Lamesa, Lehua Kanae and her husband, Tu'uta Tu'akalau, Laurie and Darvy Payne and Charmayne Rushing, all of Athens; brothers, William Messer of Las Vegas, Nev., and Hauola Prim of Kauai, Hawaii; sister, Kalehua Pule of Kona, Hawaii; 24 grandchildren; and five great-grandchildren. Pallbearers will be her grandsons, Gary Sellers, George Sellers, Jason Reeves, Colby Reeves, Curtis Walton, Jeffery Payne, Steven Lopez and Simpson Rushing II. Viewing will be held from 5-8 p.m. Friday at the Church of Jesus Christ of Latter Day Saints in Athens. Donations may be made to the American Cancer Society or the American Diabetes Foundation.
