    3. Dorman, The chain of command was followed to the point of receiving an answer, which was only identity theft. Shirley then contacted you, which was the next link in the chain. In the meantime, we have to take care of our counties and try to remove the broken links. We do not have the luxury of sitting back and waiting for someone else to do something on the archives end because we have no way of knowing if the links, some or all, will be restored or not. And if identity theft is the issue, and 75 years is the rule of thumb, then why were vital records prior to 1934 removed? The archives have been moved for a long time now, and still have links to nonexisting managers, the old archives, the old TXGenWeb site, etc. It does not give us the impression that we can sit back and wait for the links to be found/restored, if they indeed will be. I am sorry if I seem upset by this, but all it would have taken down the line was one email to the State Coordinators list to say check your state/counties archives to be sure you are not linking to the wrong or removed files. Then it would have been on each state's SC to see that their state was not full of broken links. Instead, we had to wait until patrons complained to discover this.     3. They were removed because the State forgot to take the adoptee's names off the records they let out. Then that was fixed and it was let out again.     3. I removed most of the Texas Vital Record data less than 75 years old from the Bell County archives on Rootsweb and USGW several months ago, due to hassle with privacy complaints. However, I don't have dead links to them and a local copy is retained, should the time come when it is appropriate to put some or all of them back online. Joe

Elaine, I suspect the reason many of the "vitals" were removed is because the FM at that time was tired of the constant harassing of those wanting to be removed from the marriage, divorce and birth records. Typically, when people want things removed they don't understand that search engine caches don't move as fast as we do. The issue is identity theft. There is a certain genre of people that are wanting their names removed from any and all records. We allowed them that right when we stated on our records that if they wanted their names removed, it would be done. When you say "many files in many counties" are you referring to the Vital Records files? or are you referring to something else? Exception: Birth and Death Records (a) A birth or death record maintained by the bureau of vital statistics of the Texas Department of Health or a local registration official is excepted from the requirements of Section 552.021, except that: (1) a birth record is public information and available to the public on and after the 75th anniversary of the date of birth as shown on the record filed with the bureau of vital statistics or local registration official; (2) a death record is public information and available to the public on and after the 25th anniversary of the date of death as shown on the record filed with the bureau of vital statistics or local registration official; (3) a general birth index or a general death index established or maintained by the bureau of vital statistics or a local registration official is public information and available to the public to the extent the index relates to a birth record or death record that is public information and available to the public under Subdivision (1) or (2); (4) a summary birth index or a summary death index prepared or maintained by the bureau of vital statistics or a local registration official is public information and available to the public; and (5) a birth or death record is available to the chief executive officer of a home-rule municipality or the officer's designee if: (A) the record is used only to identify a property owner or other person to whom the municipality is required to give notice when enforcing a state statute or an ordinance; (B) the municipality has exercised due diligence in the manner described by Section 54.035(e), Local Government Code, to identify the person; and (C) the officer or designee signs a confidentiality agreement that requires that: (i) the information not be disclosed outside the office of the officer or designee, or within the office for a purpose other than the purpose described by Paragraph (A); (ii) the information be labeled as confidential; (iii) the information be kept securely; and (iv) the number of copies made of the information or the notes taken from the information that implicate the confidential nature of the information be controlled, with all copies or notes that are not destroyed or returned remaining confidential and subject to the confidentiality agreement. (b) Notwithstanding Subsection (a), a general birth index or a summary birth index is not public information and is not available to the public if: (1) the fact of an adoption or paternity determination can be revealed by the index; or (2) the index contains specific identifying information relating to the parents of a child who is the subject of an adoption placement. (c) Subsection (a)(1) does not apply to the microfilming agreement entered into by the Genealogical Society of Utah, a nonprofit corporation organized under the laws of the State of Utah, and the Archives and Information Services Division of the Texas State Library and Archives Commission. Elaine, There was a discussion among the Archives FMs in 2008 concerning the unbelievable amounts of requests to be removed from people "googling" their names and finding marriage, birth and divorce records in the public domain. Some county FMs decided to remove the birth Vital Records because of the 75 year rule in the State of Texas. Its a sticky issue in my opinion. From my experience, I removed hundreds of names a week from those who have requested their names to be removed from the archives. I've been threatened with lawsuits, court cases, bodily harm, cussed, etc. Is there a specific county that you have reference? I later learned of the Nueces County problem and contacted Don Brownlee, theArchives Manager for that county, about that. He is the one who told me the files had been removed due to identity theft issues. And if identity theft is the issue, and 75 years is the rule of thumb, then why were vital records prior to 1934 removed? The archives have been moved for a long time now, and still have links to nonexisting managers, the old archives, the old TXGenWeb site, etc.  It does not give us the impression that we can sit back and wait for the links to be found/restored, if they indeed will be. I am sorry if I seem upset by this, but all it would have taken down the line was one email to the State Coordinators list to say check your state/counties archives to be sure you are not linking to the wrong or removed files.  Then it would have been on each state's SC to see that their state was not full of broken links.  Instead, we had to wait until patrons complained to discover this.
