Received a question about this earlier today and wanted to pass along the information to everyone who is researching in the Great State of Texas :) You can get to the Legislature page http://www.capitol.state.tx.us/ and read the entire history of HB 836 http://www.capitol.state.tx.us/tlo/76R/billtext/HB00836I.HTM Below is what John Miller of the Austin Genealogical Society had to say back on May 12th when the bill passed. Dana - - - - On Wednesday morning, May 12th the Senate Human Services Committee voted out favorably the substitute bill sponsored by Senator Judy Zaffirini. It clearly states that Summary Indexes (only name, date and event-place) are Open Records. Also, that the Bill is applicable to Local Registrars and Bureau of Vital Statistics. If a record would give any information about adoption, parental determination or adoption placement that record would be Closed. I went to the Bureau of Vital Statistics, talked to a supervisor and showed her the language in the draft bill. She told me that there is nothing in the Summary Index that would cause the record to be closed and she didn't have any problem with the wording. Not that it is a big deal, but some clean-up language starts the clock running for the 50/25 years on the event date, not date of filing. The General Index is closed except to "Qualified Applicants" for the 50/25 year periods. Qualified Applicants are defined in the statues to include the registrant, a member of the immediate family, a guardian or legal representative. So o o, "we" headed off the bad guy at the pass and it should be easy sailing. Sen. Z commented that the Committee received about 40 call and letters. That got their attention so she pulled the Bill last week and wrote a substitute Bill which answered our objections. A Committee staffer, Sophia, was extremely helpful with phone calls and faxes of drafts to me, requesting my comments. I appeared before the Committee this morning and thanked them for their efforts on our behalf. >From the Committee, the Bill goes to the Senate's local and uncontested calender and should be passed easily next week. Then it goes back to the House for their vote. Rep. King (the original author of the Bill) has been advised along the way and is expected to concur with the substitution. With his approval, it should be passed by the House. Then to Governor Bush for his signature. You can check the Legislative Web Page to track the status of H.B. 836.     3. April 15, 1921 there was a tornado in Avinger, Texas . Avinger (formerly Hickory Hill) is in precinct 2 of Cass County. Mr Fred McKenzie's book AVINGER TEXAS, USA gives an account of the tornado on pages 204 - 211 of the book. There is even a map of the area with the path of the tornado shown. I imagine the Linden, TX library has a copy of the book and you could possibly get it on interlibrary loan or buy a copy from Mr Mckenzie. Some of the names mentioned as having suffered in the tornado are: Ferrell Wicker Brown Chism Mims Clark Johnson McNiel Dunbar Jackson Jenkins Vernon Barnes Rogers Rhyne Young Neal Webb Alford Fowler Powell Alsup Daye Turner Orr Jenkins Pendley " A freakish aspect of one family tragedy was the manner in which the tornado removed the roof and walls of the family home without disturbing its household furnishings. Those who got there right after the disaster said that the dining table that had been set for lunch was completely undisturbed with all the chairs still in place all around it." Two weeks after this tornado there was another in the Mims Chapel area and some of those names are: Lock, Doyle, Duncan Brown, and Beane. The book gives a vivid account of these events and is well worth the trouble to find the book and read about it. Does anyone know if John Frederick (Fred) Kasling/Kesling/Kiessling actually married Mrs. Bettie Lyles. I have never been able to confirm this marriage other than the application for the license.
