I searched through the new cemetary listings placed on the site and found a relative that I have not been able to locate before. I knew her approximate DOD due to the census records, but did not know her burial site. There were also a number of other folks on the list with her same last name so they may be related. For any Kuykendall researchers in Bastrop County: John Kuykendall tried to claim himself as having conscientious scruples during the civil war and went before the court on 10/1864. The writing of the case, including stating that John had fought bravely during the Texas revolution, was several pages long and indepth. His past service was one of the factors the judge used to dispute John's case. In short, John stated that he had joined the Campbellite church and contended that the bearing of arms was not in accordance with the teachings of the new testiment, that the reign of Christ was to be a reign of peace. The judge stated that many of the members of the church are now and have been fighting in the army of the confederate states and that they do not believe their church would turn them out, for members who were in the war for bearing arms in defence of the country. He further stated that "In this connexion we cannot overlook the valiant services which he avers to have patriotically rendered this country in the trying times of the Texas Revolution. This is a very important fact in this case, for it shows that at one time, applicants conduct warrants the conclusion that he had no conscientious scruples against bearing arms in defence of his country." So, John lost because of past actions and because he "remained connected with a church, that not only continances but many of the members actually participate in bearing arms in defence of the country" and "continued to associate with and treat as breatheren those who not only encourage and countenance, but actually engage in service". "It is not to be informed, that the court reflects on the sincerity of the applicant in the statement of facts to which he has sworn but simply that by the rules of evidance, which are based on common sense and our experience in human affairs, it is found, the declarations of a party, ought not to be relied upon when inconsistance with his conduct and actions." "I feel it incumbent upon this court to hold the applicant liable to perform military service to the Government of the Confederate States of America. Wherefore it is ordered adjudged and decreed by the court that the applicant JOhn Kuykendall be remanded to the custody of Capt. Wm J. Cain, enrolling officer of Bastrop County to be by him assigned to military service in the Army of the Confederate States of America. To which Judgement of the court the applicant excepts and gives notice in Open Court of Appeal to the Supreme Court of Texas." No judges name is mentioned. Hi Tammy, I was hoping you would have had information to break down my two brick walls. :-) I am a decendant of Tempie Arminta Petty and her 4th husband, Charles Bearce. Their daughter, Addie Bearce, was my great great grandmother. She was married twice and had 3 children by both husbands. My great grandmother, Bertha Franklin, was her oldest child. Charles Bearce and Dock E Franklin are the two most mysterious men I have tried to find anything about. Thanks for the urls - have been to the San Jacinto monument twice lately, did not realize they had a library until I checked your note. Another good resource is the Web site for the Sons of DeWitt Colony, Bastrop's neighbor. That site can be found at <http://www.tamu.edu/ccbn/dewitt/dewitt.htm> There are several books which list the "Old Three Hundred", but I can't remember finding a single definitive one that includes everyone. The best I found was in the Clayton Library in Houston, although I don't remember its title. Good luck. Casey and wife apparently died shortly after their arrival, as Curtis helped their two oldest sons (John and James) get their land grants. Another Curtis daughter married Geo. Washington "Wash" COTTLE, one of the defenders of the Alamo, a third one married Bartlett SIMMS. Grandsons James Stewart and Beverly Stewart married BURLESON sisters. She married Abner Bagby SPEIR b 1808 GA; d 1874 Bastrop Co; buried Speir Cemetery Son of Betsey Ann & Abner Bagby SPEIR is Seaborn Jones SPEIR b 1832 AL; d 1899 Bastrop Co.; he married (1) Sarah J. MEEKS b 1837 Miss; d 1873 Bastrop Co; Daughter of SJSpeir & Sarah Meeks is Laura Eller SPEIR b 1858 Travis Co., TX; d 1937 Austin; married (1) in 1872 James M. HUGHES b ca 1852 possibly Leon Co., TX; DISAPPEARED from Bastrop County Nov 1882. I'd like any information on him. I'd like to exchange information with anyone researching this line.
